    A truck stop IS private property. It doesn't matter, however, if it's private or public, or anywhere else. If you are in the driver seat, you have to log line 3. There are two exceptions, but the OP's dilemma doesn't fall under either exception. You violated buddy, plain and simple, and I still think you should leave the country until the heats off.

    p.s. I feel violated because you violated. And, I feel even more violated that others think you didn't violate and even more violated by those that have a cavalier attitude about the severity of your violation. In fact, I think that may be a violation in and of itself. This thread is full of violations and I'm not going to stick around here and get caught up in it when the man shows up and starts popping your collective rear ends for violating!

    Otsby is irrelevant as it was in an apartment complex parking lot and a complain was made by a resident of that complex. That, for all intents and purposes, invited the police onto the property to investigate the complaint made by a person with legitimate standing to make the complaint.

    If I'm out in my own fields mending fences and drinking beer while I work, there is nobody but me who has the legal authority to file a complaint thereby inviting the officers to enter the property to see what I'm up to.

    The other problem with Otsby, is that he was going to or coming from somewhere. If he got drunk at home, went to his car to leave, and passed out before making it out of the parking lot, he had the intent to drive upon public highways. If he had been out at the bars drinking, drove home, and passed out before he made it into a parking space, he had driven on the public roads. In other words, he was either ABOUT to drive drunk on the road, or he had ALREADY driven drunk on the road. If you're on your own private property doing chores that may involve a motor vehicle, and at no time will you leave your property while driving, the public is never going to be placed at risk and therefore enforcement would be outside the police powers of the state.

    As for other places...convenience store parking lots, stadium parking lots, apartment complex parking lots, truck stop parking lots, etc...they all have a few things in common. 1) You don't own the property. 2) You don't control the property or who may enter onto it. 3) The owner of the property may ask you to leave at any time, and refusal to do so is considered trespassing.

    When YOU own and control the property, it is a different set of rules than when you are a visitor upon somebody else's property.

    There's a difference between being on someone else's private property and being on private property you own. As the owner you have far more rights on your land then a non-owner would. That being said, there is no way truck stops, or any other commercial property, are public property. Public property is owned by the public, IE parks and such. Just because it's public property doesn't mean it's open to the public however. And there's the other big difference. Who owns the property doesn't necessarily equate to who can enter the property. There's plenty of private property open to the public. And vice versa.

    Edit: Just to add to OPs concern, being over a bit like this I highly doubt any DOT would even say anything. Just put a comment in the ELOG as to why you were over and leave it at that. When I ran OTR on e-logs I had to go over a few times due to traffic, no parking, etc. and that's all I did. Never had anyone complain.

    Well since the blitz is on and you get pulled in maybe expect a inspection. My guess unless your truck is jacked up you will be fine.
