Logging off duty when in sleeper. Yes or no?

If you where truly off duty under no dispatch you can get Barney Fife's ticket tossed out. If you are between loads it is nobody's business what you do with your down time.<br>If you where dispatched and waiting on a load then Barney can claim the right to now what you where doing with every second of your life. &nbsp;&nbsp;

 

What ticket do you get if you just keep your mouth shut?

 

When ever a LEO asks what you were doing and such, just show them the log and keep you mouth shut. You are not required to go into details of the last time you wiped your behind or stuff a burger down your throat. Only provide what it required by the law and one can avoid a lot of silly crap. You must provide a log when asked, but you do not have to incriminate yourself at the same time.

 

It happen to me a few years back in Washington. Warning ticket for, "logging off duty not driving, while in sleeper berth." I thought the guy was joking. He was one of those "career cops" hair cut and all.

 

Five a day keeps the Captain away..........

 

Thing is, he didn't give me a ticket or put me out of service. He put it on the inspection report with the violation code number. I'm an owner operator so it will probably just jack up my CSA score. Requesting a review will probably be pointless seeing as how it will be reviewed by the issuing officer anyway.
He was telling me how he was a truck driver for 20 years before he became a Nazi cop. I'm thinking BS on that too. I will try a data q review and see what happens. I just can't see how they can justify having to log sleeper time when you are not under a dispatch or a load and are truly off duty. Do I have to log sleeper time when I'm at home in my bed too? It's just ridiculous.

 

again, it has NOTHING to do with being under dispatch or load... it has to do with your physical location... When you are at home, even if you just stop while under load, and sleep in your own bed, you are off duty... NOT IN YOUR TRUCK... if you sleep in your truck, that is sleeper berth... regardless of your load status.

The log book is totally about your physical location, and what you where doing at that time...

 

It's all spelled out in plain English in the little green book.

 

I'm on elogs and have come to like them for several reasons, besides keeping the Company from abusing me or coercion to run.

With a push on the screen I log as I do it. If I get out of the truck I log off-duty and go back to sleeper when I get back in. I edit my logs at the end of the day, before approving, to recover every minute possible. I'm audited by my Company and have had a couple DOTs look at my "day" and have never had a problem.

Like they said, Line 1 & 2 are all about physical location. DOT knows you have to take a dump every day so if all you show are Line 2-3-4 activities it will raise a flag if they want to get picky.

 

If it makes you feel better in 8 years I can't remember ever logging sleeper.
