Max time you spend in sleeper birth?

    Not at all, what I am saying, is that using your logic, reading it verbatim, for a 34 it does not mention sleeper berth.. but it does on a 10 hr break, so there must be a distinction. As they mention it on a 10, it follows that if they wanted it to apply on a 34, they would have mentioned it.

    So using your logic, of the letter of the reg and not the spirit or intent, a SB would invalidate the 34.

    Just pointing this out, not because I believe it, but rather because it shows that the letter of the Regulation is not necessarily the intent.

    I am actually 1 - 1 in cases against a lawyer. Ex wife bullkaka civil court crap, she had the free attorney from the Publicly supported man hater angry women club

    Felt good the time I won. Heard her attorney in the hallway while the judge was deliberating, tell someone "I need to find a different line of work"

    HAHAHAHA!

    What is so funny is the FMCSA HOS rules along with the guidance and the PDF's all over the FMCSA website are clear and all it takes is a small amount of common sense to understand them and act accordingly. What is not funny is when someone hard interprets a rule then tries to drive a square peg into a round hole trying to get it to make sense. Even when someone who purports to be a MCSAP/CVSA/DOT officer ( I will give the person the benefit of the doubt for now) says otherwise they continue to try to drive this false narrative. Over the last several hours I have did 3 searches of part 49 CFR using a boolean search program I own. I used sleeper berth change of duty status and being current as key words. I found NOTHING in 49 CFR that supports this hogwash. There is NOTHING in the FMCSA rules that say it is illegal to be on line 2 for your entire 10 hour break, NOTHING! There is NOTHING in part 49 CFR that stipulates you must change from line 2 to line 1 if you exit the sleeper for a brief time. There is NOTHING that stipulates you must have current logs at all times across all your duty and off duty periods, NOTHING. The only time the FMCSA mandates your logs be current to last change of duty status is when you are OPERATING a CMV on a public road. Yes a carrier can restrict you tighter, but that is the carrier and it only applies to that carrier.

    How would you interpret the keywords "true" "correct" and "current" that are inthe regulation you found regarding proper logging of RODS?

    I posted guidance from the FMCSA website itself which states it is illegal to log Off Duty while your body is in the Sleeper.
    I don't know how a reasonable person figures they are exempt from true correct current logging rules if they know the FMCSA requires them to keep their logs current to right now true and correct.

    I have also presented copy of an actual member of this forum who was found in violation of logging Off Duty while his body was in the Sleeper.

    After all this evidence and proof a driver still wants to log against the law, I have to wonder if they have daddy anti-authority issues.

    Regarding the comments about not being inspected or bothered during your rest breaks, in May 2010 while I was on the Swift trainer truck, we were in a rest area somewhere in California, several CHP vehicles swooped in and started rousting up the drivers whose trucks were idling. They woke them from their rest breaks and ordered them to shut down their trucks irregardless if they had the California Clean Idle stickers. My biggest regret was not having the forethought grab my camcorder and record this. I did witness it and it did happen.

    Make sure that you put the correct sandwich in the remarks. If you say you had ham and the cop smells chicken you will be arrested for falsified logs and wear prison whites.

    You got daddy issues? I heard this is why there are so many strip clubs, the girls have daddy authority issues so the 'get back at daddy' they take off all their clothes and rebel against all authority. Truck drivers like to do the same thing, thumbing their nose at authority, speed limit signs and requirements to log true,correct and up to the minute currently. This is why carriers are going to ELD and driver facing cams-- too many drivers not logging correctly, truly and correctly plus playing with their phones while driving which is expressly against the law.
