You're wrong there. You can't add nothing not originally in your 13 filing. The reason they look hard at 13's is that a filer has the option to change to 7 and that means you could further do damage to others that extend credit. Chapter 7 is better forget all the "do the right thing" crap. I wouldn't worry about not getting a lease trailer anyway.
I had a friend had one of them a couple years ago he did good for a little while and then nothing he gave it back and went to hauling gas.
Met a driver in Tn last week he's with mercer and said he's going somewhere else said the money there wasn't there any more. Anytime I seen there loads or they've called me on one never enough to fool with anymore.

I didn't say you can add debt to a chapter 13, I was stating the courts take your income payments and apply them to the things orginally on your chapter 13. So if a company is holding money back for a debt, the court could take that money and apply it to your debts which would not include your trailer, though the money was being held for your trailer.
Sometimes the court won't allow you to file chapter 7 if you have income. -
And how could filing chapter 7 after 13 hurt Mercer. If they selling you a trailer, the trailer would just go back to Mercer.
Please don't be so quick to say someone is wrong before reading. -
it probably has to do with the finance company. Mercer is just a go between. think of them as a co-signer

mcgoo, have you ever been leased to mercer? I have 2 payments left on my mercer lease trl, I have always made money since I came here, and the loads you see are the ones left after the mercer drivers turned it down. I meet guys every week who are going somewhere else. the trailer lease isn't the problem, its th yahoo behind the wheel.old time, Blind Driver and spyder7723 Thank this.

Not to argue but you are a bit mistaken about how the trustee (court) gets paid and pretty much everything else about a Chapter 13.
Here we go........
I pay the trustee a scheduled payment each month just like any other payment, No one takes money from my account and does this for me say like a garnishment or lien. By the guidelines of the discharge I am not legally allowed to take on personal credit without the trustee's permission but I am allowed as outlined in the discharge to take on business debt as necessary (sell, trade, lease trucks, trailers etc etc). The courts would not intervene to pay or not pay with my lease to Mercer or anyone else for that matter coz it's nun ya in these cases...
The bottom line is really stupid on Mercer's part if you ask me because they started by telling me it was my credit that created the denial and then moved onto the fact that my work history is a little busy. Ok, whioch is it?? But if I bring my own trailer from another source then I'm welcome with open arms. So the job history and credit issues mean nothing in this case?? Say I leased a trailer and gave it back in 9 months. Would Mercer have any trouble placing the trailer with another driver? I say not. Will they get trailers back from drivers with better credit than mine, almost certainly. The thing is if I'm good enough to haul the freight then the trailer lease should be a non-issue. What this says to me is that Mercer is without the power of lease approval and it hurts both of us.
As for failing, I don't take the implication personally at all because I know the business well enough to know that it can happen to anyone. Hence the reason for the Chapter 13 filing and getting this train back on track. Most would have just tossed in the towel and took a big financial crap. I'm responsible for myself and family and I will take care of business. Many see this as a negative but bankruptcy is a tool that may be a last resort but a tool just the same. I used the tools available to me to keep my business going and I will succeed with or without working at Mercer.
I have no ill will to anyone at, for or against Mercer. The decision is what it is and one I don't really see the logic is but that's ok too. I'm hauling yellow and green machines everyday and will continue to do so. See my modified 377 Pete out there give me a shout on the radio or a big hand wave. Yeah, I still wave unlike most out there that seem to be in a trance of some sort...

What is it about Mercer that makes you want to come over here? I told you last year I believe that living in the area you do is not a good place, unless you are fine with bouncing to St. Louis every time you want to leave home, or haul cheap and heavy crap from your area to get going. If you want to haul green and yellow machines this is not the place to be, our rates are to high and we seldom get anything out of them anymore.

I think it has something to do with the cost of getting trls back when someone leaves maybe, but thats just me thinking outloud
