    Yeah he would foot the bill for plates, insurance, any ifta owed, all fuel, and he also said he would have the wet kit installed. Although when i left he would remove it or id pay for it but what do I need a wet kit for to haul flatbed? Lol My cost would be literally just my 1099 taxes, and my tractor. But there would be a one year contract, which isn't a big deal because that's the amount of time we have until our youngest kid finishes school. None of this is set in stone he is 100% open to negotiation, he said I could pay for everything ( plates,ifta, fuel, etc) and he would give me more % but it depends on which way I want it. He just opened with the 50/50 split and he will take care of everything else except tractor maintenance.

    Is he going to complain when you're out there running the speed limit and idling the truck and the fuel mileage is horrible? That may not always be the case but I know I pay my own fuel and there are times that between my speed and idling I hurt my fuel mileage, but it's my bill so it is what it is.

    If he's going to pay for everything except taxes and truck maintenance then you might be ok for a year. I would make sure there is nothing in that contract that gives him the right to dictate anything about that truck, inside of the law of course.

    And, @angrytrans, if you're going to be an Independent Contractor (1099) he cannot by IRS regulations tell you when or where to work. He's saving significant money by not paying the employer portion of taxes and social suckurity and you should be sure your contract/agreement with him is clear on how the IRS defines an independent contractor.

    He's playing fast and loose with the IRS definition by paying ANY of your expenses.

    I watched that a few minutes ago. His screen had a button that said "punish". When do i get that button? Id be good at using it.

    Well my company truck gets 4-4.2 daily, and I run 70 or a bit better to pull the long hills....he owns 40 trucks all with 500-550 isx peterbilts....we also have assigned trucks and he lets people people drop visors, tint, aftermarket lights etc on the company trucks so none of that would be a problem. Hell our roll off driver has a 8 inch drop, and limo tint all the way around, his rules are don't destroy my trucks and no tickets....we actually have 2 5,000 gallon on site fuel tanks at the yard that I'll have access to.

    If that's the case how can mercer pay for IFTA? Or your base plates? I mean they don't directly from what I understand but you get so much off for milage run etc? Right. At least that's how I came to understand it . Do construction contacters not charge for use of equipment to build things? I see it as being no different, Johnny house builder charges X amount to build a house, I charge X amount to haul a product for his company, Johnny house builder paid cash for his man lift from his last job, I paid for fuel from him for a percent of the revenue made overall. I'm not trying to sound like a smarta**, it's just the way I thought about it. I could very well be wrong and it could be illegal, I'm not sure, but i wouldn't see how it could be.

    The difference is, is the general contractor supplying Johnny house builder with the lumber, nails, Windows and shingles to build the house? And telling him what hours he must spend working on it?

    As for mercer, you got a few things inaccurate. You can get ifta and plates through them but you don't have to. That choice is there specifically to clarify the contractor status.

    And I know legally he can't tell me not to take a job
    I know you don't have to take them from mercer but alot of guys do that's why I was asking. And yeah I'm aware he can't directly tell me when to work etc, I didnt want this to turn into some big ordeal, but I do understand where you are coming from. And I appreciate the information.
