That is the law if you are leased to a carrier, such as Mercer.

(f) Payment period. The lease shall specify that payment to the lessor shall be made within 15 days after submission of the necessary delivery documents and other paperwork concerning a trip in the service of the authorized carrier. The paperwork required before the lessor can receive payment is limited to log books required by the Department of Transportation and those documents necessary for the authorized carrier to secure payment from the shipper. In addition, the lease may provide that, upon termination of the lease agreement, as a condition precedent to payment, the lessor shall remove all identification devices of the authorized carrier and, except in the case of identification painted directly on equipment, return them to the carrier. If the identification device has been lost or stolen, a letter certifying its removal will satisfy this requirement. Until this requirement is complied with, the carrier may withhold final payment. The authorized carrier may require the submission of additional documents by the lessor but not as a prerequisite to payment. Payment to the lessor shall not be made contingent upon submission of a bill of lading to which no exceptions have been taken. The authorized carrier shall not set time limits for the submission by the lessor of required delivery documents and other paperwork.

 

Here is the kicker that far too many people don't understand that are entering into contracts that has the carrier paying them beyond the 15-days. Carriers create the contract with wording that the carrier says provides consideration in exchange for not meeting this 15-day obligation. But unless they offer you a choice (pay with in 15-days at X rate OR when we get payed at Y rate) there is not valid consideration to make the contract valid.

I have looked at dozens of lease contracts with carriers and have only seen one that is actually valid.

 

one thing you have to understand about those numbers, that is the avg for the entire 2100 truck fleet. i wish they would give numbers for the 48 state trucks versus the 37 state trucks.

the numbers are actually skewed downward by the guys who only run east to west coast only the ones who will run west for 1.75 and back for 1.40, simply because they only want to load or unload once a week.

even here at mercer you got some guys who cant poor pee out of a boot with directions on the bottom of the boot.

you also have to understand my numbers are the result of using the noodle. i was took off last week for my stepedads funeral and to help my mom with a few things . my first load out is 2.91 cents a mile to the truck to dallas 3 pick ups and 1 delivery point 954 loaded miles and 52 deadhead miles, i have prebooked one to va bch, va 1.81 10,000 pounds no tarp 1427 loaded miles and 110 empty miles, resulting in a one week total of 2370 loaded miles and 162 empty miles, which will result in 5359.01 in revenue less 1600 in fuel, 700 for all fixed expenses and maintence, (100 bucks a day for truck trl, apu insurance and contribution to maintenance fund) leaving 3059.01 after those expenses in a tuesday thru monday period.

lets make it 3000 for talking purposes. thats for one week. the way i scored the 2.91 a mile load was a plan . after being off a week i was number one on the board, so i had first shot at all loads in my area, monday i almost pulled the trigger on a 1100 mile load to rochester,new york with an a/c unit that paid 2.47 a mile. but i passed and about 4 pm the 2.91 a mile load that started picking up tuesday hit the board, bingo we have a winner , was listed at 47,000 i eneded up with 31,000. yesterday, the va bch was offered, it offered two things reload with no waiting , and i could go thru richmond,va and visit my kid at ft. lee , va , plus lift the front axle with that light load and increase the mpg one mile a gallon.

all in all, after a week i will have 3 grand in the pocket. for one week. my personal expenses are a house payment of 600 bucks, and electri bill that avg 200 a month, a water bill of 50 a month, my kids horse boarding bill of 250 a month for her equestrian horse, we avg 125 a week for eats, and my wife uses ont tank of gas a month 100 bucks. which gives me about 1700 a month in absolute obligations.

so after the first week of october , i have the month of october kicked already, with 1300 to spare.

you have to keep in mind over the last 15 years i paid off a 90 acre piece of property , have no car payments ( a 2009 dodge p/u paid for the wifes 2004 van paid for and my 2000 ford diesel dually paid for).

my situation is probably vastly different than most , i tend to wait for better loads, i simply dont feel under the gun so much as i used to. patience is a virtue.

i had my authority for 14 years, ran 8 trucks , i am in full relaxation mode now actually.

fact is some guys can make more profit at 1.75 a mile than some guys can at 2.50 a mile.

september i took off the first week to see my son graduate airborne school at ft. benning and took off last week for the step dads funeral. worked 2 weeks of the month and cleared 4000 dollars after all truck expenses were paid .

yep even my house got robbed and i didnt go home, wife said she had it under control and keep hauling freight.


and i got to be bluntly honest with you bayou hotshot, i just dont think you would work well under mercer's system. you aint ready for that yet. and i dont mean that in an unkind way at all. you are still too independent , when i came here i was ready to cut loose the authority and the stress of running 8 trucks, turns out the housing collapse of 2008 was a godsend to me.

but that being said, with your own authority it seems there is a problem, you may being to rigid on the areas you will run or the rate to leave texas perhaps, with a fellow as unhappy as u they has to be a cause.
