My 1st accident!!:-(

    Actually if you are fired you can to get unemployment. I was fired from Werner last year and I recieved unemployment for 4 months until I got my next job. Also I had be fired from a customer service job a few years back and I recieved unemployment for a few months then so you can be fired and still get unemployment.


    Actually I didnt say the car that hit the girl was coming out of the toll booth. I said I was merginging onto I290 which a 3 lane high way and the car that rear ended the girl was in the middle lane of the 3.


    I understand that's your opinion but let me clarify something. I love my job of driving and so I make SURE I do everything I need to do to be safe to myself and others out on the road. I was 200% alert. I was very much aware of the girl that was in the lane and I needed to get in and I seen her the entire time in my mirror. I get the impression you think I wasn’t paying attention but I was. I see people like this girl everyday they see you coming and don’t want to move and that’s fine with me. Either she didn’t care or she wasn’t paying attention because she had the opportunity to move and she didn’t and when she did caused a accident. I slowed down to let her go behind her and I guess her not paying attention to what was coming in that lane and she got hit. Also I never said I hit her 1st. She said that I hit her with the side of my truck but they determined there was no damaged except in the front when she spun in front of me after she was rear ended. And for you to say that I wasn't doing my job because I got into a accident that was caused by somebody else is so stupid to say and thats some bs. Just because I drive a commercial vehicle doest not make me god and I cant control others actions and just because I drive a commerical vehicle and I get into a accident does not automatically make it my fault because I have the bigger vehicle as I assume that’s what your basically saying. If I were to go back to change anything I didnt I wouldnt change not 1 thing that I did!!

    You gotta fight it. I think you have a good chance to win. It will cost time and money to fight but you will more than make that up by keeping your CDL intact.

    I had an accident a couple days before New Year's day. Here's a schematic from the Iowa State Patrol, how do you think my company will assign the blame-- on me or the other guy? lol

    What I ment by no ticket, in regards to that statement, in the State of WA, when there is sloppy policework, anything done at that scene is tossed out the window. Violations/citations/etc. thrown to the garbage can.

    Dunno about CA, just know in WA, her ticket would be tossed into the trash.

    Regarding 100MPH just after a toll booth, car was already on the main road. That said, a simple Honda Accord can go 0 to 100 in 23 seconds.

    Majority of those "small cars" you see on the roads, can easily go 100MPH within the distance you specified, and time.

    I know she's got a physical ticket in hand, but in regards to WA, (don't know about CA) the ticket wouldn't hold at all in court. And regarding calling a cop to court, not just the cop, but any/all "evidence" and forensics gathered as well to explain in-detail every little thing about it. If he can't, it's bad forensics, meaning they can't pin the accident on either party. Let alone, how to explain why a car going at a higher velocity compared to the other two collided into a car, and nothing was done regarding it.

    Rear ending, under any circumstances, is the person who rear endeds fault unless the vehicle was backing up. per the US Supreme Court. And the cop did nothing regarding that vehicle, nor its driver. That can also be elluded to favoritism, or, show of the officer choosing at will who he wants to/doesnt want to enforce at will. (which is a no-go)

    We have open road tolling, so the cars in the area do not all have to enter the tollway.

    I really have my doubts that a car was doing 100 in that area as rough as the road is. Just my opinion though, since I was not there.

    Thank you, RM. I was about to address open-road tolling. However, I must disagree with you on speed possibilities in Chicago. People in Chicagp go as fast as they want to whether it's a construction zone, cops all over the place, whatever. They just.....go. can't tell you how many times I'd be going 50mph through I-94 north to Milwaukee through that construction zone and be passed like I was going backward. I had forward radar in my truck at the time. Many times, cars would be going 90+, pass a cop and the cop not turn a hair.

    It's Chicago.

    I understand that. I go through it weekly.

    But, the area of the 290 that the OP is discussing is where people are getting on and off right in the same 2 lane area.

    Every state is different ( I amagine) I do know in NY you can collect if you quit for harassment or intolerable work envoriment. (My words not their's)And she's in Pa so who knows.

    Set that aside plead not guilty (may be to late ) get a lawyer and fight it to protect your CDL< forget about the Ins. co investagation they just want to get out of paying for damage.

    Take another job, this one's gone! BOL
