ive been with recent employer for 12 yrs.
had incident on job back in march. wasnt able to make it back to company to fill out a report with management. at the end of month manager gave me a call wondering why i wasnt makeing my bid runs and i explained what had happened.
he automatically said i neede to report to assurance to report my self being off and why.
it automatically put me into fmla. that i didnt request. its like he sent me that way. was going to chiropractor to try and get what was wrong worked out but ended up being more than exapected. ended up being along with real bad srung ankle, twisted hip and 2 protruding disk.
it went to judge without a hearing and got refused caused of not reporting it in time. cause of no peper trail. manager didnt write it down when we talked on phone. that was only few days after it happened. been treating best i could my self now with no insurance.
have gotten alot better now on my own and now trying to find work again. ive got good driving record, was always on time and went way beyond to help them out. but now the company's ive applied at are calling me me back and saying their not going any further with it.
Can the recent employer give bad info to give other companies a reason not to hire me.
im old school about trucking and life.

I often had to battle with comp after the dispatcher WAS told and thought the driver would be fine the next day only to have someone stuck in bed with a wrenched back that wasn't better.
Remember that the load planner was trying to keep the schedules intact and seemed to think the driver would 'walk it off' all the time.
My problem was he was one of the owners too!
Drivers, report all injuries to someone a few pay grades above your dispatcher, local manager, HR or Safety someone with more than tomorrow's schedule in mind.
It makes the process complete and smoother for everyone and gets quick treatment. -

other was reefer all 48 states 53ft till Katrina hit wiped them out small company in Louisiana

I am confused.
First off your former employer was supposed to contact THEIR insurance and file a claim to the state for worker's comp.
Second what judge said no?
Seeing you informed your employer within 30 days, they are supposed to take the info and fill out the forms. It seems the FMLA paperwork should be enough to provide proof. -

Based on the info in posts 2, 4 & 6 above -- it might well be time to hire on the right workman's comp/FMLA attorney -- & get your name/rep cleared.

the supervisor that called me after me telling him what jad happened, he should have reported it then on his side. but from me knowing him and forgetful hes saying i didnt tell him what had happened and that im the one who requested the fmla. not true of me asking for that info of such. me and lawyer thinking hes just saying that to cover his butt. and not looking bad to his supervisors. its still in the works as lawyer knows im out looking cause its gotten hard with no income. they are going by the first email we had and that was in march. incident happened first of march. the time frame is what their going by as reporting it. he just didnt do his job as a supervisor and rrported it when we talked on phone. its his word against my word.
cant find to many honest people out there no more. -
I can vouch this cat ain’t JTR. I caught him trying to work my block a couple of times.
