New Phone Rule

Fines up to $2750 dollars for drivers using various type of handheld Cellular, Qualcomm, Texting and Other which may distract Drivers of CMV and 11,000 to the Company that employees CMV Drivers to use handheld cellular devices while working. It is Fact, they will lighten up your wallet if given a citation. It's not a choice any more. The FHA, DOT are ready to enforce the law. The rule suggest a driver is to find a safe place to pull over (excluding shoulder of roadway) to rec and send your messages.

Where as you agree or disagree with the ruling does not matter, The Man is looking to punish those who are caught violating it.

They will assume you are guilty until you prove your innocence in some jurisdiction many many miles far away on the Date of Appearance, when you are required to pay or plead not guilty.

Looks like they have drivers by the kahunas once again.

 

I think it had more to do with HTC than Android, since HTC's tend to be hit and miss when it comes to bluetooth connections.

 

Total crap this law is!

Oh well, it's law now, so not much we can do. Yet again the government does whatever they dam well please and we just take it. We as citizens should be allowed to vote on issues like this. It shouldn't be a friggin dictatorship where we are forced to just do what they want. It seems like some people enjoy having their nards handed to them by the government. That's good because it will only get worse.

 

Funny I try to talk to on the CB in Montana and you had if off! LOL

So you can take your eyes off the road ahead of you long enough to see whats going on in the car or truck thats passing you and you say they aint safe? POT meet KETTLE.

 

Guy at the truckstop on the CB said the scales were checking cell phones of drivers against logs to see if calls were made or taken during line 3. One driver got hit for 3 phone calls at $2700 each-- over $8100 dollars in fines.

 

Guys at the truck stops may have been telling tales.

It's a regulation, in an industry full of regulations. So it's not that you as a citizen weren't allowed to vote on it, it's that you as a truck driver have to deal with it. If this were a regular law, you as a citizen could vote your representative out of office. Makes sense to me that if you want to test out new legislation you'd try it in a regulated profession first. You get a better feel as to what the backlash is going to be.

 

I would think they would need a warrant to even search your phone if not that's what the security lock is for

I don't know what the law is regarding that. But I've seen enough of the cop shows to know that it is pretty easy for them to talk people out of their rights. --They simply ask to infringe on a persons privacy and the people often oblige!

I've seen countless dash-cam videos where the motorist consents to a search even though they have a car full of contraband. --absolutely amazing! LoL.

 

If I remember I was told d.o.t is allowed to search your truck but not your personal stuff is that right?

That's a case of somebody giving up their rights if true. My private phone is not subject to scrutiny by anyone without a warrant.
