New RE-START rule really sucks...

Probably just the principal of the whole thing of taking off days and knowing you got 5 or 6 days to run hard. Then wondering how much of the construction zones, traffic jams, will eat away at your driving time on the 7 or 9 hours you running from recap. You have to factor in the On duty not driving time cuts into your little recap hours and if you are doing 15min pre trips, post trip, fuel etc. and you had 8 hours Now you are probably down to 7 hours of drive time. Then if you are OTR and you are in a different time zone. Having to wait an hour or 2 until your terminal's time is 12 could cause you to be late. Just lot more trip planning when you have to run on recap.milkdud and driverdriver Thank this.

This new restart is going to ruin a lot of drivers, esp when loads are down during the winter month. Recap may be the way for a lot.

I know I started my last 34 June 30 2013, as soon as it was completed my Elog shows "Eligible Now" for next 34 reset.
The minute you start your reset, look over 168 hours from that time and that is when you may start your next reset is what the regulation says, plus two periods 1am to 5am.
Let's see how things look in 6 months when the snow and ice lock everything up and you got trucks parked everywhere looking to get that legal reset in, I predict a big mess.milkdud Thanks this. -
If you have the first and do not want to take it as a 34, how do you tell them on the recap?
If you have the first and want it, then how do you make it known?
When you take the first 34, do you know you will have a second one?
The part you quoted 395.3, clearly states you must make a comment in the Remarks electing the 34. If not, then would not the restart actually be the recap?
With DDL, you have to make the election.
A friend told me on his eobr, he has to make the election. -

I'd imagine on paper logs you show the election simply by zeroing your hours on the recap itself. If you don't want to use the restart even though you got 34+ hours in and meet the criteria for a restart just show a normal recap. Before this new ruling I never heard or seen anything that required us to annotate we were using a restart, at least from regulations. My last company asked us to note we were using a restart simply for bookkeeping purposes by writing a 34 and circling it by the recap but that wasn't because of any regulation or law. Now, however, I can see it being necessary to declare which 34 period you are using the restart on but like I said it should be obvious from your hours which one you are using.milkdud, tinytim and otherhalftw Thank this.

I write the word restart on my log since it is noted on the DDL at the same way. I am in no way going to give the DOT a chance to write a "Form and Manner" ticket because I did not do it. Nor, am I going to risk them disagreeing with me on whether my intention was truly a 34 or not.tinytim Thanks this.

I agree. So many drivers, so few who've read the Green Book. So much fail in so many safety depts, is it any wonder the general public has such a low opinion of the profession. Pathetic.

Is it any wonder we have such a low opinion of the general public? Until they can step up to the plate and do our profession they have no business talking any crap. That little green book you speak of is ever changing so how do the feds and you suggest we keep up to date with it?
