If a company who owns several vehicles and some weigh more than 26000 lbs, but they only operate within the state and therefore they do not need a DOT #. Do their drivers fall under Federal DOT Regulations? Are their drivers required to have a medical card? Do the HOS apply?

My understanding is you have to have a DOT number period. In AL you get operating authority for intrastate operations from the PCS. I don't know about your state. You do come under the hours of service

Been a few got in trouble here in WV for not having a dot #, they just had 3/4 ton pickups with 14,000 lb trailers pulling a 10,000 lb excavator….

You should contact YOUR state directly for an accurate answer. Some states require intrastate trucks to have them even if the DOT doesn't.

If you don’t go out of state and stay within the 150 miles and only haul your own products you don’t need a usdot number at least up here…….

Depends on state,most require.
Arkansas has an Intrastate number unless hauling only agri products.
Unless you cross state lines you don’t need USDot number in AR.

If you never cross state lines, the Federal DOT has no jurisdiction.
That being said, some states still abide by the federal regs, but they don’t have to.
TN is pretty lax in this area. I think technically you are required to have some sort of authority to haul for hire intrastate, but it’s not enforced. I know you do not have to have a DOT number in TN if you only run Intrastate.
Bottom line is the only authority the feds have over intrastate commerce is only what the individual state grants them, it’s in the Constitution.Last edited: Dec 17, 2023
