Nuclear Verdict destroys small trucking company as a result of another company pulling their trailer

The load was on their trailer, that was a mistake, they should have off loaded the entire load onto the other carrier, not let then use the trailer.

 

If we had a French-style revolution, the first ones to the guillotine would be the class action lawyers, followed swiftly by the personal injury lawyers.

 

I would only agree to do it in that order if we made politicians watch while waiting their turn.

 

Seems like they could just have filed BK , sold the assets in a auction to another LLC they owned and kept doing business as usual?

isn’t that what most companies do when hit with a judgement like that ?

 

What if O/O doing POWER ONLY? Who will pay?

 

America needs mass tort reform badly. These verdicts are just bigger and bigger. If this keeps up, there will be no privately owned companies to run freight. The US Govt will acquire them for pennies on the dollar and they will reduce trucking to a lowly wage and it will be federally regulated and they will hire all the illegals to run the freight as cheaply as possible.

 

Doesn't sound much different from how it goes right now besides government ownership.

 

Just remember this fact …

there are 1.2m lawyers in the United States

there are 3.5m truck drivers and owner operators in the United States.

the form of government we have, has allowed us - the people - to allow lobbying to take the place of our voice,

The group represented by largest groups of lobbyists are lawyers.

The group represented by the smallest groups of lobbyists are the truck drivers and owners.

you can see where I’m going with this, tort reform will never happen.

 

Even one of our vice presidential candidates, John Edwards, was an ambulance-chaser-type lawyer. Had a huge mansion that he built from the money he made from suing hospitals and doctors for malpractice.

Why didn’t the company just file BK and start over under a new name ?

construction companies do this every couple of years when they get sued .
