NY trailer wheelbase law

    Driver was ticketed on I-81 for the following:

    Violation code 392.2DIM Section 392.2 "DIMENSION VIOLATION (WIDTH/HEIGHT/LENGTH) - 3853E - OVERLENGTH KINGPIN DISTANCE - ALLOWED 43' ACTUAL 46'

    I think federal law trumps NY law while on I-81 but I can't find this law. Can anyone find it?

    Not aware of any federal laws. If you were 3 feet off, chances are that's the difference between the center of the tendem assembly and and the center of an axle. Check the state rules in the front of your rand McNally. I don't have the rules in front of me.

    The federal law I’m referring to is the STAA National Network of qualifying highways and access roads. IIRC you can go anywhere on these highways sans permit with a 53 ft trailer so long as your trailer measures 41 ft or less from KP to center of rear axle group.

    FMCA regulations take precedence only when they are the stricter of the rules between federal and other jurisdictions. States, counties, etc. may enact stricter or more prohibitive rules than federal regulations.

    It appears they make this dimensional violation fall under the federal 49 CFR 392.2 rule saying you must also obey rules of all jurisdictions in addition to all federal ones.

    49 CFR § 392.2
    § 392.2 Applicable operating rules.
    Every commercial motor vehicle
    must be operated in accordance with
    the laws, ordinances, and regulations
    of the jurisdiction in which it is being
    operated
    . However, if a regulation of
    the Federal Motor Carrier Safety Ad-
    ministration imposes a higher standard
    of care than that law, ordinance or reg-
    ulation, the Federal Motor Carrier
    Safety Administration regulation must
    be complied with.

    Don't remember NY, but Cali is 40 feet, other states have different rules, so, I guess states Trump feds.

    Generally those rules do not apply to trailers 48' or less.

    Kingpin to Rear Axle Maximum Distance

    Also have to watch for rear overhang in Canada and Maryland. Not to exceed 35%. There may be more rules to overhang, not sure. Michigan is no less than 37' trailer wheelbase. So a heavy load from California to Maryland may be difficult to meet both laws. 40' max kingpin to rear axle + not to exceed 35% rear overhang usually leaves 1 or 2 holes of adjustment. For me it is 1 set of holes.

    That map says 43 ft to center of rear axle........it agrees with the cop. I could’ve swore:
    1) NY measured to center of axle group
    2) the National Network and it’s access roads didn’t have to follow the NY DOT laws.

    43 to rear is approximately the same as 41 to center of group. Ny allows 36,000 on tandems statewide.

    I don't believe there is a blanket rule for trailer wheelbase/kingpin to rear axle. Every state doing their own thing. Generally it's 34k on interstates, but ny is one of the differences. Colorado 36k. New Mexico 34320. Rolled across i70eb scale at Colorado from Utah at 34300 drives, hauled me in tried to tell me I was overweight. Said to him there's no way I can say the following without being a smart ###. Is this a joint scale with Utah? No. Colorado is 36000, no? We are 36k. Conversation over. I had just fuelled at the pilot in green river Utah and was gross 79960. 11660 34300 34000. I kick myself for not going that extra 40 pounds or 5 gallons.......now you have an idea of just how exciting my life is lol
