Off duty vs sleeper berth

    so you have to have a 10 hour break after 14 hours but does anything say you have to be sleeping in that 10 hours. Can you sleep in a daycab if you log it as off duty not sleeper berth. I'm not saying I want to sleep in a daycab I'm just a bit confused by all the other threads discussing this

    Technically you can be off duty. When questioned later as to what you did...you were off duty. Were you well rested? That’s another story

    If you stop for lunch, you’re off duty...you can’t sleeper

    Technically, you have to get out of the truck. Realistically, no cop is likely to give you a ticket.

    I've slept in a day cab and logged it off duty.
    Is there a regulation that specifies where you have to spend your off duty time?

    I worked as a motorcoach driver for 20 years, and we were always told that we had to be out of the driver’s seat whenever we logged off duty, and I assumed that was the case here. But a little Google search gives this:

    To be counted as a valid break (for compliance with the 8-hour/30-minute rule), it must be logged "off duty" or "sleeper berth." In general, to be “off duty” the driver must be free of all obligations and responsibilities and free to leave the premises.

    Nothing about leaving the truck, so I stand corrected.

    Yes they changed the regs in 2012 to clarify that the driver could log Off Duty in a "Parked" commercial vehicle. This would allow daycab drivers to do their 30's in the cab as long as their vehicle was parked. Prior to that it was illegal to log off duty in a day cab or even a sleeper truck unless you were in the sleeper and some have said they beat it by sitting in the passenger seat as off duty.
