Pending public drunkeness, need advice...

I would definitely see what your lawyer has to say. I'd also get into counseling immediately so that I can show the court I am taking steps to resolve my issues going forward and leniency is more likely.

I would discreetly look up the company policy relating to he matter as well so you know what's likely coming on that front.

Considering you were looking and have an offer from another company, take it. It can be months before the matter is resolved in court. Make the move, clean up your act on the road, get counseling to show you are serious and if down the road the charge affects your job, well...you were making more coin in the meantime. But if it goes in your favor then you are in the job. You wanted to be in.

 

I just have a nightmare scenario in my head where I accept this offer, get there, they do another background check (after already doing one several weeks ago) and see I have this pending charge and sack me.

Then I've already left my current job, and don't have the new job and im screwed.

Admittedly I don't know how realistic it is for
1: the new company to run another background check after already running one on me
2: if a background check would even show this pending charge since it's a summary offense in PA.

My anxiety is just 10/10 right now...

Ironically the lawyer mentioned that he's going to have me do a counseling class for the exact reason you mentioned.

 

The new company isn’t going to do another background check after just doing one. They have to pay for that. LOL.

 

Someone please explain how his current company would find out about it. I can see a new company doing a pre hire background check and seeing it.

It’s not like it will be on his driving record that carriers have to check occasionally.

Even if the new carrier saw the charge so what. Sure it will be an embarrassing for the OP to have to deal with this the rest of his life but it’s not connected to driving.

Impossible to say. The legal system is a strange and unpredictable thing. Things can go one way or the other depending on if the judge, prosecutor, lawyers are in a good mood or a bad mood. Ive been thru the legal system many times and its always a crap shoot.

 

I was just under the impression that anything relating to alcohol on your record, even if it's not driving related, is super bad news in this industry in regards to employers accepting you for positions

 

Make sure the lawyer is a good one ,
And they can Probabaly get it reduced or dismissed.

did the cops do a breathalyzer or a blood test ?
Is there documentation that alcohol was involved ?

was a trip to jail involved or just a written summons ?

Id say your odds are pretty good of getting it reduced or dismissed if you don’t have any previous record
and you didn’t get into a fistfight with the cops or something like that.

 

I apparently admitted to the cops about having alcohol. Drunken me forgot to not admit anything to them. I don't think a breathalyzer was done. Definitely no blood test. I was certainly acting #### faced in front of them though. On the report it says I admitted to alcohol.

I did spend the night in jail, as they said, to sober up. Though I distinctly remember not being violent or rude, but very talkative and jovial.

I do not have any record at all.

 

Good point, could have been a medical episode - unless there was a test.

Agreed you need to make changes, quickly. If you’re prone to binge drinking leading to blackouts, it’s not many steps before terrible consequences arise.

I have a very naughty neighbor down the road that managed to spend a ton of money and get himself out of a 2nd DUI, by presenting receipts from a pharmacy where he bought allergy medications.

His defense was his repeated attempts to ‘blow in the bag’ were hindered by the allergies.

He’s non CDL, but at a highly paid job - he admits wanting to change his ways, but repeats the same behavior.

It will eventually be his downfall I’m sure, and I can’t feel sorry for him - his entire circle of family and friends have attempted to help with no avail. My fear is that he kills somebody else.
