sorry to hear that, but many comp lawyers take on a case for free, and you pay them at the end out of any settlement.

Yep, I was able to do it all till this doctor requested that exam. Oh well I'm glad Texas allows us to bring a third party lawsuit because that game they are playing can work two ways. The pipeline company where this happened is not going to be very happy with them when we file this lawsuit. I would imagine they will consider pulling the contract.

You THINK you were able to handle it all but I assure you everything was stacked in the favor of your employers insurance company the whole time. They will bend you over the fuel tank with an alligator smile. That's why it's so important to hire a lawyer. When I got hurt, I didn't want one either. Then I noticed a huge behavioral shift between myself and management. Shortly after they brought the games and disrespect. It was clear I needed legal counsel. Everybody think their company cares about them but the fact of the is they don't. Get hurt on the job at most companies and this becomes very clear. A rude awakening for many, no doubt.

Your absolutely correct. Quality Carriers had the sheet over me too. But when my back is against the wall like it is now, I'm going to fight back. I have an appointment with 2 different attornies on Friday and I'm going to pick between the two for my 3rd party lawsuit, both said I shouldnt have in issue with that, or the dispute, but they are only going to handle the 3rd party suit. I'm going to give Quality till Friday to do the right thing, if not, I'm going after the other party for every dime I can get. Texas filed the diapute for the wages they cut off and said I shouldn't have any issues with the dispute since I have 2 Dr's orders not to return to work till the exam plus a prescription for the exam to the physical therapy office he sent it to. They just thought they could run over me and Id lay there. I'm game to the core and that's not happening

Good for you, Driver. They won't make it right. They don't care about you. All they'll offer is tricks. Go with the best legal council you can get.

the employer "may do the right thing" for you, but then expect to be officially fired as well.

You can hire an attorney to find the best attorney to win your case. An attorney will look at actual case histories of cases the attorneys worked that are similar to yours. It is worth the extra effort to get a suitable attorney. If you judge it will be a quick out of court deal then this may not be necessary.

Everyone is aware but they are siding with the insurance companies adjuster. Hell, even the lady at the FMSCA said the investigator marked the complaint as valid after reading the complaint and looking at the Dr's orders. She sent it to the local office for them to visit QC at the main office in Florida to ask why they ordered me to return to drive, against my Dr orders and when I refused, cut off my temp benefits. According to the FMCSA thats coercion and against the law.
