Question about PC

    i think the problem with PC is that the rules are too vague:

    If the nearest safe haven IS in the direction of the load's final destination, then is it legal? Seems to me to make sense that it SHOULD be legal, but the wording seems to imply otherwise?

    FWIW, our company gives us a 20 mile limit......

    Yeah they are. What may be ok during an audit may not be to a LEO.

    Distance and not logged hours is what reasonable is about.

    You guys want it to be unregulated and you all want the fmcsa not to answer your questions, because once they start dealing with pc, they will screw it up for all of you drivers just like they have for everything else.

    Depends on your company. Ask them. Crete Carrier allows a maximum of 200 miles PC in a day. Your company might allow less, or measure by time.

    Thanks for all the advice guys, i decided to play it safe and im just gonna do a 34 hr reset and deliver monday night, so i dont have the thought of getting into a crash and being on pc passed all my legal 11hr and 70 hr limits. With my luck u would be reading a story about me on cdl life lol. Elogs are just frustrating sometimes but i guess its the game we all have to play

    At the end of the day, the risk isn't worth the reward. You can probably do it 10 times in a row without problems. But the 11th time you do it, and it ruins you for years to come. IMO, you made the correct decision.

    You're correct ,it's guidance, not law. The law (regulations, actually) don't give you any sort of personal conveyance. Pc exists only within guidance, so you really do have to follow said guidance.

    If you want to use that guidance is not a law you have to fall back on the regs, which all States have made law.
    The regs state all time at the controls of a CMV is Driving. There are zero exemptions to this definition. I.e. if the truck is moving it has to be Drive. The guidance is the only thing that allows one to go to a movie. Or any other personal use.

    On duty driving or off duty driving. Sure, they are both "driving".

    Again, there is nothing in the regs for off duty driving.
    If you are at the controls of a CMV you are on the duty status of Driving. There are zero other options. Doesn't matter what you want, what matters is the law.
