Ah. Ok. I see them a lot also coming through the Fort Worth yard to drop/pick up a load. But I spend a lot of time at the Fort Worth yard.
There are also the l/p operators that have paid off their truck, had JCT sell it for them and then ordered a new truck from dealership and Three Diamond Leasing bought said truck and then leased it to same driver. We know a couple of married teams who have done just that. Of course there are a few drivers who have brought their own truck and leased on with JCT.
There is at least one (probably more) driver(s) who run California dedicated who own their own truck but pull JCT trailers all over the state.
It will spend years in court. Just like CARB did and well...... But, large carriers are supposedly already telling their California based contractors to either move out of Cali or go get your own authority. And, if they don't their contracts will be terminated on Jan 1. Edit: Just heard on the radio that New Jersey has a similar law. Not as wide of a scope, but are looking at expanding it to be more in line with California. There is also 3 Presidential candidates (Bernie Sanders, Elizabeth Warren, and Kamala Harris) support the law. Also, OOIDA fully backs the law.
They're not backing it, per se. They're saying that it could have some benefits as far as the companies that do wrongly classify drivers as ICs. OOIDA an outlier on A.B. 5’s implications The Owner-Operator Independent Drivers Association, despite the warnings of other trade groups and attorneys about the law’s implications, has spun A.B. 5 as some what of a positive, or at least a neutral, development. In a statement to Overdrive, OOIDA says that carriers in California have been wrongfully classifying drivers “for decades.” The group supported the legislation’s passage. “Lease-purchase schemes have plagued the industry for a long time, and there are plenty of carriers that take advantage of traditional lease agreements as well,” the group said. “However, there are equally as many truck drivers that truly are independent and we’re concerned that codifying a complex court decision [Dynamex] might go too far. Our hope is that this legislation will force motor carriers in California to rethink the way they treat drivers and either hire them as employees or restructure traditional lease agreements to give owner-operators real independence.”
The thing is the law will make it illegal for someone who already owns the truck run under someone else's authority. They are saying either become an employee or become a carrier. No middle ground. Not everyone wants to be an employee. Which is why they bought a truck in the first place. At the same time, not everyone wants to be a carrier with their own authority. Which is why they lease their truck onto a carrier. That model has worked for decades and in comes California and say nope. Not good enough. It's another step to becoming a nanny state. The more we allow the government to try and "protect" us from ourselfs; the more freedoms we lose. We should be free to run a business how we want (within legal means of course). You want to L/P a truck. Go for it. It's your risk and no one elses. Want to become a carrier....go for it. Want to just lease your own truck on to a carrier....have at it. And, it don't only affect trucking. It will apply to lots of other industries that use the IC model in any form. It for sure will affect the ports in California. Which from what I understand is someone upwards of 90% IC drivers (mis-classified or not). This law will wreak California's economy. And this might sound mean, but I hope it does and opens the eyes of the dumb###sery of the leaders they put into office. And if one of the 3 Presidential Candidates that support this law (and makes it nation wide) makes into the White House.....then oh boy are we in for a world of hurt.
