The problem with that is the DOT cop that did it will be a choir boy in court. That judge won't be able to smack that hammer down fast enough with a Guilty next case ruling. Now your out the fine. The lost time and most likely a violation noted in an inspection. I don't like what @TripleSix said, but I am forced to admit these DOT cops do this and he is correct. Best do what that pre pass says.
Info on the PrePass site makes it pretty clear that you always do as the PrePass signal tells you to regardless of what other the signs may be saying. No signal and the scale is open you go in. The only exception is in some States if you're hauling hazmat or os/ow you always enter an open scale even if you get the green PrePass light. The PrePass sight has a list of the States and their particular rules.
Years ago, in the little coup that was on 59/20 from Mississippi/Alabama line, there was a sign that said TURN CB RADIO OFF. Well, we were riding along, and this kid was bragging about how his grandfather was a trucker, his dad and all his uncles, and how he himself was born in a truck and he know's everything he needs to know about truckin. He pulled into that eastbound coup and they weighed him. "Driver, pull on around back. Bring in your permit book, logbook and your fire extinguisher." As I went by, I saw the kid walking towards the scale house carrying his permit book, logbook and fire extinguisher. We were howling with laughter. Was on a crane move from Houston to Haines City FL. OSOW, about 20 trucks. We stopped at that TA in Marianna FL. Got up the next day and stepped eastbound. Came up on the scale. This little old woman comes out and I greet her good morning and hand her my permit. She stepped to the front of the truck to doublecheck my base plate. One of our trucks went flying by flagged and bannered. She pointed at the driver and he tooted his horn. She grabbed her phone and called the Florida HP. We see him up the road, 5 miles later, cornered by 4 or 5 full growns. They voided his OSOW permit and wrote every ticket they could. And he had to purchase another OSOW permit. We went to Haines City, got unloaded and went back to Wildwood and stopped at the TA. This driver got into Wildwood right before dark, still with his load on the wagon. I asked him why did he run that scale, and he said,... "But the PREPASS blinked green!" Deception? When that girl dropped that bridge with her truck on it, with all the signs saying 6 TON LIMIT, Do you think her excuse of not knowing what 6 tons limit mean made the judge forgive her? You know full well what the judge had to say about that. Do you really want to appear before a judge and tell him how the HP deceived you, when there was a sign out on the road that said "But You Honor, I didn't understand what that meant." You know exactly what the judge will say next, dont you?
I think were all missing the important answer here..IF you go into the scale..for god sakes maintain the speed limit thru the scales!!!
Cops are there to enforce the law, judges are there to interpret and uphold the law. In the states that have weigh in motion, do they even have a law to address that situation? If not the DOT either way they want. They could write up one guy for doing it one way and the guy for doing it the other way. Hell yeah I would challenge it if there is no laws about it.
