Sent for random drug screening while off duty

    Then you cannot be called in for a random at that time, but since random lists are sent out quarterly .... you'll be right for the picking right after vacation

    While I get that many drivers fail to use their heads with this post there are a few unanswered questions about this.

    The first thing that you are not going to like is what I have to say, you don't have to be on-duty to be called but you do have to log on-duty when you are being tested which includes to and from the test.

    What bothers me is why does anyone have to remind you or tell you to be on-duty for a test?

    This is common knowledge that anything to do with the job requires you to be on-duty and only the drivers who are not very good drivers will not do what they are supposed to do, FOLLOW THE RULES.

    The second thing is what's the rest of the story?

    It is clear the observation requirement has to be used for a narrow scope of reason on a random, one is you are in a return-to-duty status which means you blew a test before.

    So why was the test flagged for an observation test?

    Third the company makes the call, no one else. They call you, you can't go because of say you are on a cruise ship in the middle of the Gulf of Mexico, a little hard to get to a collection place, right?

    I know the excuses, some are pretty legit like going into surgery or a doctor's appointment and there is some latitude but overall, you have to make an attempt.

    The last thing is, if you don't like this, then be diligent to pick out those who are causing the problem. This crap didn't start overnight and it isn't a case where the drivers are all pure and innocent as the wind-driven snow, a lot of scum out there behind the wheels and they get away with all kinds of crap out there so if you are a person that looks the other way, don't cry about the crap you have to put up with just to drive a truck.

    Again, that's only true for alcohol. For drugs (controlled substance) they can call at any time, even while on vacation.
    I've already posted the regulation....

    Yes you can. Just not a random alcohol test. You can be sent for a random drug test when ever they want.

    Just the insinuation rattles me.

    I had a highway patrol tried to arrest me for dui alcohol. Did everything he could to make me fail. And when the breathalyzer came back negative. He charged me with dui drugs.

    It was dismissed before court.

    Yeah. I get rattled. 20 years later.

    I saw one former DOT officer say he specifically looked for logging on duty for a random while doing audits because it's an easy gotcha for most.

    For the vacation, if you notify of the dates before its really not a problem with the way the time frames from a consortium's perspective are applied unless you're getting into greater than a month territory.

    I think the OP stated the observation requirement was in place because his first sample was too dilute, although he said it another way.
