So let me get this right, your buddy wants to leave, the cops show up and say "I'll arrest you for trespassing" please provide department the officer worked for and his name, I'll contact him and find the truth, cops don't arrest for trespassing when someone wants to leave! They arrest when they refuse to leave! And yes I do know a little about the law

1) he went to a shipper, to get loaded...load wasn't ready...wouldn't be ready for hours like 2-3am..... He wanted to drop trailer, and goto the truckstop not more than a block away and he threaten to call the cops as he told them they cannot hold him against his will. The shipper called the cops for him, cops came out and basically told him since he signed the bols, etc.... that he wasn't allowed to leave, and if he persisted on leaving that he would be arrested.
2) He explained to the cop that he would be out of hours by time they got through getting him loaded and he needed to get to a safe haven, cop didn't care and told him same thing if you persistent on leaving he would be arrested for disorderly conduct.
3) He then explained that the shipper needed to give him a place to stay since they wouldn't allow him to leave and he would be out of hours....cop told him that since he already signed the bols etc.....that once they were done loading him he had to leave, and if he didn't they would call that same officer out and instead of being arrested for disorderly conduct he would be arrested for trespassing.
According to the officer once one has the bol's sign and back in possession whether loading or unloading that is when your permission or your welcoming to be on the property ends and at that point becomes trespassing.
again realize this happened in Il. and in other area's where I have been where I have actually called the cops out in order to leave I haven't had an issue. -
It depends on a lot of factors. Most people who say you can get one EVERYDAY probably spends a lot of time in truck stops, but it depends on what you call a day. If i have 11 hours to drive, im gonna drive it out as much as possible. Im not on E Logs, i run paper, so i lie like hell to get the most out of my day and usually drive about 15 hours. 10 hours to sleep? not hardly, sleep maybe 6, fix the log and gone again. Im not in a truck to sit around and mingle in truck stops and i only even go into truck stops to shower, fuel and grab food occasionally. I dont sleep at them at all unless its a no name one people hardly use. I take food with me, or i eat in real restaurants and use bathrooms in stores etc. I try not to go out of my way to do anything and keep rolling until i come to what i need on my path. I roll the miles and do my job. Sometimes i have a couple hours to BS around, but usually the BS time comes when im sitting at a shipper or receiver and there are no showers there so that down time is basically useless and i have to swap it all around to make time in more conventional places such as truck stops. I PREFER to take showers before i go to sleep but that rarely happens. If i wake up at 5 am to start my day, " depending on location " ill go in or drive to a truck stop and grab a shower if i don't have to wait in a line for 2 hours. I don't have time for that crap, so if i have to wait ill roll on until about 12 pm, that will be the time most swift drivers and the other parking lot occupiers have ate everything in sight, stunk up the bathrooms, used the showers, fueled and are on their way to begin their 5 hour work days. If i cant get a shower then, ill wait until about 1 am to 3 am. You will learn your time frame to do things without hassle. Or at-least i have. You cant just say you will get a shower every 10 hours as you would at home or you wont make any decent money. That don't mean you gotta run around for 3 days without a shower, it just means make the most of your schedule and time. However, there has been times when i couldn't shower for 2 or 3 days because i wasn't at a truck stop that had showers, or being stuck at a customer or in BFE.. Some drivers are just to lazy to shower, some are just tight with money and wont spend the $12 for a shower. Some drivers are afraid, YES afraid to shower in truck stops. With all the free shower programs, there is really no excuse for going without showers. If im in population, ill use my shower cards for free showers or if im in an off network BFE place that actually has a shower, i don't mind paying for it. The last time i went 3 days without a shower was because of that E LOG bs had me stuck at a home depot and i couldn't leave " legally ". I took my truck somewhere else and that crap wont be in my truck ever again. On average, i get a shower on the road anywhere from 10 to 30 hours depending on circumstance. Trucking, for most of us old schoolers anyway is a way of life, not just a job so we kinda lose our typical everyday home life routines and adapt to our job turning it into a way of life. Some things you have to sacrifice every once in awhile, that's one of many things that set a lot of truckers and steering wheel holders apart. Observe, Adapt, Overcome, Thrive!

I call BS... There is no law that says you have to stay at a shipper or receiver for any reason. It would take a DUMB cop to tell a person because they signed a BOL they cant leave. and an even dumber driver to comply with such. Yes, the shipper can say NO you cant drop the trailer and bobtail out, usually its " Safety Issue ". However you can be an ####### if you want and drop it and haul ###, but you have broken no laws. They might consider you late and refuse to load it, call your company and cause you all kinds of pains in the ### but your not going to jail. The TRESPASSING clause ends when a security has allowed you inside the property, or if a gate is wide open and you have cause to be there and nobody has asked you to leave. Trespassing is illegally entering a property without AUTHORIZATION- PERMISSION. And yes, out of hours or not if the shipper says LEAVE you got to go. The DOT law has nothing to do with them and you look like an idiot trying to tell them your out of hours and cant leave. Its YOUR fault for poor planning, according to DOT and COMPANY standards. Im a driver, i know better but what they say goes. It was his job to make sure he had the hours to pick up the load and find a place to shut down in compliance. Ive been told this stuff so many times i feel like a company spokesman. i was run out of a truckstop in Wyoming before by the local sheriff. It was snowing bad and roads were closed ahead and i was just parked in the automobile parking lot at a TA truckstop because the truck side was full. it was about 10 of us parked there. The Cashier told us we had to move and i used the OUT OF HOURS excuse because i was out. She called the cops and he said he didnt give a ####, i had to leave or be arrested for trespassing. I was puzzled and i said but its a #### truck stop, how am i trespassing?? He said its private property and if the store dont want me there i have to leave. I kept explaining about the DOT LAW and telling him how i was gonna have to break one law to abide by his law. I talked until he was ready to kick my ###, but i finally left and drove about 40 more minutes on i80 and parked in a BAR / nightclub parking lot. Point being, nobody gives a #### about us or DOT LAW so there is no sense in even trying to use it as an excuse to anybody.

Try to shower EVERY day. I'm new to the industry and have only been out 3 weeks solo. I won't pay for a shower at the big truck stops I have at a Mom and Pop, <$6.00>, but until I get free showers built up from fueling I make sure I get to a free shower. Baby wipes are a MUST. It's not as bad in the winter cuz you don't sweat. The longest I've gone is three days. By that third day I made CERTAIN I got cleaned. Like many who've posted, I don't feel like a human if I can't shower. I plan my 10's at a truck stop I know I can shower. I will either shower at night if the line isn't long or get up early to shower. No need to waste time waiting to clean.
