@Chinatown - with all due respect to your helpful nature, I have enough trouble dealing with stupid during a day, without drugged and stupid skirting the filters and rolling down the road.
There’s a root issue that needs addressing before advising folks to apply to bottom feeders that will simply put warm meat in the seat.
Stupid husband

honestly, i worked for a company now long gone, i think US Express bought them out.
here was THEIR policy (my former employer, NOT US Express..
"a team truck, either trainer and student, or BOTH drivers.....if ONE had ANY SORT of accident, BOTH WERE FIRED...!!
how's THAT for being unfair to the non driver at the time?
company said right out, "if ONE has an accident, and IF the other was in the jump seat, HE/SHE SHOULD HAVE HELPED WATCH OUT for the driver"
ALSO, if a driver of any team had a rollover, BOTH WERE FIRED, company way of thinking they are BOTH most likely not getting proper rest, or driving carelessly.
it sucked, but that was thier policy.
That company was Victory Express, out of Medway Ohio. this was back in the early/mid 1980's.....
i just looked it up, yes, US Express bought them out.
COMPANY NEWS; U.S. XPRESS ENTERPRISES IN DEAL TO BUY VICTORY EXPRESS
now yes, many here started to judge, but in all frankness, can you blame them..??
i mean you know, HE IS IN an industry that any use of drugs, alcohol are prohibited at all times.
he "popped" a positive test result, so the company was well with in their rights to do one of two things.
1) MAKE HIM GO to a SAP program
2) fire him.
they chose number 2
now, what HE HAS TO DO IS, attend a SAP program ON HIS DIME, and that can be costly.
his "chances" of another job are far better if he goes thru a SAP program....IT IS NOT a guarantee he will be hired again, but at the very least it SHOWS he is serious about being clean and being a good worker.
best of luck, but you gotta understand, when drivers are "popped" for a positive drug (or) alcohol test, many of us "jump" on the person, cuz HE IS SUPPOSED TO KNOW BETTER.
i think had he PASSED a drug test, they may NOT have fired him heck, not even yell, or scream at him, for what the other driver did......but your husband GAVE THEM Carte' Blanc on a silver plate.brian991219 and Bean Jr. Thank this. -
Cringey, sad and a loser. You're over your head. Goodluck with your junkie husband.

I don't buy his story, it seems there is a lot more missing. Companies don't spend the money to have an excuse to just fire someone for a mirror, they can just fire the person but a mirror, nope.
I venture to guess he is leaving out a lot more.Long FLD, brian991219, Just passing by and 2 others Thank this. -
Oh to answer your question, yes it was a waste of money. We, all cdl holders deal with drugs, there is absolutely no excuse. Now if he can get hired, he still has to go through an rehabilitation to become legal again.
I suggest he finds another job outside of trucking.QuietStorm, stillwurkin, brian991219 and 1 other person Thank this. -
I'll start by stating that I have no use for illegal drug users operating any vehicle, especially a CMV.
However given the information available, it appears the controlled substance test was not required by the FMCSR, and therefore could not be reported as a positive result to another carrier in accordance with the regulation pertaining to investigations and inquiries .
It appears there were no fatalities, no injuries requiring immediate medical attention away from the scene, or disabling damage. And no citation. If this information is correct, there is no requirement to test and the result cannot be forwarded to another carrier as such. -
I know the plumbing company my husband and I use to work for required a drug test if ANY accident occurred. My husband's work truck was parked outside of an apartment complex when someone hit him and he still had to test. The next time we were driving down our road to head to work and a drunk driver hit his mirror (lucky that was all) and took it off and yet again, hubs had to test. Some companies do it to waive liability.
Just passing by and Sirscrapntruckalot Thank this. -
Yes, the employer/carrier can have policies more stringent than the FMCSR and conduct controlled substance/alcohol tests for whatever reason they choose. The employer/carrier can also have a disciplinary policy for these tests. It is important to note that because these tests were not required by part 40 or part 382, the results cannot be offered to a future carrier/employer in accordance with part 391.23.
From 391.23:
(1) Whether, within the previous three years, the driver had violated the alcohol and controlled substances prohibitions under subpart B of part 382 of this chapter, or 49 CFR part 40.deathB4decaf Thanks this. -
That's really good information. I genuinely did not know that. Thank you.
-
And the same can be applied by any trucking company against a orientation applicant. The company can choose to be more strict.
As far as the truck cab mirrior in a big rig being taken off with no one apparently aware, I find that hard to believe. You would have to be really high and in your own la la land to lose one of your mirrors and not notice.
Buddy stated something else remembered from the old days long before today's CDL etc. Anything at all happening you could be fired for disciplinary purposes.
As far as suggesting the husband to do something and he does a total opposite that's not good. I have a feeling things might not end well with this marriage in time unless somehow you both were able to work this out.
