EVERY company will look into the Clearinghouse. Doesn't matter if you are a 1099 or work as a company driver for a guy that owns three trucks. The Clearinghouse website will even let you see who all reviewed your files. There is absolutely no way around it.

I am sure the OP meant if they will hire him with a violation.

You don't have to be actively or passively engaging in it. If you get tasked and the person doing the testing doesn't follow the proper procedures or wasn't trained right, you can end up with a positive test.

I understand that carriers are required to check the clearinghouse with the drivers consent. Carriers aren’t allowed to just randomly look up a drivers clearinghouse status without a signed consent from the driver.

Also to believe that every carrier out there is abiding by by the clearinghouse rules I’d say that’s being naive.

And since the OP hasn’t answered back about his sap status I’m sticking to what I said earlier (OP has 2 threads on the topic). That he thinks he can just hop on over to another carrier and no one will notice.

Yeah you are right about a few things. You do have to give written consent for them to go through your Clearinghouse records. But it does provide you a list of carriers that read through your files if you gave them consent.

I agree. OP probably abandoned the thread. Probably will start another one with another company in question until he finds the answer he wants to hear.
