I thought this guy fell asleep while all traffic was stopped due to traffic backup, due to I don't know for sure. He fell asleep at the wheel, presumably and awoke when the bus ran into the back of him, right? Have you never laid your head in the steering wheel when you know the backup is going to be a minute? Heck brother, I sleep an average of 6 hours each and every day, take maybe (big maybe) two naps a year and even I have laid my head on my arms and on my steering wheel. The driver was innocent at his point and became the opposite when the traffic was clear to move. Even you got to admit that this whole thing is not normal, why didn't anyone knock on his door or at least blow a dangum air horn??? I want to make it clear, I am not saying everyone should be held accountable for NOT waking this guy up.....
Murder for being in the wrong place at the wrong time.....? No, he won't get charged for murder, maybe aggravated manslaughter or something to that nature but definitely not murder.

The guy in this argument though, had no suck thoughts. As far as he was concerned, he was going to just lay his head down for a minute and at that time, all were stopped. It was not until the idiot crashed into the back of his truck that he knew anything other than, what he knew when he laid his head down.Jazz1 and Pedigreed Bulldog Thank this. -
Look where we are with cell phones banned in trucks. If we go back to the genesis of that decision, it was a 17 year old driver who was driving a little pickup truck while texting, ran into a big rig which was stopped for traffic jam. Stemming from this crash it was determined that truck drivers holding cell phones cause crashes.

Yes, this guy broke some laws and he should be held accountable for that. Yes, he is the CPT of his CMV so he is responsible, not sure if anyone didn't know that.

I am just trying to point out that we as a society are getting a little over board when it comes to law suits. This driver had no knowledge that when he laid his head down, some idiot would run into the back of him. Even though the texting driver doesn't have any knowledge of any particular crash, the texter does know that what he/she is doing, could cause a crash. Same as a drunk driver.x1Heavy Thanks this. -
When he chose to drive fatigued, he may as well have drank a pint of jack Daniels and chose to drive.
His fatigued state caused him to make poor decisions.
This forum has literally thousands of posts with the phrase "NEVER drive fatigued or sleepy". So where's that coming from?x1Heavy Thanks this. -
If you watch the interview with the driver , they called him a hero for helping people get out of the bus.
They asked him how fast he was going and he said he just got moving when the bus hit him , he didn't say he was sleeping at the wheel or in the bunk .

Oh, okay, well man some people died when the bus struck your rig" This is the part where the truck driver realizes what has happened and dread sets in.... Society today, will drag this guy to a station, check his log books with a fine tooth come. What did his log books have to do with the fact that some idiot crashed into the back of his trailer??? Could the idiot not see this big behemoth? "But SheepDog, if he would have followed the great HOS rules, he would not have been parked there." But he was sir, and that is where we are, he was parked there, along with everyone else, when he laid his head down. Because everyone took off before he awoke and some idiot crashed into the back of his trailer, he should be held accountable for the deaths of 13 people??????? If those are true facts.........Guy is a hero, And knowing he was actually "moving" with lights on should exonerate him 100% from these charges that not4hire has displayed...

See, While I choose NOT to ruffle any feathers........The ones that stay Firm on charging this guy and throwing him in the Clink are the Same guys Who wake up everyday and Eat and Breathe this Trash Industry called transportation and every "potential" liability Above the written laws..
Instead of family and a personal life- They walk around trying to make sure they memorize every rule and every scenario in that green book......Then Let it Consume their Lives...

My flaw is that I am such a softie inside. I am no good inside a courthouse.
If anything I should know all about being tired and get just a little bit of sleep, even if I have to steal it. The closest to human nature for sleep was north of crashville (Nashville) on 65 where there was a fatal times three. The local FD closed the interstate and kicked us all off down a tiny lane exit. That took 5 hours for me to drive stop drive stop three miles to that stupid exit. 6 stupid hours I could have been in say... Toledo and having dinner. But noo.... I took a nap on the side of that ramp once I found just enough room to get all the wheels off. Er... the pavement that is...
I cannot explain the lack of action of the people around Mr Sleepyhead now blocking traffic. I suppose most people don't want to have any part of it. Until at least one, usually the loudest big mouth wil get up, stagger to the door and say HEY BUDDY> MOVE THAT&^%$...
