Unsecured load violation

    If they note OOS on the inspection sheet it automatically adds 2 points to all your other points. Even if the OOS is for a 5 minute fix.

    Honestly, OOS is more of an enhancement to an inspection. Of course, it goes against you, it's just not a violation with a code section. A driver CAN NOT operate a CMV while either the vehicle or the driver is in an OOS condition. Once the OOS condition has passed the driver can then return to the road.

    Example. I am driving for XYZ and in a Class 8 CMV westbound on I 70 in Kansas. I fail to remember my medical has expired and my company for whatever reason missed this. I am stopped by a Kansas state officer and inspected. This officer discovers I am operating a CMV without a valid physical AND PLACES ME OUT OF SERVICE because of it. This violation is an OOS type violation and the inspection report will have one violation listed with the notation OOS on it as a result. 5 hours later I have returned from an exam with my brand new shiny medical. I show the officer I have fixed the OOS condition and I am again on my way. I will pay a fine for this violation and there will be CSA-2010 points issued. However, the OOS by itself is not a violation.

    Maybe next time get some wood blocks to put on the middle piece of pallet so the straps can put downward force over the middle part?

    I understand how it works. You're talking about a driver fitness/non qualified issue that will put you OOS.....
    Im talking about an OOS going on the PSP/CSA report-able event.
    I think I misunderstood what you were saying, but that happens when you're up for 30hrs lol

    To be honest there really is no real difference. The CVSA OOS criteria cover all of this. I used to have a link to a fantastic JJ Keller article on this very subject. The link is now broken. It had examples of all of this.
    About the only time, a driver will not face OOS for a violation is things like speeding, the only difference in the OOS condition is the time you are actually OOS. I am glad you posted those violations before. I also used to have a link to a pdf of ALL the CVSA North American OOS criteria but sadly that link is also broken now. @brian991219 might have this information or have something more to add. It is something ALL active drivers, as well as compliance specialists, should have.

    Let me amplify my last comment a bit. When a MCSAP/CVSA/DOT cop finds any violation that is part of that OOS criteria I spoke of. Regardless of if it is a driver's fitness issue or a vehicle or load violation, the OOS notation in almost all cases will be added to the inspection form. It is part of the system and since most officers use a computer to make these reports this OOS is automatically added. If my memory serves it is a checked box saying OOS.

    Yeah I keep watch on all the csa stuff because they’re always adding things, reclassify metrics etc etc.

    I think they’re going to move some stuff around starting 1/2020, specific to driver fitness. I’ll have to go back and look but it’s because there are some things that span different metrics.....I think the medical card is one but can’t remember. I’ll check when I get up tonight

    As mentioned, the violation will go on the companies CSA, and on the drivers PSP. The points stay on the companies CSA for two years, and on the drivers PSP for three. This violation wont cost you your job but continued violations in the future can. The company I used to work for wont hire a driver who has to many points on their PSP, commonly referred to as a drivers CSA.
