Weight scale ticket

    Lawyers get CMV Tickets dismissed or reduced every day. Without a Cat Scale weight, the lawyer may have a problem. With a scale ticket, the fact that the trailer was picked up pre loaded and sealed, and the load was under gross, I think a lawyer could win that case in court. You should ALWAYS fight any ticket in court. CMV or POV. I have Legal Shield through my employer. I have never had to use it, but, $10 per week is pretty cheap insurance in my book.

    Be interesting if the OP returns and lets us know what the load looked like when he/she opened the trailer at the receiver.

    Serious question for you all as I dont haul freight. How are you supposed to be responsible for a load when you can't even look at it?? You pick up a preloaded and sealed trailer and you are just supposed to assume it has been properly secured? Thats methed up. And I dont believe the DOT is going to give once single ounce of a dang if a load shift caused you to be overweight on an axle. Thats your baby and why it amazes me you can't look in the trailer

    I imagine that in extreme cases when we don't deal with over weighed tickets but more serious staff such as high dollar liability, more serious lawyers would get involved and try to exonerate a driver who was not allowed to inspect the cargo.
    Otherwise, it can be argued that a driver can always refuse to haul anything like that but we all know that in practice when his employer expects him to do so, it is not so simple.

    Also. Trailers get sealed.

    Receivers might not accept the load if the seal is broken.

    That doesn’t matter, it’s your responsibility to make sure it’s road legal and secure for travel.
    Either talk to shipping/yard dog driver/security guard, they will either allow it opened and change seal number or tell you who to talk too.
    If unsure, don’t go, you’d still have $1500 in your pocket.

    A refundable scale cost always beats the nonsense of dealing with weight problems at a scale. I picked up a load of "plastic vacuum cleaner parts once... scaled it the axles were 10,500, 15,500 and 40,600. There were 16 double stacked skids of electric motors on the rear of the trailer that were not manifested.. Be careful out there drivers!
