when pulling off the shoulder back into the right lane on the interstate...

    And legally you have the right of way when someone is merging from an on ramp clearly they have a yield sign however one could say that if they are on the shoulder technically they are already on the interstate and don't have a yield sign anyone have any actual laws that say who has the right of way when stopped on a shoulder I doubt there is any published laws on the matter but I stand by my comment if you hit a vehicle from behind it is your fault

    The shoulder is NOT considered a travel lane in most of the country. If you are pulling from the shoulder INTO the travel lane, you must yield the right-of-way to the traffic already occupying the lane you are attempting to enter. Once you are in the travel lane, there is a minimum speed limit. If you are not exceeding that minimum speed limit, you are obstructing the flow of traffic. It really isn't all that difficult of a concept to grasp.

    I used to work with a guy who was cited for obstructing traffic. He had blown a tire, pulled off long enough to inspect the damage, and was pulling back on the road to proceed to the next exit where there was a tire shop. He had it up to 45 mph by the time he was hit...but the minimum speed on the road was 50 mph.

    If you pull off on the shoulder, YOU are responsible for whatever wreck YOU cause when you pull back into traffic, whether they hit the rear of your trailer or not.
