Why so many accidents every week?

    Yip. And they will get what they need with minimal trouble. Cars are one thing. CMV's are a category on their own. I don't like talking to DOT. So I just try to follow the rules.

    Oh, I understand quite alright. An accident is another story completely. I am replying to the driver who said a LEO simply inspecting the phone is wrongful search and seizure which some of these courts, as you can see by the links, have already ruled is perfectly acceptable. When an accident (or crime) occurs, they can do what they want. As we see by the links, even without an accident or crime they can also inspect the phones.

    You're wrong. Ask any LEO or ex LEO on this board. I'm sure someone else will correct you, too. Many vehicles are searched without a warrant every day all across the country in every state.

    My pet peeve is seeing police officers on thier cellphones and texting while driving. They are supposed to enforce the law and set an example. Also when they fly past at 90mph just to pull into a rest area or to pull into the middle. A badge isnt a free pass to violate laws. Plus driving like that burns tax payer fuel and puts un needed wear and tear on taxpayers vehicles.

    Many times they are not breaking the law. Believe it or not, there are exceptions to almost every one of these bans that exempt emergency personnel. Not that I agree with it of course because I don't believe ANYBODY needs to be talking on a handheld or texting while driving. There are just too many things going on at once to be fumbling with a phone.

    Agreed. Many people don't realize that officers will lie and/or threat in order to get you to agree to a search. That's why whenever you are asked to exit the vehicle you make sure your windows are up and the doors are locked as an unlocked door or open window could be an invitation to enter your vehicle ;).

    I'd give them the number. I have nothing to hide. If they ask ill explain and shiw tge one button push. Ill volunteer nothing. Its my right to not give them info they can twist to incriminate me. I said I'd not give them my phone. I never said I eouldnt cooperate in a way that serves my best interest.

    I will also explain I do not hate or disresprct law officers. Most are nice pokite and professional. I have many good friends in law enforcement. I am still an emt and have been for 8 years. I work close with the law. I've seen both the good and bad. But I will not give up any of my rights for any reason.

    Ok that's what I said just in a little less words. I said I will say no but I will not risk a ride to jail over it. I will make sure its noted I object to the LEO looking at my phone.

    I also will not give the pass word. I have the phone password locked and the photo/video gallery on its own password, also my sms program is password protected seperatly. He can look at it all he wants. I forgot the passwords. That has been tested in court pertaining to a laptop. The woman won. My phone is a small computer. Again ill let the lawyers deal with it.
