Reefer load possible claim

    Hello

    please help with an advise. My driver picked up frozen load and got reefer breakdown on the road. He stopped at carrier dealership and spent about 4-5 hours there and they did fix the reefer. Next day driver was asked why his GPS location still in MO, where he picked up a load. Driver did mistake and told them that he spent 5 hours for reefer repair. From that time broker start requesting reefer download report. It was Sunday. We didn’t do any reports, on Monday morning driver delivered load and receiver accepted and signed BOL without any notes. Everything went smooth

    but the broker keep emailing us and requesting reefer download report. He said if we won’t send them, he will file a claim.

    my question is -Can broker open a claim with clean bills and accepted load?
    Do I need to provide reefer download report to them? Or not?
    If I do provide report, probably they will see that reefer was running 20-35 degrees about 5 hours while repair. Please advise? We just want to avoid any possible claims

    Once the bills are signed it's game over , was this load factored? Send the broker a picture of your ding dong and tell em to pound sand

    If pounding sand ain't enough, tell him to kick rocks too. OP, unless it was ice cream, there ain't nothing to worry about. I wouldn't give him a thing. You better get ready for a fight, because they are going to try not to pay one way or the other. If you give him the report, he will say temp discrepancy and reduce or not pay the rate. You don't give it up, they will try to withhold too. Oh.....and by the way, tell your driver not to talk so much. He could have said, "I was taking a nap."

    He can't file a claim unless the load is damaged.....it evidently wasn't.

    9 months to file a claim. Temp can be hidden damage.

    Also was the product exempt or non exempt I'd be worried if it was exempt in the broker has yet to pay

    Signed clean bills, is your saving grace. Explain that the bills were signed clean. Don't send him anything. You insurance will deny the claim because your delivery was received in good order and at the proper temperature, otherwise it would have been noted on the bill. Advise the broker that if he doesn't pay in the time allotted on your rate confirmation, you will file a claim against his bond.

    Tell your driver to put a cork in it , wow what a onion.
    Maybe going forward we can all learn how to not Invite a claim , that was drilled in us old timers heads.
    Company drivers have no buisness talking to anyone besides breakdown, dispatchers etc , how did the drivers get put in the middle of this broker shipper receiver dilemma , to many ##### to kiss as it is.
