OK. Politics aside and focusing on technicalities. There were some posts indicating that turning the key on and off while in sleeper, as stupid as it sounds, may not be as innocent as it we think it should be.
Well, I am not sure what I should do in order to contest it, other than keep doing what I have been doing so far, which is to start the truck whenever I feel like it and as I please.
I just hope that DOT officials are not dumb to the point of enforcing us to log whenever we start the truck in order to heat up a dish of soup in the microwave or simply get some AC when it gets too hot. They must realize that staying for 8 hours straight in the cabin may not be even possible. For instance, such trivial things as the fact that people have to go to poop or go out there to stretch legs.
Luckily, I have not heard anything about such actions yet.
However, If I am ever confronted with this or given some hard time at a scale somewhere then I'll sure post it here. If it ever comes to this that they, indeed, would start screwing people on such technicalities, like that DOT official in Butte, MT then it will be the last straw.
And yes when I listen to myself talking about this stuff, it is very, very deplorable that I even ask such questions. But the questions are real. -
gentleroger and TallJoe Thank this.

I used to cheat a lot on paper and I could go as far as to say that most of my paper logs were edited and corrected multiple times during a day, not to say falsified. I was pulled over many times and many times was confronted with the contents of my logbooks, especially in Iowa and Arizona they were trying hard to find something in my logs to screw me up. They were calling shippers, receivers, fuel desks, my dispatch...and for what? Just to screw me up for the f ... of it.
Now, I am afraid that with the ELDs and the output file, the have it all on a silver platter. -
One solution would be to say you opened up the sleeper door or just the window, (if you had one) and spoke to the tech that way.
That said, I've noticed a trend where most loads are being scheduled as JIT (Just In Time) where the driver must 8/2 split for the 3 day haul to save the three 30 minute breaks for on time delivery. -
I use a microwave, and have to start the truck in order for the inverter to work properly without killing my batteries.
Gotta eat! -
Question 5: Do telephone calls to or from the motor carrier that momentarily interrupt a driver’s rest period constitute a change of the driver’s duty status?
Guidance: Telephone calls of this type do not prevent the driver from obtaining adequate rest. Therefore, the FHWA does not consider these brief telephone calls to be a break in the driver’s off duty status.
And here’s another one related to receiving messages from your company.
Question 6: If a driver is required by a motor carrier to carry a pager/beeper to receive notification to contact the motor carrier for a duty assignment, how should this time be recorded?
Guidance: The time is to be recorded as off-duty.
Regulations SectionTallJoe Thanks this. -
The most important part is "...do not prevent adequate rest". -
You can fight any violation on a CVSA form. It doesn't matter if it includes a citation or not. It's just easier with a citation as most traffic judges just want money and will knock the charge down.
