Though i misquoted the reg. It states that you may not consume alchohol within 4 hours of going on duty. Not 8

But then it made what you said totally irrelevant! 10 hours off, he can have a drink in the first 6 hours, and you can have a drink in a parked truck.
It is his company's policy he violated, not FMCSA regulations.tucker Thanks this. -

No. You cannot have alcohol in the truck. Not in the passenger compartment at all and only in the trailer in listed on a manifest

This has no bearing on me, but can you cut & paste the section from 49 cfr 392.5 that says you cannot possess alcohol in a commercial vehicle cab EVER?
