Burden of proof. Who relieves me of my duties? I do. I decide when I'm off duty. I'll leave a shipper under p/c (or walk) to a cracker barrel, truck stop etc. You just tell them you are Bob tailing for lunch. Rather simple. Then sitting for 8 hours at a dock? Lol why you sitting for more than two hours? You just racking up detention pay? (I could understand that)...either way, schedule phone conference with said officers post commander...be firm, they are public servant so you can do this, just depends on how much you are willing to put into it. I could care less what some schmuck with a badge thinks personally. I stopped respecting them when they throw pissy fits because you tell them no you can't look at my phone....

Except officers are sitting right outside customers, and they know this particular customer doesn't allow you to leave so they have you.

You don't have to convince me, it was all theory anyway. The problem is when you can't convince a DOT cop who says that you were on duty, even though you went out the gate to eat a dinner or that you were asleep for 8 hours while your truck was loaded. This is BS to me as well, and I hope there are no cops like that. Nobody ever questioned me on that whenever I was DOTed and most of the time my loading and unloading time as 15 minutes and the rest in sleeper berth or off duty. Although, lately I do prefer to show sleeper.

First time for me too in 6 years. Had somebody message me on Fbook today that they got nailed too, so this is more than a coincidence. New way to harass us? Not sure.

When the full ELD Mandate goes live December 19th this year it will be a lot easier for everyone. The new rule will be if the wheels are turning the ELD automatically reverts to Drive line unless you hit Yard Move which is essentially On Duty Not Driving.

No more will we be able to slink around in Sleeper or Off Duty at slow speeds.

You're going to get all kinds of people using PC or just unplugging it to move around. There would be no point in staying overnight in customers anymore since you'll be starting your clock when you head to the dock anyway. Truck stops will be even more full.

Isn't amazing how this works? You've gotten away with not logging actual work, and I get a falsification for not logging a nap on duty. o_O

    scottied67 Thanks this.
