It was parked well off to the side of the road with its lights on and hazard lights on.

Not much else a driver can do....

Both are stupid. He should have never been parked on the side of the road. Except for an emergency. Should have parked at the job site or some other safe location.

I used to park in that area often when I pulled chemical tankers. There's a Loves a half mile from there. If it fills up, there are lots of side streets that would have made a better place to park. The whole area is industrial.

Should the guy have run into him? No. Will I feel bad if he gets sued to kingdom come for parking on a shoulder? Nope.

    Good Rule.

One of our most important and long-standing safety rules is called the “Sitting Duck Policy”. What is this? Simply put, it says that we do not want our drivers to park/stop on the shoulder of the roadway, UNLESS there is an emergency that requires them to stop.

Then you call safety Dept and also report broke down, and even they’ll get someone out to help get you off the road.

He and company will get sued and loose.
Lawyer will say he didn’t put out triangles as required.
