Off duty vs sleeper berth

    Yes you can log off duty and sleep in a day cab I have before it's not comfortable but can be done just dont log it as sleeper birth time no where does it say you cant sleep in the cab you are on your time not company time

    No where in the regs does it state a specific number of hour you have to sleep. It is assumed that you will use this time to get your rest as you cannot drive fatigued. As for sleep
    To answer the first part of your question, the regs specify you must take a 10 hr break but there is no where that they state you must be sleeping a specific number of hours. They state that you must have 10 consecutive hours: off duty, in the sleeper berth or any combination of the two. In case of the split 8-2 break, the 8 must be logged sleeper berth, but again no specific amount of hours you must actually sleep.

    I suggest that you respectfully ask the safety dept for these policies to be in writing. In the absence of rules to the contrary a carrier can have company rules, just get them in writing. This way if you run into a DOT officer hellbent on a ticket you have cover later and the carrier then has to get rid of their compliance dept OR fight this officer in court.

    The thing is most will take the CSA hit and pay the fine. This is one reason I stay so dang angry at carriers that seem to have become sheep, in light of how some state DOT officers have become more like Gestapo than people trying to make the nation's highways safer. Carriers of all sizes run scared of these people. They, for the most part, refuse to back their drivers. I know DOT officers. I have stated in several threads now how they make fun of drivers and how they play gotcha games with them. As a driver ALWAYS show respect to a DOT officer. You might want to bury his teeth down his throat, but stay respectful. However, make NO comments on your HOS compliance. NONE! You are only legally required to show that officer your "logs". Don't make you're not answering into a wee wee contest, just smile and tell the officer you are staying silent. If the officer then spends 5 hours inspecting you note that. If you get cited for obstruction fight it in court. The thing about the above though. please follow your company rules. Since most carriers are scared to death of fighting DOT Gestapo they will toss you away like yesterday's trash!

    The way i've always understood the regs is that in a day cab truck, the driver can go off duty in the cab. However, the driver can't go on line 2 sleeper berth in a daycab; since a day cab truck doesn't have a sleeper birth.

    One must be off duty or sleeper berth to achieve a 30 minute or 10 hour break. A day cab has no sleeper

    If anyone asks, just say “duhhhhhhhh” and keep your mouth shut

    I’m pretty sure you have to be out of the truck to be considered off duty, and out of the front seat to be considered in sleeper berth.

    More to the point, taking a 10 hour break in a day cab strikes me as an exercise in masochism, even more so than sleeping in a bus (which I certainly did a lot of during my 20 years as a bus driver). At least in a bus, I could go back several rows and be relatively invisible, and could stretch out across several seats.

    Can people not read? That hasn't been true since 2012. I'd post the regs, but as there isn't one requiring to be on duty in the truck I can't.
    As for front seat vs. sleeper... Well to log sleeper the wording is "resting in a sleeper berth”. So yes, one has to be in the sleeper to log sleeper.
