Yet another question about Personal Conveyance

    So I had a quick question about PC. Am I able to PC from my drop off to a truck stop for my 10 but once I get to the truck stop, go on duty and fuel? Or do I just have to use on duty drive time to the truck stop and do it that way?

    If you go to a truck stop to fuel, then you were not relieved of all duties were you? Thus, you can’t PC to the truck stop and then fuel.

    If you have to ask it's likely not allowed. Also, that truck stop had better be the closest safe parking location....

    While the specific question isn't addressed in the guidance, look at it this way. If you are on the side of the road and get an inspection will you be able to convince the LEO doing the inspection it was a valid use?

    Fueling, or other on-duty activity, suggests the PC is being mis-used to an inspector. You might forget to log fueling and you MIGHT get away with it or get in trouble.

    If your going to the truck-stop to fuel and take your 10 then just stay on PC till you park

    I’m probably not the best one to listen too honestly…I’m not to reliable with my logs.

    There are 2 basic types of PC. The first one and the most common is basically bobtailing to get things during a break. This has been done for decades. I remember one of my uncles telling me about using PC in Houston back in the 1960s. This is not what you are doing.

    Then there is the other type of PC where the FMCSA is allowing a driver to move from a dock to a place to safely park after they are out of hours. The reasons behind this are way to long to get into here. @ZVar touched on this about in that closest safe place to park comment.

    Now take a long look at those paragraphs. Does your PC fit into any of them? If it does not and you have available hours I suggest HIGHLY you stay on-duty driving until you get to the truck stop and go to on-duty to fuel up. I also HIGHLY advise speaking to someone in safety about PC. Some carriers don't allow it.

    If you’re a company driver you should be asking them what you can and cannot do.

    Me personally, if I was held up at a delivery and my clock expired I would absolutely PC to the nearest safe parking place. If my fuel was dangerously low where it may not be enough for the night then I would absolutely put fuel in the truck at the truck stop on duty. After getting settled in take a complete 10.
    Don’t include the PC time into your 10, show a full off duty/SB.

    Lastly, don’t abuse it and no one will give you a hard time. Don’t PC if you had available drive time. Don’t drive 2 hours pc looking for a place to park. Know exactly where you are going before you log PC.

    I would think this specific question's answer is similar to bobtailing to a shop for repairs, the guidance has told us that that would be an on duty activity since we are moving the vehicle for a purpose of keeping it functional, similar to putting fuel in if you were low, you are advancing to a place to keep the vehicle functional, otherwise, post #8 is the best answer yet.
