Just over a month after the FAST Act Highway Funding Bill effectively gutted the CSA program and removed it from public view, the FMCSA has reincarnated the controversial program that, like Frankenstein’s monster, has been patched back together with bits and pieces of its former self.
As part of the FAST Act, the FMCSA was instructed to remove the CSA program’s BASIC scores from public view knowing that they would not be allowed to return until the CSA program had been reworked to make the safety scores more accurate. Now it appears that the FMCSA is taking the ruling literally by restoring almost all of the CSA data that was previously available, but leaving out the percentage-based BASIC scores – the only part of the program which they were explicitly disallowed from continuing without congressional approval.
In practice, this means that parts of the CSA system which opponents find highly problematic are still viewable by the public. For example, the Crash Indicator BASIC still shows a list of each individual crash, regardless of who was found to be at fault. Every other BASIC but the Crash Indicator has a graph of last year’s history and lists all violations and inspections which pertain to that BASIC.
FMCSA spokesmen have stated that other than a few technical issues, the public display system contains all the information now that it is likely to contain.
At least until the FMCSA finds a way to reintroduce their scoring system.
Brian White says
I’m not surprised at all. Lifelong bureucrats always find a way to impose THEIR will on the American people, usually in a way that reduces the individuals liberty, and ALWAYS through rules and regulations not voted on by the people, much less the peoples representatives in Congress.
This is tyranny, people.
Charli says
Yeah starting with Citizen United, and all the redistricting and gerrymandering. Not voted in ” by the people” !
All the historic limits on marriage and immigration, and voting rights… Yup all political tyranny pressed upon human beings.
les_gvt says
Gerrymandering was names for Gerrymandering Elderbridge. He not only signed the Constitution but was also in our first 5? Congress’s. So that issue has been around since 1787 or so. It is not a new problem by any means. He was a member of what went on to become the modern Democratic party though
Tim says
Agreed. Similar to their reference to Frankenstein’s monster, it’s like this tyranny is in our British DNA or something . Can’t seem to shake it.
David says
Not tyranny, just another of our governmental agencies showing it’s general lack of respect for its government.
Anyone remember the CIA wire tappng and spying on the Congress that was investigating it?
Ed says
As usual FMCSA does not like not getting its way. Even if they are wrong , they will not admit
Matt says
Doesn’t surprise me either. Rules made by people that have never had anything to do with this industry. The ATA is another farse. Just another special interest group made up of the big companies. When will it stop?
morons says
When we’re all dead. And there No one left alive on the planet to feed lazy rich people.
les_gvt says
The more power we willingly give to the government the more they arbitrarily take. Just wait to see what happens if Hilda beast gets in
Angelo says
This will all stop when we drivers make it stop! It is pretty basic. Stop driving until you get what you want. Otherwise please be quiet!
D.J. says
Exactly
David Norton says
When is the federal government going to stop protecting company’s from drivers and the public, the need to know wich companies are horrible since all the blame seems to fall on the driver they need to start protecting the drivers from bad company’s.
Francois says
Well, the CSA scores should be a good way for driver to do a background check on companies. You would see if a company has a lot of crashes or have maintenance issues or OOS issues.
I for one, like the public view of CSA scores. It enables me to check on companies before applying.
Companies don’t want to show their score publicly since their customers can see if they are a good or bad company to deal with.
Samuel lee says
FMCSA IRS EPA DEP and numerous others were designed to make decisions without constitutional constraints. …huge drag on the economy just to cater to a bureaucratic elite….Remember Anne Ferro?
Rufus Crank says
I desire to file a lawsuit against the FMCSA for “Gross negligence of their primary official responsibility.” that being trying to keep drivers safe. In all my years driving, not once has the FMCSA passed a rule that makes me safer. speed limiters, elogs, lane restrictions, split speed limits, aggressive automobiles, and lack of parking, threaten my safety each and every drive shift, yet no effort is spent trying to make me safer. I wish to have an OOS order placed on them for 30 days, with a review of policy by congress before they can return to service.
William Flatt says
They don’t care about Congress! Isn’t that obvious?
William Flatt says
Fmcsa is another bureaucracy out of control. Until ALL trucks stop for three days they will remain out of control! No one, and I mean NO ONE, whether in the industry or in a regulatory position gives a damn about the loose nut behind the wheel!
Chuck says
***This should be enough of an indicator to anyone that the FMCSA is an arrogant and abusive agency that needs its powers stripped immediately!!
I’m so sick and tired of government abuse of power and the FMCSA is a poster child for it !!
Congress needs to give these guys a swift kick in the butt for pulling this stunt !!
How about some nice class action Civil suits for their unconstitutional method of punishment to carriers???
Anthony says
Who does the government work for?
D.J. says
Until the drivers stop rolling and strike nothing will change in favor of the drivers. When you threaten the economic balance then you can get some act right, until that happens FMCSA and other big company ran organizations will continue to force laws and implementations in their favor. A drivers coalition needs to be organized, and a strike date needs to be set. The leverage that they hold is divide and conquer, if the drivers don’t come together for this simple cause then they will continue to conquer. We either come together or we continue to be at the bottom of the food chain, doing all the work.
Peggy Christman says
So well said! Again, there is ‘Power In Numbers’! Unite, people! Unite!
Joe says
If you set up an organization and a strike date, thw govt will call you an economic terrorist
