ELD enforcement has been getting phased in slowly ever since the rule went into effect. The next round will see drivers potentially placed out-of-service for failing to comply with the mandate.
Starting on April 1st, in accordance with the Commercial Vehicle Safety Alliance’s ruling, enforcement officers can place drivers out-of-service. Here’s what happens next:
- Drivers will remain out-of-service for 10 hours
- After those 10 hours, drivers will be able to travel to their next scheduled stop
- Drivers will not be able to be dispatched again until they are in compliance
- If a driver is dispatched without being in compliance, the carrier “will be subject to further enforcement action.”
The FMCSA announcement does not specify what those further enforcement actions would be.
While the announcement says that drivers will be able to travel to “their next scheduled stop,” FMCSA’s head of compliance and enforcement, Joe DeLorenzo, clarified that point.
“Just the same as a driver who previously didn’t have a paper log,” said DeLorenzo according to Overdrive. “Once that 10-hour period is up, assuming the driver has at least a paper log, we’re going to provide flexibility for that driver to proceed to their final destination and deliver their load.”

You can’t… The big companies are already compliant and with the low wages the smaller carriers pay you’ll be hard pressed to get the drivers scratching the bottom of their wallet to make payments on what they are trying to hang onto to participate in a walk out. I’ve been at this for over 30 years as well and no matter what the new rules are you always hear talk but never any action, even due to the driver shortage. (if there actually is one) Companies have most drivers so scared of losing their jobs none of them will do anything.
Always hear that without trucks the country stops, no truer words have ever been spoken. Just look around and name one thing that hasn’t been on a truck at some point. If everyone stands together things will change, there’d be no choice. You really think that every company will fire all of their drivers?
Oil companies and truck stops would feel the pinch as well, just think of how much diesel is sold nationwide in one day.

I never drove more than 11 hours a day, I took a nap when I got tired. With e log book you have to drive even you are sleepy or tired because you want lose your driving hours. 90% of truck drivers against e log book

The FMCSA is the most ignorant and dangerous group in the trucking industry. The ELDS are junk and have caused accident rates to soar but the money their getting paid by the Crooked manufacturers is more important than actual safety. I inform everyone I speak to about them that when their involved in an accident to make sure their attorney includes the FMCSA, CVSA, ATA, NTSB in their lawsuits because they are the true causes of most accidents.

If you are arguing about E-logs it means on paper you were running illegal. We all have a 11/14 rule. Doesn’t matter paper or E-logs. 14 hours is 14 hours. Everyone knows that paper logs are a joke. You only complain because you don’t know how to manage the clock correctly. I’m glad I work for a company on E-logs before it was law. I’ve heard stories of drivers saying dispatch said tear up and make a new one so you can haul this load. On E-logs they can’t do that. So in reality if you are tired and dispatch says tear up and make a new one, who is more dangerous. Me, that shutdown because I’m forced to or you that already put in 8 hours on duty and is rewriting the log to run another 10 hours. I’d say E-logs are the great equalizer. However, shippers and receivers should be fined heavily for taking more than 30 to unload a trailer. It’s ridiculous to be at a receiver 5 hours and then have to find parking even if you are out of hours you can’t stay on their property. Prime example Walmart comes to mind. Run your hours out and give you the boot no care hos violation or not. If you refuse to leave they have you towed. Happened to a C.R. England driver about a month and a half ago. He couldn’t leave legally and they had him towed.

If you can only sleep at home then you need to find another job or work local. You knew from the start that you would be in a sleeper or hotel every night. Is it hard to find a spot sometimes, yes, do I search for hours no. If you have been out here for any length of time you should know where you can park, doesn’t always have to be a truckstop. I don’t do rest areas or places that I can’t get a meal, and only stay in a truckstop 2 days a week.

When I was driving I was always rewriting my log, because these rules are crazy and hard to follow, but I never drove over 11 hours a day. I was able to drive only in a day time, stop for a nap for couple of hours during a day time, stop if I saw road condition not safe enough, I never drove fast. E-Log actually force you to drive against your will, doesn’t matter how you feel, because if you stop you will loose precious hours.

That is why paper logs are the best-you get caught in a highway closure, bad weather shutdown, you could use sleeper birth for 4 hours and if you worked it right-drive 16 hours a day. We used to have 10 hours of driving, then 8 off, get up and drive another 6= 16 hours of driving a day. I used paper logs for 34 years and never had an issue with them. ELD’s in my opinion; are no more than a money maker by the producers, insurance discount for the mega’s, pushed into service by people who had to make their job look important and they had accomplished something, pushed by the mega’s so they did not have to pay staff to check/file logs away, save companies images from tarnish due to some newer drivers not knowing how to work a paper logbook. Electronics came on the scene and the new generation of people in trucking (non driving) think the have to apply it onto drivers in every aspect. Thrity years ago the freight got moved and delivered with 3 phone calls, get load info, call that your loaded, and maybe 2 or 3 days later-your empty. That was it. Today most drivers are totally tracked, on camera and the likes to do what we did without any electronic devices in the ‘old school’ days.

I did/do the same. Do they actually log a 30 minute break on ELD’s when then just got done sitting in an hour traffic jam on 285 in the Big A? Log on duty at receiver after waiting for a door 4 hours? What do they log when they sit in line at Loves fuel lanes for 30 minutes waiting just to get to the pumps? If they were honest in every aspect of their daily time-they would be driving 100 miles a day.

States themselves determine what the safe speed is for all types of vehicles, including trucks. If the state says it’s safe for a truck to go 70 mph, then by definition, it’s safe, given good road conditions. You don’t write the laws concerning safe speeds, the states do. Also, Walmart sucks but not as bad as Family Dollar.

I am an independent owner op that made the hard decision to stand up for what I believe in and that is not to run with a government spying device in my truck . When I was a company driver I had to stand up and not be harassed to break the law. I ran legal without an eld so that is not the issue. The issue is senseless regulations. 20 some years ago,many States increased speed limits on Interstate Highways.Tn. WV. Az. NC. SC. and many others. The statistics released by the USDOT in the years following not only revealed no increase to highway wrecks but also revealed a decline in traffic “accidents”. The only States where there was no change in the statistics were those who didn’t make changes to speed limits,specifically Mi.and Oh. Split speed limits for passenger vehicles and commercial vehicles in Mi.and Oh. continued to be a dangerous practice.The Michigan Highway Patrol Officers,in the field.were wise enough to realize how ridiculous this practice was and allowed truckers a 7 mph grace on the 55 mph state wide commercial vehicle speed limit to around 62 mph (exception Jefferson County Mounties). 70 mph for passenger vehicles and 55 mph for commercial vehicles on the same road is just plain stupid.
I know,for a fact, Oh. has since increased the speed limit for commercial vehicles from 55 mph to,at least,60 mph. I believe Mi. has done away with the wide spread speed limit,as well.

It is more of a problem of dispatchers looking at your log and determining you are safe to drive if you had 10+ hr break even though you didn’t actually sleep For example I delivered a load one evening and was at TS by 9pm I fell asleep between 10 and 11 pm I woke up around 6 that was 7+ hrs of solid sleep.by 9am I called the dispatch asked the about my next load they told me to get sleep and they had a load for me at 6pm 500mi and del. at about 7am the next day.I was unable to sleep due to the amount of sleep I got the night before. 1/2 way through the load I was falling asleep I sent a msg to tell them to change del.or re power I was to tired to continue they called me and threatened to give me a service failure,Which was illegal when I asked them to put on people net so there was a record, they refused.That company has a lot of younger drivers having accidents because they don’t know the laws that protect them.If you are going to have ELDs you need to make a law that all communications between drivers and companies go through the ELD.This unrecorded conversation and intimidation tactic is of the companies is why accidents due to fatigue increased with ELDs, and the drive pays the price.

I’m an owner operator fuel hauler and these electronic babysitters on the dash now make me have to push harder than I ever had to just to get enough loads in a day to cover expenses and make a meager living. Last week I pic up load summer wa and delivered Fontana ca I starting my drive 4am and reach Redding 4.30pm I didn’t find park . And stop on freeway ramp all night. Eld make big problems to drivers short park .i see morning time 45 trucks park on freeway shoulder.but too many trucks stills use paper logs until March 31st

This is exactly right. Finding places to pull over for 10 hours or even 30 minutes sometimes makes for unsafe parking condition many times. In Oregon a few months back there were truckers parked outside a rest area because the rest area was full and no truck stops around. A pickup truck driver rammed into the back of a truck which promptly exploded. Killed the pick up driver and put the truck driver oos until dot and osp was done with their investigation. Drivers still park there every day.

A trucker who caused a fatal crash which took six lives has been sentenced to 55 years in prison.
Earlier this year Benjamin XXXXXX was found guilty of six counts of vehicular homicide, four counts of reckless aggravated homicide, speeding. Highway patrol also said that Brewer had been falsifying his log book.

If you are going to make a case for eld’s then tell the whole story. That same driver was also on METH. It had nothing to do with eld’s. If anything, eld’s cause drivers to drive in rush hour traffic and waste fuel not to mention spend longer periods behind the wheel when otherwise they would not. And because of that is made it almost impossible to find a safe place to pull over and take a power nap without putting others as well as yourself in danger. Of course if you are a company driver then you could care less about the cost of fuel but for those o/o like myself that pay for our own fuel it’s a different story. Time is 💰 and making the most of that time also means being able to dictate when you run that load. I don’t like being force to run a load in the middle of rush hour traffic in L.A. in fear of running out of HOS and getting fined because I got stuck in the port for 6-7 hrs. I get paid by the load so if I am going to survive and take care of my family, then I need to be able to run more than one load a day. Bottom line is that more research should have been done before enforcing something that can and will ruin so many lives.

Safety is first getting home to wife and kids second and following the rules is third, and if run out of time on a customer lot needs to be a agreement there between transporter/driver and shipper/receiver to accommodate for that 10 reset if on property if lost time was cause of slow loading/Unloading.

To make this e log system work,the shippers and receivers need to be in tune with this program as well. Time is the key element and that is taken away at both ends of the shipment and leaves little time for driving. Until that changes there will be pissed off drivers and receiving customers….

The FMSCA need to get on the shippers and receivers. Let see the no working lazy warehouse workers get those load ready to ship in 2 hours instead of wasting the drivers time waiting 4,6 or 8 hours to get loaded and unload. Tell the warehouse workers when they are going to take lunch and brakes. ELD are all about the money and it has put a hardship on small owner operators. I say shut down for a week and then see what the FMCSA does.

When I was driving I was always rewriting my log, because these rules are crazy and hard to follow, but I never drove over 11 hours a day. I was able to drive only in a day time, stop for a nap for couple of hours during a day time, stop if I saw road condition not safe enough, I never drove fast. E-Log actually force you to drive against your will, doesn’t matter how you feel, because if you stop you will loose precious hours.

I often wonder how many of the old school drivers who post on here remember the forced 25 – 30 (if not longer) non-stop hauls. I can fondly remember gulping down those little pink pills to keep my brain in gear to keep my rig moving: or be fired. If you were unlucky enough to have a co-driver you could lay down in a sleeper that was the size of a coffin, (most of the OTRs back then were pushing cabovers) so sleep was fitful dozing between pot holes. Let’s not forget the cabs in those days had about as much noise reduction insulating as a soup can. Though I never drove with an ELD, I firmly believe that I would welcome one if I went back on the road.

Eld’s are not a one size fits all solution for the trucking industry. If it were there would not be so many exemptions for certain industries. I know us o/o that pull loads out of the Long Beach/Los Angeles ports are praying we get exempted from eld’s. Until the ports personnel start getting paid based on their performance they could care less about a driver HOS.

Elogs are fine it’s the HOS that’s messed up. Let a driver start and stop his clock as needed. Split bunking 5/5 as well. This would help ease up parking issues at truck stops. Make large shippers / receivers play by the rules if they ship freight ICC.

Two problems that have always been there and ignored for someone to make money off of. First, most new drivers don’t know how to drive or do the job and are pushed by too many people to make a buck. Second, trucking companies don’t adhere to the rules themselves, and are quick to replace drivers that aren’t efficient. I’m in my 50s be driving since 14. I drive an old Pete 379 ON PAPER LOGS and haven’t had problems nor am I racing around killing people. Lack of proper training, lack of better pay, lack of support for drivers that do the job proper, and lack of good equipment that can pull a hill. Bet you I burn less fuel and cleaner climbing that hill while passing you and your toy trucks. Hey what about Trump doing away with all our tax deduction next year?

Agree, too many drivers working for peanuts/do work for nothing at shippers and receivers. Make them pay for everything you do-including watching a safety video. I was paid $35 for watching any safety video at shipper/receiver. All of these places could not believe I was actually getting paid and thought it was ridiculous. That’s how they view a truckers time. There are about 10% truckers out there today and the other 90% are ‘people’ driving trucks. REAL TRUCKERS DON’T WEAR FLIP FLOPS.

About the E-log. Wake up people. The E-Log is basically no different than the paper logs. It is to record what you did. Past tense.
Please get over your self in blaming E-logs. The real problem is the current HOS. The HOS does not allow you to stop the clock. That damned clock continues to tick tock no matter what you do after you start it. . The HOS as it is is the major reason for so many accidents and stupid stuff happening. Drivers cannot according to the HOS stop the clock for a SAFETY nap when they need one thereby driving tired..Drivers cannot stop the clock to sit down and eat a proper healthy meal, Drivers do not sit out rush hour traffic as was done in the past because the All knowing FMCSA ‘s HOS will not allow the clock to be stopped. Not for safety reasons or any other reasons can drivers stop the clock with out penalty. These are some of the biggest reasons the current HOS needs to be radically changed.
Pausing the clock as proposed by the talking heads at the FMCSA is stupid.Pausing , That’s a catch word that means nothing. NO time limit should be placed on the driver for stopping the clock for any reason. Eating, safety nap, waiting out rush hour. The reasons for some serious accidents is due to the driver trying to keep a steady pay check to the house.PUSHING and don’t say the E-log stops it. That is just some stupid crap being spewed the newbies that have no idea how it should be because they haven’t experienced a better way like a lot of us experienced drivers have. ,Stopping for the safety nap cuts the pay for hours to be driven. It’s easy to tell the new drivers here. I’ve seen more swift, England , Crete drivers in slow trucks involved in most wrecks. Walmart truck hit Tracy Morgan in NJ. Their trucks go 66 but limit was 55 so speed was a factor.

Pallets have to be broken down. Receiver has inspect and accept the count. Docks may have the last truckload waiting to be put away before there is room to unload. 2 hours is acceptable time. Over that, detention.
Also you are on private property when deleivering and picking up. They can tell anybody to move. Use personal conveyance. Without ELD WE WERE ABLE TO MOVE SOMEWHERE WITHOUT THE BS THEN TAKE 10

I figure my wages from the time I leave home till I come back. I live in Missouri and won’t drive in californication. So I can drive to most states and most Canadian deliveries and back home under 70 hrs. I do not condone unsafe driving practices but I also don’t believe one size fits all. So I will drive according to what it takes to get me back to my family and my home.

Im not trying to beat a dead horse, but you all are replacing the dispatcher with an e-log. But as professional’s always remember “You are the Boss when it comes to moving that truck”, if you have planned and manged your time, you can take your naps as needed.
To give you an example, in my position, A company driver, I work from 2 to 5 days a week, out and straight back, 2500 miles or less per week, on e-log, and I made over $72,000 last year.
E-log does work, you may have to drive at times thst are not your normal but, it can be done.

Checking your weight just hit the brakes shut it down right there and tell him hey my 10 hours driving is up I got to go to sleep take my break and just park it right on the freaking scale. My thing is, it was never about safety. More like thinning the herd. It’s a run up to the inevitable, autonomous trucks. It’s been done in California, Arizona and now Pennsylvania. If they’re successful in Pennsylvania, it’s just of matter of time before the industry as we know it is totally phased out and us right along with it. This was one of the last vestiges of middle-class careers without a college degree. The elites that’s running this country into the ground who BTW could a crap less about any of us no matter your hue, wants us to be either rich or poor. No in between. The more we are in financial and health related hardships, the easier it is for the elites to control us. ELDS are only a fraction of what their overall motives are. I truly suggest we otr drivers should retrain ourselves for a different career path especially in IT or other related fields. And learning about robotics. And one more option, start a business that have a researched specific need for people. Capitalism is the main reason this is happening and to defeat it would unfortunately take a bloody revolution. Are any of us really ready to go into that space? Face it drivers. We’ve been lied to time and time again and before it’s too late, we have to prepare for change. This is a transition period just like it was in the industrial revolution era. Change is always difficult but we have to be honest with ourselves and get into position so we are not left in the cold asking WTF happened.

Doubt they’ll ever be a strike. Most drivers are too complacent to do anything beyond complain. Many are fearful of being fired.
A simple, legal and very effective way to show how ridiculous all the added HOS and other regulations passed down by FMCSA over the decades is to operate exactly to the regs. For example, do the exact pretrip/post trip inspection and log it to the minute. That inspection takes well longer than the 15 mins everyone logs. To be honest l, very few drivers even open their hoods anymore, so we know they don’t do a vehicle inspection. Also, EVERY MINUTE at a customer stop by regulation is to be ON DUTY NOT DRIVING unless release from duty by the carrier. Read your regs. That is exactly what it states. If the driver is responsible for moving the vehicle, they are on duty. If you are backed into a dock or even have a flatbed sitting in a yard and hooked to it to be loaded/unloaded, the driver is responsible for moving the vehicle. YOU ARE ON DUTY. If even 10% of drivers did that for a few days, the public and FMCSA would take note.
Last, the time to have done something effective about HOS and Elogs has long past. When Werner first started using Elogs, the driver community could have black balled them, yet Werner still had few problems getting drivers. When FMCSA eliminated split sleeper berths and went to 2-8 split, drivers could have stood up, yet they didn’t. There is no unity in the driver community and is part of the reason why driver pay and respect has gone from one of the better paying blue collar jobs to one of the lowest when you consider all the hours involved. Realistically, I don’t see any positive change on the future and don’t see unity happening either.

I’ve noticed a lot more drivers speeding since the mandate.get rid of the 14 he rule. Maybe. Just put the rookies on it, they are young people that come from the computer age anyhow and it will paranormal to them and let o/o be back on paper, after 20 + yrs of driving we know what we are doing. Now can u put a 70 yr old man on a computer when he can’t even figure out how to use a smart phone. The old hands are really struggling with it. I agree with a strike but all we have to do is plaster it all over FB and twitter and we won’t even have to strike. If they think we are going to do it they will give in before all shut hits the fan.

Do you ever hand-over your CDL for a shipper to keep while you are being loaded? Watch a safety video without being paid? Decline loads to places like the Northeast or NYC with the threat of being fired if you don’t? Count freight without being paid for your time? Touch any freight or remove cardboard from tops of pallets without pay? If you do any of this, then how can you say you will go on strike with other truckers. I have been hundreds of places where drivers work for free at shippers and receivers, hand over CDL’s to be kept until loaded, and watch safety videos at these places for no pay. Too many drivers are afraid of loosing their job because they let shippers, receivers, and their company belittle them.
First thing to do when hired is to let the company know they need you and you don’t need them. When they tell you “we give you 30 days probation”, do as I did and say ” thank you, because I am only giving you 2 weeks and if your no good I’m getting rid of you”. When some one tells you that you must do this or that, ask them what are you going to pay me, or, at shipper or receiver;” I don’t work for you”. Period.
As far as ELD’s that was pushed ahead by lobbying from the mega carriers who get cheaper insurance rates like CR England, USA Truck and the rest of the bottom feeders. Yes, its time to put the FMCSA in their place-too many regulations and too many people passing laws that know little of the trucking industry.
I am not new to trucking-been OTR 34 years, and it has changed drastically as far as regulations are concerned. Paper logs gave the driver flexibility and the FEDs did not like that along with Mothers Against Drunk Drivers and a host of other public associations against truckers. Lastly, as a trucker, if you want respect, you need to dress and look like you deserve it. REAL TRUCKERS DON’T WEAR FLIP FLOPS!

Its impossible for drivers and o/o to come together to stage a walk out or a shut down of trucks for a week, Larg truckig companies barely pay their drivers and owner-operators have to strive harder to make it because they can’t compete with larger companies so staging a coup is virtually impossible and the government knows it yes it would be great if owner-operators & Company drivers come together and shut down for a week but it will never happen cuz people have family to feed and bills to pay therefore eld’s are here to stay and yes I am very much against them and I am an owner operator who is barely making it

If you were obeying the law you would have nothing to complain about… I have actually found I can get more done in a day with e log..
Instead of rounding off time in 15 minute increments it is to the exact minute furthermore it’s nice not to have the burden of getting the pen out every time there’s a change of duty status… I hope any attempt to overturn the law fails…

The problem is that drivers are all in it for themselves. Their not thinking about the long term consequences on their familes and ours. As long their is no alliegence to stand against carriers and regulations, carriers will make more, we will take home less, and our families will continue to remain poor. But worse yet… They’ll have every right to keep us out longer for the best interest, at the cost of our families and marriages. The question is… Is it worth negotiating our wives, children and lives for a rigged system that will never allow us to get ahead?

Trucking job no more freedom we are like criminals we got now the ELD by us to track our moves with time and places recorded,we are like the criminals ,government don’t keep them in jail. But…. They got the freedom to stay out with the ring in the ankle. I feel the same become a Truck driver was for the freedom to Be OTR in constant vacation and getting paid for it But now with this surveillance (ELD) is no more pace full day all this modernization in trucking which I am not to Happy with can’t take longer breaks than 30 min got to run like a chicken with no head also trucking start getting to modern the only ones that are happy are the jounggeneration the ones wear flip flaps not shoes or boots ,God Bless all of them But again we need one leader like Joffa real men the one will represent us and defend our freedom but like everyone said all this is about money government wants make money they don’t care about us they do not know what is trucking all about all I know it is my job I am proud of it I love it !!!! Just get with the program or get out of the industry, sounds like all you winers and super truckers aren’t playing by the rules, I’ve been using eld for years actually makes life easier no more trying to figure out what and where I was supposed to be doing just to make it look good , saves me a lot of time at the end of the day

Look at who started elogs in trucks in the first place.Werner!!!!thats who.elogs should be restricted to those companies and drivers who have multiple accidents and moving violations as well as equipment violations. I have seen trucks roll through scales with lights not working,straps holding body parts together,and even a flat tire.If FMCA is looking for safety,than where is the safety when these drivers roll right under their noses

10 hours is total consecutive hours off duty!!! 8 must be in the sleeper.the additional 2 are for eating,showering or preparing for sleep or waking up after sleep.the hours can be any number of combinations, 1-8-1, 1.5-8-.5 , .25-8-1.75,etc.8 of the 10 consecutive must be consecutive in the sleeper. End of logging 101.

Wake up. Drivers have stopped since Nov. And yet you ones complaining about going on strike is not on strike with us yet. So either shut up and keep driving or go get a megaphone and stop driving.

Stall (fake a break down) in any major freeway. 2 trucks at a time for bout 20min. right before CHP shows up we leave. than the next 2 trucks at a different freeway
repeat the same thing over and over, for the entire day. what this will do is, that we will send a message to Fmcsa.. that we do not agree with their new policy..
