The Federal Motor Carrier Safety Administration announced that it will allow companies with old ELD software to continue using it, even if it’s not totally compliant with the new ELD regulations.
One of the criticisms that was leveled against the ELD mandate before it went into effect was that the FMCSA wasn’t certifying specific ELDs as compliant. Instead they elected to leave it up to the manufacturers to self-certify. When the compliance date came, some large ELD manufacturers had problems rolling out software updates for their devices.
Multiple carriers, including notably Old Dominion, discovered that they were having problems becoming compliant due to their ELD provider – and allegedly through no fault of their own. As such, they submitted requests to have their compliance dates pushed back.
Now it appears that the problem is so widespread that the FMCSA has elected to give a blanket waiver to all carriers with this problem.
In their new policy, carriers will be considered compliant with the ELD mandate even if they are running older versions of ELD software. Some of those versions allow carriers to manually change driver status, settings, and speeds at which the device turns on.
Drivers and fleets have until December of 2019 to update to compliant software.

It’s a complete load of crap. Omnitracks has been providing ELDs for 20 years. Werner Enterprises was the first trucking company to fully implement E-logs. Some of the big carriers have been on E-logs for over 5 years with no problems. Other companies got on the elog kick to make a killing because everyone had to get the system installed in their fleets. The fact that they are having problems is stupidity because the law was passed in 2015. I think 2 years is plenty of time to get a product ready to roll out to the industry. If they dropped the ball, then those providers should be banned from providing elog devices and software. Federal government needs to pull it’s head out of it’s backside and enforce the law they passed. As for the states refusing to comply with federal enforcement requirements, I have a solution. Tell states enforce federal law or lose your highway funding.

Omnitracs is a joke. Recent software upgrade screwed our logs. Deleted milage for 3 days before update, deleted a weeks worth of loads for a coworker and wouldnt let him log into sleeper until he reentered all the load info, not all of us got the same update. Some have features others don’t. 20 years and they still dropped the ball. Werner was given a choice, go to ELD or close the doors…

As a Truck driver for almost 20 years, this ELD thing is not worth it at all and it’s gonna hurt our economy in long run, number one, it’s taking away drivers freedom, you can sleep while you feel sleepy, and number 2 will increase even more accidents by forcing drivers to keep rolling in order to beat time, I see many big companies increased their speed limits to 72 mph, it’s very dangerous to handle big rig new drivers with such speed. I’ll suggest FMCSA, to let drivers use their regular paper log or regular ELD DEVICES.

I’ve never driven sleepy as much as I’m forced to now. So much so, that I’ve realized that the main reason I “falsified my logs” wasn’t to make more money, but to sleep when I felt I needed it. Isn’t the purpose of HOS to make sure we get enough sleep? Now that I’m being forced to be a safe driver by the fmcsa, I’ll have to drive sleepy more or I don’t make it to my appointments. No worries, in two weeks I’m taking a 3 day a week job and enjoying life more. It’s probably the best thing that ever happened to me really. I’ll move 10 million dollars LESS of this country’s GDP every year, and enjoy life more as the wages rise in the industry so that they can keep drivers at all.

The whole logging system is a joke, I don’t need a machine telling me when I’m tired or not. It’s set up where I have to sit some mornings for 2 or 3 hours befor I can start driving, while I’m wide awake because I haven’t been of duty for 10 hrs. Then when I can leave by the time evening rolls around, I’m driving tired, because I couldn’t leave when I was wide awake in the morning. We are all adults I think I know best when I should start my day, and stop it. Not to mention the crazy 34 hour restart, and the dang mandatory 30 min break at the 8 hour point!

It might also be beneficial to provide discretionary exceptions based on a drivers saftey record. In other words, use more stringent rules for drivers that are habitual saftey risks.

I’m retired now, but when I used paper logs back in the day I ran so hard that I didnt remember how I made it to my desination. Once I did 3 back to back 1000 mile loads. Never used any drugs of any sort. Looking back, that’s scary. Glad you Drivers are using E-logs. Be safe.

The 14 hr rule needs to go away. WE manage how we drive. If the company you drive for watches your HOS and bugs you to be driving any time you have hours, THEY are the problem. The 14 hr rule makes this easy for them.
If we had the old split sleeper berth option, it would be easy to stop and take a REAL break(not that POS 1/2 hr we are FORCED to take) and not be forced to drive in rush hour traffic, or in inclement weather, without having a problem getting where we need to be a bit later on. There are plenty of times that being able to take a short break at a shipper or receiver and then get down the road, helps out a bunch. You can’t do that now, the 14 hr rule and the 8/2 split make it almost impossible.
The 34 hr reset…that works just fine, not sure why it is considered a problem. Way back when it took 3 days to get your 70 back.

ELDs are about accomplishing one task and one task only-to remove older drivers and replace them with a younger version without having to take ANY responsibility for the horses they are putting out to pasture and the glue factory. The industry has allowed Uncle Sam to put us all on a modified version of work release in county jail because they essentially have cr@p for hiring standards and will take practically anybody with a pulse. I pee in a jug because I can’t stop every 2 or 3 hrs. I don’t sit down to eat anymore. Usually make a sandwich while driving. I push the speed limit to the max(7-8 mph over limit). Even changed my pants and shirt because early morning cold turned to afternoon warmth. No stopping for this truck. Load, unload, fuel, 30 min. Usually can’t get my 11 hrs. in. Have to turn down loads because p/u or delivery times. Can’t drive past 8 or there’s no chance of finding a safe parking spot. I push as hard as I can go from the min. I wake up until the min. I pull over. I apologize to all you company drivers for not giving you enough credit. ELD’s are grueling and exhausting. I’ve been doing this for 25 yrs. and never felt this wore out and tired. Also, to add a little salt in the wound, I make $500 to $600 less per wk. . See ya down the rode. I’ll wave. Can’t afford to stop and chat anymore. Now doesn’t everyone feel so much safer?!!

I came to TX last week and am currently working in the oilfields under the TX intrastate HOS rules. The best thing about these rules is that there is NO.14 hour window to deal with. Daily reset is 8 hours. Drive time is 12 hours and on duty + driving is 15. I’m 63 years old and have been driving professionally for over 40 years now. The rules fit great. I’m awake when it’s tome to work and ready to sleep when the 15 hour limit hits.
Once again, Texas got it right, and the feds are still not over the headupassitis epidemic!

I am a local copier delivery driver/ installer in Los Angeles the 14 hour rule works out ok, keep in mind I also install and push copiers into offices, stair jobs, so by the 12th hour am already tired , by the time I get back to the warehouse am close to 14 hours and exhausted , and driving tired is like driving drunk

Truckers brought this on themselves. Running illegal, two or more log books to make money and a total disregard for safety. 2 years to get programs up and running. BS that they are not compliant. If FMCSA/DOT started issuing citations to motor carriers, they can turn around and sue the ELD makers for selling a non-compliant product. That would get makers to get theirs fixed.
I’ve been in this industry since 1988. ELDs are needed. Prevents dispatchers from pushing drivers to drive when they are tired or have no hours available.

So many drivers confuse the ELD and the HOS. Two totally different things.HOS tells you what you can and cannot do and how long to do it. The ELD keeps track of what you have done and how close to a violation you are..Back in the good old days we could stop the clock without penalty. Not so today. Take as long as we needed or wanted to enjoy a sit down meal. Take as long as needed for a safety nap and it did not count against our day. Tell the FMCSA to don’t even think of a “pause” in any change to the HOS. It should be STOP the clock for as long as needed. No time limit.Matter of fact the ELD is not needed. It is here due to some class b carriers and drivers that lie and hide from the dispatchers and regulations. Then Werner got in trouble and to stay in business cut a deal with the govt. Werner was the tester.Many years ago the idea of being able to track a truck / driver was discussed. About the mid 70s. Today we have that idea in operation. It is called CONTROL by the ELD and every driver is considered a thief, liar and unsafe and needs to be monitored. To get it put in trucks accidents had to be publicized non stop. that had to be the word safety needed to be used. The word Safety has a positive sound and that is how it works. Add in todays drivers that can’t read an atlas,barely speak English , damn near know how to dress them selves, look like they have rented the truck stop dumpster to live in ,have been raised in the electronic world of texting and instant gratification.Too lazy or stupid to use a rest room in a truck stop or rest area or customers. We are stuck with it due to the modern day steering wheel holders and the lazy ones that can’t put pen to paper. Since a majority of the drivers of today have not learned the art of personal communications, we are stuck with electronic and many of us just don’t do that due to not needing it..Yes there are some that don’t fit this image but they are far and few between. But these are t the drivers that the public and the LEOs see and they put all drivers into one category.

The Gov needs to look at real safety issues such as a person can come off a couch go to truck driving school and 3 weeks you have a CDL . And ready to drive a 80000lbs vehicle and enter our public Hwys. And in many cases get your final training from a driver that has less than a year experience his self. Look at the accidents that we see im sure it tells the truth and most accidents caused by a truck with a ELD.

This is pretty ambiguous is this talking about the Grandfather rule which allows carriers to use AOBRDs (the previous versions of what we now know as ELDs) until 2019. This was a rule from the get go to help those carriers who already had devices but weren’t compliant with ELD. It gave them a bit more time before having to replace their initial investment.
If that’s what we are talking about this article is somewhat misleading. But then again it’s ambiguous enough that it’s not clear either way.

I was a driver with 12 years on the road and zero accidents and zero moving violations. They got me on a minor health issue which hasn’t effected me in the 15 years since that happened in the least bit, and off the road go I, but still fine for me to drive a 4 wheeler. I was a safe, careful driver with 12 years of experience and they pulled my health card and put a young, inexperienced cowboy on the road in my place. I don’t get it why that’s a good idea. The government is so screwed up. You can’t put people in plastic bags on shelves to protect them. This is supposed to be a free country.

The issue with a shut down two fold. Is the advance notice given publicly that gives the grocery warehouses a chance to stock up. If the leftist media decides to publish it.but, Other business will not have that ability and we will be able to make a point. The easiest is if the reefer drivers / carriers just back to the chilling houses docks in CA but refused to open the doors or load, The truck farmers would be plowing crops under at the cost of many millions of dollars and forcing Sacramento politicians to action, Ca would be changing some rules. the rest of the country will take heed. After a 10 hr shift, I fall asleep hard for a few hours but then I’m up several hours before driving again, so I start my next shift tired. Bring back split time. As for Eld’s, I have never seen so many trucks parked on the shoulder and ramps sleeping, doesn’t anyone see a problem here?? I don’t mind a device if it worked, but the HOS don’t work

You can’t plan for that 3 car pile up that costs you 3 hours. And you would have made it to your destination otherwise. The 14 hour rule does not mean you have to run the same 14 as everyone else. It actual allows you to run your day on the time table you want. The old rules would have you up at all different hours when shippers and carriers where pushing us to get back up and run as soon as that old eight hour break was up. I for one do not want to go back to having people who are sleeping in their beds at home telling me I have to get up and run just because my clock hit 8 hours at 02:00.
The 14 hour rule stopped that. But anyone can do their 14 anywhere around the clock that they choose or their cairrer chooses for company drivers.

I drive OTR. I dont have a problem with 14 or 11 hour rules as long as brokers and dispatchers are reasonable with safe long distance schedules.
I have issues with ELDs that are poorly designed and not driver friendly. Sure they hold a lot of info, most of which I dont need to see. But what I do need should be easily accesible both visually and tactile.
I do no touch freight. So extended loading and unloading by lumpers can waste my 14 – The rule to override some of those hours would be useful if the ELD actually worked to extend the 14 in these cases.
Lastly, the 8 hour rest rule. I have not had an ELD that performs this, instead it only sees 10 hours rest.
For me the regs are fine, its when normal human inefficiencies at the docks, roadside, and ELD programming dont work harmoniously. Thats tough to accomplish in the real world. But if those things work against me, i as driver should not be punished or exoected to break the law.
A good logistics team and scheduling goes a long way!

I’m retired now, but when I used paper logs back in the day I ran so hard that I didnt remember how I made it to my desination. Once I did 3 back to back 1000 mile loads. Never used any drugs of any sort. Looking back, that’s scary. Glad you Drivers are using E-logs. Be safe.

Two the brokers and dispatcher are right with them and let the driver’s do there job. And for the hours go back to split sleeper times, since that was changed the accident rate is up 56%. I am happy with the new rules. Since they have been implemented, shippers have backed off in my world. The eld itself is just a tool and I find it way more convenient than keeping up with paper logs. I already had my trailer tracking me so fudging it on paper logs was not an option. And in my opinion that is the only reason anyone wants paper back. They are calling it flexablty, but the true word is falsify.
I do not have any problem running the same freight I have been running for the last 10 years, only now when some shipper tries to push me to running illegal with the threat of finding some bozo who will, I can just say “ok good luck on that one”. The new rules have force shippers to be more flexable, and that is a good thing.
And changing the rules back will not solve the driver shortages. The main reason behind that, is the new generation of drivers is not willing to give up the things that truckers have had to give up to do the job. Hometime. Autonomous trucks are on the horizon, and not necessarily that far. Frieght is already being delivered in several states and testing and development are coming along. Instead of screaming and kicking about change, it would better serve anyone to chart where they will be the best off in the coming new realty. Because it will arrive whether you are ready or not.

The HOS is the problem. NOT being able to stop the clock for things like a safety nap or to sit down and take as long as you need to eat a decent meal without penalty is the problem. The penalty is sit and eat you use up driving hours and soon the 11 is used up. Getting a bit sleepy and take a nap? Penalty.. You ate up driving hours. The driver needs to be able to stop the clock for as long as the driver needs to become safe to drive again.Period…. Because the penalty is short pay check to the house due to short miles is why they drive tired and sleepy and in poor health. It is not the ELog. It just shows you the ticking clock and what you did. . The HOS needs to be completely redone with the drivers being considered and able to make decisions on safety like we used to be able to do. Stop the clock to wait out rush hour traffic . to sit down and eat a healthy meal. to be able to take a safety nap if needed. All with out penalty. Let drivers drive like their bodies tell them they can. some days are long and other short .It is all on how one feels . We were able to do it in the past, Why not now.

Here is a thought, just give everyone enough money to be able to spend more time at home, more money to buy and fix our equipment. After all we are in it to make money, I don’t know anyone that wants to work 20 hours a day just to get by. You see the rates havent changed and it is the real problem, but everything else did go up in price. Truck price appreciated 20-40k, shop rates from $75 to $130, tolls went up 50 to 300%. What they need to do is regulate the brokers, not the truckers. I know brokers in chicago making $400,000 a year and they only have a phone bill.

There should have been only 2 ELD programs allowed, PeopleNet, and Qualcomm are the best programs on the market today. I used PeopleNet for 4 years, at first I thought, what a joke, but when I got used the program, everything went smooth, you just have to learn how to properly guage your hours of operation. ELD will work for you, but only if you work with it.

One of the things they’re were trying to do is take trucks off the road when in reality they’ve put more on the road at the same time. Everyone shuts down at the same time with no where to park then start about the same time more congestion. Just crazy

The 14 hour rule doesn’t need to be changed, it just needs to be able to have a pause button. If you decide to take a 2 hour nap to refresh then you should be able to input that to extend the 14 hours. It should also have traffic delay built into it. So if your stuck for 2 hours behind a wreck up ahead, and are not moving then you should be allowed to input traffic delays and extend as well. This would help to alleviate racing down the highway to beat the clock when you’ve been delayed.

All I read in all these comments is that drivers have been cheating paper logs, ELD companies have swindled carriers, and no one uses sleeper berth provision.

so which elds are they talking about that allow you to manually change driver status, settings, and speeds at which the device turns on……ill take 10 of them

These rule makers are so out of touch with reality. I’ve decided that I Parker Johnson am going to be going after the job as the head of FMCSA. I’ve been in and around the trucking industry for over 20 years so I feel that I’m definitely more qualified than these current law makers.
