Just a few months after spending almost four years in jail for his role in a $3.6 million check kiting scheme, Timothy Kephart appears to be at it again. The former CEO of Dart Trucking in Ohio is currently being sued by the U.S. Department of Labor in order to recover money taken from employee paychecks.
He now owns Kephart Trucking along with David Kephart and, according to court documents, has been deducting money from employee’s paychecks to go to the company’s 401(k) retirement plans. None of the money has managed to make it into the fund.
“The investigation determined that employee deductions representing voluntary contributions and loan repayments for employees of the company, totaling approximately $270,000 plus interest, were not remitted,” a Labor Department statement said.
Though a lawsuit has been brought against the owners and officers of Kephart Trucking, no criminal charges have been filed as of yet.
The lawsuit seeks not only to return the $270,000 plus interest, but also to appoint someone else to be administrator over the funds and to block the Kepharts from handling that fund or others like it in the future.
