A new lawsuit has been filed by the Environmental Protection Agency (EPA) against Navistar International Corp. over the sale of engines that failed to comply with the EPA’s emissions standards dictated by the Clean Air Act. By some reports, the EPA could be seeking over $300 Million in fines.
When the Clean Air Act emissions standards went into effect of January 1st 2010, it mandated that no new engines could be sold that violated regulations put forth in the Act, but any engines built before 2010 would not be subject to the same restrictions.
Navistar’s legal team is hoping to skirt around the issue by pointing out that the engines may have been sold after Jan 1st, 2010, but they were built in 2009, before the standards went into effect. The EPA has countered that argument by pointing to very specific language which prohibits “manufacturers of new motor vehicle engines from selling, offering for sale, introducing, or delivering for introduction into commerce” engines that don’t meet their requirements after January 1st, 2010.
Bloomberg Business reports that the suit could seek as much as $37,500 in civil penalties per day for the approximately 7,750 violations.

Good point can u say double standard. I also believe if the dirtiest diesel we receive can be cleaned up like in Europe and japan the trucking manufacturers won’t need to create these epa compliant engines then who will they sue oil companies.
Only thing I can figure is the owners of Navistar didn’t donate to the Ovomit administration.
Both of those comments are valid. Now it is time to let dead dogs lie. Navistar has really taken it in the shorts over this stuff with their Maxxforce engines. They got rid of the stupid CEO that was behind all of it, they have upgraded all their motors to the new SCR standards, they have had to make good with all of the customers who got the short end in during this time. Leave Navistar alone. I do not own a Navistar truck, but it just isn’t right that almost every month, someone else is trying to take their pound of flesh from Navistar. The EPA just wants to get in on it and see if they can cripple Navistar some more. There is nothing good can come of twisting the knife into Navistar any more.
The problem is dirty diesel. Toronto railway received new diesel engine that won’t run on the crap we put in our engines. The diesel fuel we get is very dirty clean the fuel no need for epa bullshit.
If you believe in “Global Warming”, Climate change , whatever is the latest rant from the socialist, this must be an affront to you. So, the “government” is going to get a large sum of $$$$$ from yet another American company. The “government will get this money and ………..GIVE IT TO THEMSELVES.
We the people will have to pay for it with increased costs, spread over the
Navistar corporation.

The spa Needs to take a short walk from a tall cliff, they’re so-called emissions worries are all invalid, take for instance these punks and there black coal puking diesel pick ups, the spa should think about those emissions.

My boss has a diesel powered p/u, it doesn’t belch black puke but he says when the def gets low his truck slows in performance/power.

I used to work on that junk Maxx force engine. They piped too much exhaust gasses back into the engine , in theory it could have actually worked. I would have changed the piping to make it work. Good design and theory it could be fixed with minor changes , which I tried to explain to their rep 3 years ago.
Like it was any secret that the Maxx Force weren’t making EPA spec way back then. International screwed the pooch horribly back then, but they’ve since fixed things. This is EPA aiming for their pound of flesh, it would hardly surprise me that a statute of limitations is coming up soon and they just wanted to maximize their claim before filing suit.
