
When Old Dominion filed for a second ELD exemption, they blamed the maker of the ELDs they were using. Now, the Federal Motor Carrier Safety Administration has said that they’ll consider all carriers running PeopleNet ELDs as part of the exemption request.
In a notice published on January 31st, the FMCSA announced their consideration of Old Dominion Freight Line Inc.’s one-year ELD delay request. It is stated in the notice that “FMCSA considers the request to be on behalf of all motor carriers in similar situations concerning the integration of PeopleNet’s ELD software into fleet management systems.”
While the highly controversial ELD mandate has had legal challenges, legislative opposition, and significant lobbying pressure against it, the FMCSA has charged forward anyway. FMCSA Deputy Administrator Cathy Gautreaux even called the rollout of the ELD rule “a success.”
But many carriers, truck types, and even whole segments of the industry have requested exemptions from the rule. If the FMCSA decides to approve the ELD delay request from Old Dominion, it would mark the first time that the agency would grant an exemption for any carrier because they use a specific ELD.
In their delay request, Old Dominion noted that while they already use Automatic Onboard Recording Devices (AOBRDs) from PeopleNet, becoming ELD compliant is taking longer than anticipated because PeopleNet’s software updates aren’t ready yet.
Previously, Old Dominion had a 90-day ELD waiver approved. In their approval notice, FMCSA wrote that because of the size of the carrier, “it is in the public interest to avoid disruptions to Old Dominion,” and so decided to approve their request.
It is unclear if a similar rationale will be considered in their year-long exemption request.

There are *so* many more systems in similar disarray, and many more will be easily thrown into disarray by changes to HoS rules in the future. Will the DoT grant exemptions and delay every time? Or will this just be about making the industry come to them, hat in hand, begging for leeway, every time the whim strikes them, to change a rule?
It’s time we started calling for the dismantling of a federal buracracy that is answerable to no constituents, and which writes policy with the force of law, with no effective system of oversight or review.
Peoplenet is a terrible written software use it everyday. It is another failed microsoft blob that locks up and takes for ever to rsync.
I don’t know how long you’ve used it, and I’m no longer using it, contracted to another carrier. In my use and experience of Peoplenet from July 2009 until September of 2017. I had issues on very rare occasions. Each time was just a matter of using the reset or disconnecting and reconnecting so it could reset. Only one time did I have issues where I had to go through a hard reset which took about 10 or 15 minutes. Less trouble than you have with a home or work pc, or your so called smartphone. Remember, all this technology is designed by humans for humans, therein lies the source of all problems. Very user friendly system with lots of add ons. In contrast to the Rand McNally GPS tablet ELD device. Now there’s a system with issues in the beginning, though it has gotten better over time thus far.
This is exactly the kind of bureaucratic BS that POTUS should target for repeal. NOBODY voted for this. It was foisted upon the trucking industry by the ATA lobbying for it in the name of safety.
Nix the whole damn program, all of it! The notion that a computer controlled log determining when a driver should roll or stop, is safer than ones own judgments, is ludicrous at best. Those who came up with the notion in the first place can only be considered “simpletons” and haven’t the foggiest idea of what “factors” determine when and where is the best time to keep truckin’ or to stop.

ELD login device forces you to run as fast as you can in the amount of time allowed by the machine. I have been on paper log forever and never had a problem and now it is a constant battle. Band ELD
I totally agree Evan. ELD’s have forced me into a position where I have to speed. A race against the clock. A few times I wanted to take a nap. NOT HAPPENING. Keep driving before your clock expires. I truly don’t see the safety aspect of these devices. I feel my safe driving habits have decreased considerably. I continue to be as safe as possible, but that ELD makes it harder and just causes additional stress that I don’t need out here.
If you are tired, just stop and rest. You run the machine, do not let the machine run you. I also am on the ELD.

I don’t care about the eld period. It’s more expensive then paper and the tracking is insane. They have a new bill in the works for cdl holders to have to put eld in personal vehicle so they can see what we do with our free time I’m guessing you are ok with that since eld is not the problem

That’s true! It really is the HOS and not the computers. We always seem to come back to the HOS where all this BS first kick off. Uhhh…well thats after deregulation of course!
The driver alone should be able to dictate how long he can work. I know people who can work 8 days a week and drivers who can barely work 8 hours/day. The people who can work should be allowed. Those who can’t should not be forced to work.
Any driver should be able to make a good living on a 60 hour week. A very good living. Especially road drivers who sacrifice their family life for the road. Pay drivers enough so they don’t have to work beyond their limits just to make a living. Trying to apply cookie cutter regulations to a diverse driver community only has one product. Kaos.
Someone mature enough to be entrusted with an 80,000 vehicle should be able to decide for themselves when they need to take a nap. Again – pay drivers enough so that they don’t have to press the envelope of safety just to make a living.
Another problem is that your company can’t get the unload as requested. But most are set to have a driver run like crazy then take a 10. You can barely get 8.5 hours sleep in that time. Then are those use to taking a split sleeper. They only sleep 4 hours at a time. Rules, rules…

And even the state troopers can’t even write tickets cause they don’t have the proper software to write them it’s a bloody joke.
I bought the Switchbord ELDs, for my trucks, and 1 has already showed that my driver drove 157 miles while he was on his 34 hour break, and he never even moved his truck, another showed driver drove 16:05 hours non-stop which was also a joke.
I served 4 years of my life for this Great Nation so that people did not have to live under the eyes of the government!
