After about 19 months of hibernation, the proposed rule requiring the installation of speed limiters on commercial motor vehicles has resurfaced.
The National Highway Traffic Safety Administration first proposed the federally mandated installation of speed limiters back in March of 2011. The NHTSA has stated that the installation of speed limiters on heavy commercial trucks would reduce fatalities in crashes involving commercial vehicles on roads with speed limits of 55mph or above.
The agency delivered a document to the Office of the Secretary of Transportation on March 4th announcing their intent to advance the proposed rulemaking on speed limiters. The next step would be deliver a formal proposed rule to the Office of Management and Budget.
Both the ATA and Roadsafe America have filed petitions endorsing speed limiters and calling for a maximum road speed for trucks of 68mph. OOIDA meanwhile has rejected the idea that speed limiters would make roads safer. Instead they call for uniform speed on highways, stating that speed differentials will only serve to increase vehicle interaction which can lead to unsafe maneuvering.
In Canada, OOIDA member Gene Michaud is challenging the constitutionality of mandatory speed limiters. He claims that speed limiters harm his ability to conduct his trucking business safely. A Canadian lower court agreed with him, but the province of Ontario has announced its intention to present an appeal in September. While the constitution of Canada and the United States are obviously different, and the decision looks like it will be appealed, the lower court ruling does provide some hope for American truckers who are tired of government regulations making their jobs more dangerous.

I totally agree with OOIDA that uniform speed is the key to less accidents. If your going to govern speed then you have to govern all vehicles the same. For example you cannot have cars in Texas traveling at 75 MPH in some sections of roads and trucks moving much less. Unfortunately that is exactly what is happening as many trucks are already governed at 65 mph. Again our federal government has become a micro management style for us all. I would be less inclined to be against a govern speed limit if it applied to all vehicles. If both cars and large trucks operate on the same roads then you have to apply the same rules.
Brother you are so right I have been stuck in a 64mph truck and I am getting cut off non stop by motorist how think I am deliberately impeding traffic. So cut close on me and hit the brakes to teach me a lesson. It is just a hazard to be traveling 10mph slower then the four wheeler traffic. if the people that call themselves professional drivers driving 80,000# truck would operate in a professional manner and not drive wide open all the time, and the police would do their jobs and stop profiling and gettin fat off the tax payers dollar and politicions would stop trying to control other businesses and worry about the things that really matter to make and keep our country safe and from going bankrupt and reduce the wasted spending in government is something we could all live with…..
I also agree with OOIDA, but I think that non commercial drivers should take a course on trucks . so they know what a truck can and cannot due like braking and other different variations of the truck. And why passing on the shoulder of the road is dangerous and cutting off trucks trying to exit off ramps on freeways, because we are already slower than non commercial vehicles. It takes longer to get moving in truck as you well know and trying to come to a complete stop. It is complete ignorance when the general public assumes we have eighteen brakes….educate the public on the danger that can occur when they do not keep a safe distance around a big rig.
Since we “share the road” with other traffic, why not have uniform laws for everyone? Limit everyone to the same speed, limit everyone’s driving and total work time, require log books for all drivers, weigh/inspect all vehicles, require specific endorsements for pulling trailers or driving size specific vehicles and everyone has to pass a physical/random drug screen with the same standards? Given the information recently released regarding the causes of truck/car collisions, it is only right and just to lower them to what we have been dealing with for decades.
Also restrict what type of roads they can drive on. I’ve seen too many four wheelers, and a big rig, not do proper merges onto the highway.
Uniform regulation like this might fly in a country like Singapore. Not sayin’ it’s a bad idea…just sayin’.
They will never govern the speed of an average vehicle when then have a revenue stream from tickets. Imagine what would happen if nobody could break the speed limit? Maybe they can start inspecting all vehicles like they do commercial vehicles.
Lower speed limits are not the answer either. As someone who often drives the northeast, I can tell you that people drive the same speed regardless of the speed limit…lower limits just cause people to slam the brakes when they see cop cars, and they cause more passing because of people like me who don’t want tickets and thus actually do the speed limit. If they actually cared about safety they would increase the low speed limits to reasonable speeds and they would use those dot officers that keep inspecting my perfect 2010 truck to write tickets to people doing 25 over in work zones.

I’ve been trucking for 26 years,and have seen some ridiculous changes and everytime they do,its done by someone looking to curb our earnings ability,or cause a shortage so they can bring in “undocumented aliens” to drive for less money!!

Here’s a thought (not original): Eliminate mileage pay and pay strictly by the hour- with time and a half after 40 hours. Drivers would have no incentive to speed or violate hours of service. Shippers and receivers would have to get trucks in and out in the appropriate tariff time window or pay the price, as suddenly there would be a cost to the carriers that they rarely feel now. And the carriers would have to pay the drivers according to the hours logged- whether driving or sitting at a shipper/receiver. Of course this does not solve the 4 wheeler problem. And also, of course, regulators would never impose such a rule, as it is simple, practical and does not require a Philadelphia lawyer to figure out. Carry on.

I own five trucks and pull containers out of the rail yards in the Cleveland area the rail yards are the worst places to ever pull out of. There equipment is always in need of repair, I have sent pictures and letters to the CEO and know response.
I admit I pay by percentage but my guys are home nights and weekends. I have tried to get the companies to boycott the rail yards for the time drivers have to wait for repairs etc. Not one will even think about it , there answer is pull something else if you don’t like it.
I have tried for years, now I have five trucks for sale and getting out of this business!
Lets state the obvious…the interstates WERE NOT made for cars..it was made for the military and trucking industry to transport goods and personal from coast to coast..now I’m not saying they can’t use the road but we should be able to video tape us getting cut off and submit it to the police and they prosecute them for their actions and if their actions result with a major accident involving death or serious injury that they never get to drive again and suffer serious fines..now a days if you bump someone you get write up for a crap load..inspected, drug tested and held up 3 or 4 hours and finally let go, but let someone bump or put you in a accident.. They get wrote at fault BUT GET NO TICKET.. The trucking industry has went to the trash can and every since ray la hood (libertian dumb@$$) has took it over it’s just got worse and prepare drivers. It’s only going to get worse..i don’t mind governing ALL vehicles but the root cause of 75% of all commercial vehicles wrecks are a result from a car not leaving enough room, i.e. (oh my I’m fixing to miss my exit and curing across 5 lanes of traffic WITHOUT LOOKING next thing you know 3 other cars collided and you rear ended them all killed one person and because you were on that road at that time you are at fault..you have better insurance…drivers. Protect yourself..if you do not have a dash cam get one…or get real lucky..it is the only thing to protect you froma lying driver

First you need to get your noses out of trucking. If you hadn’t pushed your ways on truckers this economy would be a lot better off and truckers could make a better wage.
Now as for this proposed law. WHY. We already have speed limiters. Its called a speed limit and the are posted every few miles. You want to go after trucks for everything. When you cut all trucks down to a set speed like that you are going to over crowed the roads with trucks. You make us a rolling road block. do we need to do to the country like we did to Ohio. side by side from one side of a state to the other. Let all of you congressman and senators get stuck behind us for 100 miles every time you leave and see how you like it. You understand the small companies make money by getting to the freight and working right. you come up with ideas and make them law to fix things but you only make it worse. How about going after the cars thay run 90 in a 55 and cause all thes wrecks. cutting trucks down to any speed is only going to make it worse. more wrecks later freight which will lead to higher cost of goods since rates will have to go up to support truckers so they can make a living.
I’ve been saying for 25 years, that we MUST strike to get what we need! Fuel prices, speed limiters, unfair legislation, unfair police practices, and harrassment, being barred from parking lots because of piss bottles and disgusting personal habits of our “peers” ( that one I’ll leave to your imagination), and all kinds of “you name its”, most of which we haven’t brought upon ourselves! WE are an “ESSENTIAL SERVICE” and should lobby as that!Without us..what happens? Try ,today to bring young men and women into this industry, and you’ll find them uninterested in it. They want the soft “cushy” jobs, even ones that they have no qualifications for..but they sure as HELL don’t want to be in trucks! I agree with Bob on this and I have to admit, when I first started trucking the regulations didn’t matter to me. However, the more I drove, the more I hated the laws and regulations they have against us. I was driving through Nashville, TN one day and saw a state trooper going 85 (reason I know he was going 85 is because I have Meritor sensor that tells me how fast someone in front of me is going), no lights on and had his phone up texting going down the road. I said then if I had of thought, I should have gotten his tag number and called in on him. They are no better than we are. I told a buddy of mine that we as truckers should strike because that is the only way to get the law makers attention. Let the U.S. shut down after two or three days and see what laws change. But, like he said, “who all do you think will really strike? Company drivers won’t because more than likely their company will fire them and company drivers make up most of the trucking industry now”. If something don’t happen trucking as we know it will have more laws than we can keep up with. If someone see’s a 4wheeler doing something wrong, like aggressive driving, playing chicken with you or a driver, cutting you off, etc; call the State Police. I have before and will again. I called the State Police on a driver in Kentucky who cut me off and turned his rear lights off the trailer he was pulling. I guess he thought I would hit him. However, I called the State Police and reported him. I stayed behind the driver just to see if they would send out a trooper. They did and pulled the guy over. Not sure what happened on that, but at least in Kentucky it worked.
Governing ALL trucks is NOT the answer. People get pissed enough when there is a 63.4 mph vehicle passing a 62.7 mph vehicle. Speed is not the biggest factor in crashes. Lack of common sense is te bigger factor. Your in a 80,000 lb truck not a car you need to adjust your speed accordingly. If we govern all trucks at say 65 such as Canada did, one will be pulling 65,000 lbs and one may be loaded to the max. Most drivers do not have the common sense to let off the cruise, let the other driver pass and then reset the cruise instead everyone sits there drag racing on which is more dangerous than a truck doing the speed limit in a 70 mph zone with traffic lined up behind them for mile.

Screw that pay by the mile crap. We get paid by the hour. Overtime anything over 8 hours in a day. We have one of the lowest numbers of accident claims in the business. Safety is more important than speed when making a delivery. And since they have GPS tracking they know if we are screwing around or doing our job. Pay the drivers the real money they deserve. They earned it. Ever since deregulation, companies and drivers have been slitting each other’s throats. This has to stop. Organize !
Well explained. The company want to pay by the mile but now they have no excuse with GPS and Qualcomm. By the hour it must be. In the U.K. and Germany, it’s been mandatory to pay only by the hour since 1974. Time the Congress woke up and joined the advanced countries and acted for people instead of being paralyzed by corporations and the 1% who don’t work for wages. Time we organized but that won’t happen because the Southern Good Old Boys think that would be godless Communism. How bout limitations on government regulators. Appears many have acquiesced their freedom to bureacrats. Government is not our master. It is our duty to limit bureacrats power, that is electing representatives who’s worldview believes less government equals more freedom.
Placing “governors” on bureacrats is the answer, slash and sequester their budgets with real reductions year by year not just a small budget decrease in the increase as was Obama’s sequester.

I agree with the Florida scales, they get you through and out in no time, (unless you are near the weight limit or over). Here in Louisiana the scales will pull you in even though all are now set up to weigh you on the highway.

Some drivers are going to drive like they’re stuck in a real-life version of “Speed”- No matter what, their foot will NEVER come off the gas! getting rid of the cpm would be best. A lot of the drivers are already racing their damned e-logs to try to get their load hauled. I’m one. Turn those e-logs into time clocks, pay by the hour, and companies had better be prepared to do a LOT more relaying! The cpm scam has got to go, though. I’ve been out here twenty years, and when I think about all the hours that I’ve given to some of these companies while they send my family puny paychecks my blood boils!
I understand CPM has been illegal in the U.K. and Germany since 1974 due to safety concerns and dual logbooks being a problem. In the U.S., the I.Q. is lower and the arrogance of the rich is greater. I agree that the trucking industry needs to make a statement but lacks the organization to effect a nationwide strike, so how about this…pick a 10 day period later this year and for that 10 days no one hauls a load into or out of a state Capitol city…no gas into, no trash pick up, no food into…nothing. Show them how trucking affects their lives every day. In 2 days they will be begging to restart truck services. People see us as an obstruction to their lives and they need to see us as an absolute necessity to their lives. Living without us for a few days will do it!!

He’s thinking “What laws am I breaking that some “crooked D.OT. officer “can use to take away my money to ruin me”? I had a guy in Ohio in 2005 hit the right side my truck at 55 MPH,and kill his passenger,my truck was doing between 10-12 MPH while making turn on a green. I got blamed for the death by the Ohio Highway patrol,and lost my CDL . It all came down to the police “playing Politics’ at he accident scene. It’s easy to “screw over” a out of state trucker using “more government regulations” as tools to give a truck driver a bad reputation.
It’s time for all truckers to go on strike! Let’s see how long it would take! If they want to slow down trucks even more, how about we give them trucks that don’t move at all! No one can blame trucks for any accidents that occur on the three days or so that can still drive!

Regardless, having trucks and cars with different speed restrictions isn’t smart either. Take a look at Chicago and some cities in Tennessee. You got Car: 65 Truck: 55. Car does 70-80, truck does 60-65. Who’s going to get into an accident? Impatient cars because they’re late for a blowjob and get caught up behind a slow moving truck and do ANYTHING to get around.
Trucks driven on the roads anywhere pay Road Use Taxes for the use of that highway. Some prick politician(s) is screaming about trucks running to fast, causing to many fatalities. Most people do not realize, that without TRUCKS, there world would stop. Those are same morons that will pullout in front on a truck, especially on a two lane road and don’t realize there is more than 40 ton bearing down on them at speed and think he/she can stop on a dime. They are also the same stupid SOB’s, that has a problem looking at the back doors of a tractor trailer. Only to drive 90 mph to pass you anyway they can, to stop in front of you to turn left.
There is really two schools of thought. If the trucks pay the taxes to use the highway, to deliver food, fuel, the essentials of life; they should be allowed to keep up with traffic and pass when necessary. It really is not up to the politicians to micro manage your life. When you call it a day, you still may be thousand miles from home. Being an over the road driver, your life is your job.
On the other hand, the speed limit is generally put on a highway for the people that really can not drive to begin with or can not handle what they are driving. To get a permit to drive, a person should have to go through the state police training course to get there permit to drive a car. The schools for truckers, should have trucks, that has NO AMENITIES for comfort, no special equipment to help you drive and loaded trucks(a tanker loaded with water would work), because a truck feels different empty versus loaded, add weather conditions, then the school might be close to real conditions.
So what it going to be, choke all heavy transport vehicles down to the point below the posted speed limit, to create a rolling road BLOCK everywhere you have to go. That alone tells me a politician come up with this stupid idea. For the lack on a better word.
This part will make some of you mad, but step back and look at it from someones else’s angle. I learned how to trailer truck across the USA, old school. There was no GPS, nor did the trucks have JACOBS brakes on them or power steering and A/C. The truck then where just a simple truck with very few creature comforts. So when you start down a mountain, you best know what the hell you are doing.
Trucking schools do not even teach pupils how to handle a rig loaded, on any type road weather combinations. If they started now, then it only has been going on for a short while. If you ride down the highway for any length of time, it is not hard to spot a driver from a school. The courtesy of the drivers of yesteryear is not on the highway anymore, because that cannot be taught, by any teacher or school. It was passed on from one driver to the next.
Whether you know it or NOT. Truck drivers have the country over a barrel. I remember an issue like this, that arose in the late 60’s early 70’s and government was getting to big for there pants then as well. Jimmy Hoffa went on strike and parked all of the trucking companies he had control of at that time. It took less then 2 weeks, the grocery stores where empty and the public was going berserk, there was not merchandise on store shelves and in the end, The driver got what the government off there backs. It can be done again, but it will not be without some pain, but it looks like it needs to happen again.
They are so out of touch. They want to bring down the fatalities on these highways. The problem and the solution is so clear. 99% of the people on these roads drive eith little if any regard for anyone else. You need to change the mindset of the motoring publc before you get any significant change in the fatalities.There is just to much lack of respect for each otherout here. As I read this limiter story I am saddened by a story I heard yesterday: somewhere, a little village is missing their idiot. Speed limiters are the single greatest cause of big rig/4-wheeler interactions. They piss off the jerks in the cars because we’re “in the way” and the limiters piss off commercial drivers because we have to put up with the 4-wheeler jerks and their stupid little protests directed at us for being in their way. The idiots making these proposals have one thing in common: not one of them has a CDL, and none of them have ever been in the cab at all. I want to know how these lesser life forms got to a position allowing them to dictate my job so I can beat somebody with a stick. The next time we find out this board of jerks is out of their meeting room, we should flood it. Maybe we should flood it when they’re in there….
Ontario has a speed limit law for trucks. my truck was turned down because of this from my company because we frequently travelled to Canada. I Crashed in to a wall in 2009 in a 65mph truck because i was cut off when a car was coming on slower then me was cutting in front of me. I didnt have any room on my side because of a car that was there . I slammed on the brakes and something snapped and sent my truck flying 3 lanes over into a center barrier. lucky for me Imissed everybody
Now my truck does 85+ I dont have this problem any more. I make people drive smart. You want to get in front of me? Thats right your in an acceleration lane. USE IT! The problem isnt the trucks. Our government is stupid! most companys already regulate their trucks to 65. im talking 85%. Now 50% of trucking companies are electronic logs.
Regulating laws to change something that is already changing itself is wasteful. How bout you legislate something that makes a difference. Like keeping our money in America and demolishing this Budget crisis and National Debt. How about they start enforcing laws instead of crowding the law books with more laws. Our government is using crisis to force things and cause the american people to go out and spend useless money on things. Gun laws? How many people spent all their money on guns and ammo? You notice they dont attack grocery stores? No point because there isnt any food tax. They attacked the fuel pumps by 400% and we are still going farther and farther into debt…….
They need to instead focus their efforts on enforcement of posted speed limits for EVERYONE. I travel through Chicago IL, Louisville KY, Indianapolis IN, Richmond VA, Charlotte NC, and Nashville TN every week and the speed at which people drive, especially through metro areas, is outright insane. Its a wonder that every day there arent many fatal accidents in every single thruway of every city. I have radar on my truck and know the speed of vehicles up to 400 feet in front me. The average speed of four wheelers, REGARDLESS of posted speed limit is in excess of 70 mph. Its not unusual to have cars cut right in front of me pushing 80+mph, because someone is riding their tail who pushes over 90. Its somewhat rare to see police pulling anyone over anywhere, with the exception of the outside areas leading to or from a city. There needs to be some sort of fundamental change in the procedure and regulation of drivers licenses for 4 wheeler drivers in order to make them understand and appreciate that driving a vehicle is: a) a privilege, b) a responsibility, c)not a constitutional right. And p.s. to truck drivers who think this job is just a way to make a living – go find another job if you cant drive responsibly and youre unable to take your foot out of the radiator to allow for traffic to flow around you and let the rest of us who truly love what we do to do it safely and respectfully.

An example traveling on I355 toll road in Chicago land yesterday I was staying out of the right merg lane when an ag hauler (grain wagon) came hauling ass up on me, mind you I was doing 5 over the speed limit, 8 foot off my icc bumper, this moron stayed on my ass for 2-3 miles like this
trying to intimidate me to get over, I was not in the hammer lane this is a 5 lane road at this point
there was no reason for him to do this with a lane avalible on the left, any way he jerked it into
the merg lane just as a4 wheeler was merging in I wached in my mirror as this so called proffesional dam near ran this 4 wheeler over, all because I was’nt moving fast enough for him,
I got on the radio to confront him, he became defensive threating me with violents blaming me for his stupidity, if I had the time would of taken him up on his offer, nothing like cracking the empty mellon of a dangerous driver, in chicago this is nothing short of normal shit, everyday
speeding is common part of going to work or home, how would a speed limiter work here? the local drivers think there trucks are 4wheelers and drive them accordingly, hell I doing 63 mph in a55 mph zone a CPD passed me like I was sitting still, you gotta love chicago cops, 2 out 10
actually do the speed limit, even though there correct it causes the others to ride there bumper

They put our max speed at 68 then we should respond by passing each other with a 1 mph difference then start an outcry to the public that this governer mandate impeads traffic
I think that speed governors are very dangerous there have been many time that I have been trying to pass a slower moving car or camper on two lane highways out west and have the truck shut off when in am nearly by-leaving me hanging out trying to get back over. I do not think any vehicle should have a governor. we all drive different and having your vehicle shut off trying to get by is dangerous and stressful on every one. I think in all walks of life. people are getting tired of micro management from the government, and special interest groups trying to have more free rights taken away. Have a gr8 day.
All the restrictions and limits for trucks are limits and restrictions for all the economy. With lowering the speed limit you lowering the efficiency of transportation. The job you can done for 1 or 2 days you have to do for 2 or 3 etc. days. example The bancrupcy state of California.
Limits, limits limits… the land of the free and brave people is gone.
Speed limiters is a truly BAD idea. We already have trouble getting in and around traffic, two slow trucks passing one another can back traffic up and cause four wheelers to do some crazy stuff when they try to get around or past the trucks not to mention the road rage it causes. Slow trucks are rolling road hazards trucks need to be able to run with the flow of traffic making it safer for everyone. Tailgating is the problem with speed not the speed of the trucks.
I do not have speed limiter, but I never drive more than 65 m/h. If I’am not in rush, I set cruise at 63 and feel much safer. Those who drive more than 65, are crazy drivers. And dont tell me about traffic flow speed it’s a B/S. Be safe pals, you drive 40 tons
All these higher taxes and regulations are being felt in the marketplace. If taxes are increased, its passed onto the consumer. Wait until people go into a store and pay $50 for a $5 _-shirt. Then they will ask why, but by then, it will be too late.
I wonder how long will it take them to realize that if all trucks are running 65, but one has a light load, one has a heavy load, one is spec’d differently. If a light load hits the hammer lane to pass a heavy load. thenwhen they reach the top, now both lanes are tied up. Which could bring on road rage.
Here in the UK (Soon to be EU Germany) I have driven a truck for over thirty years. Driving is a way of life for me. I enjoy just driving around the country delivering goods looking at the country side, the great houses and homes and best of all when stuck in traffic I can sit in my cab think of great old England and know the longer I sit here the more money I earn. (paid by the hour and fitted with spy in the cabs tacho’s plus limited to 54mph) If the company send me on a job in the rush hour so be it and they want me to go faster (i.e. reduce the running time which by law has to be shown if it is a regular run) then VOSA would be informed and the s**t will hit the fan for them in fines and inspections etc. I love the new regs and the USA should use them, therefore we as drivers are all equal and anyone who is not following the rules should be debarred for good. Speed limiters reduce death on the roads and makes my life so stress free. (Remember in UK we get paid by the hour in 99% of the work we do) I know you are all thinking I am a donkey I know nothing but even with all the laws on driving and fines etc for noncompliance I LOVE MY JOB here in UK. (44tonne is our limit on our roads for normal users and speed limit 60mph but trucks limited to max of 56mph or in most cases 50-52 mph. Just think going from Washington to Denver by truck and how long it would take at our UK speeds and the cost £ ) Being paid by the mile was changed in the seventies here for good reason as you have all been saying on this blog.
