Swift Transportation has agreed to pay a $4.4 Million settlement to former job applicants involved in a class-action case against it concerning background checks made during the application process. The claim was that Swift had violated the Fair Credit Reporting Act by failing to tell applicants that they would be running background checks and for not telling applicants that they could review and contest the findings if they wished.
Anyone who applied to be a driver for Swift between July 23rd 2008 and September 30th 2012 may be eligible to receive part of the settlement money if Swift obtained a background check, motor vehicle history report or consumer report on them without first having an in-person interaction.
If this applies to you though, don’t start celebrating yet, there are about 161,000 other people who also qualify to receive a chunk of the $4.4 million and the terms of the settlement ensure that no one person can get more than $50. If all 161,000 people who are eligible bother to claim their share, each person would only receive $27.33.
Those who qualify but want to opt out of the settlement and take their own legal action have 60 days from the date of final court approval to do so.

“…and the terms of the settlement ensure that no one person can get more than $50.”
Uh, no person except the lawyers, that is! They will take in quite a chunk.
Good point. I see lawyers bragging about the big settlements they’ve earned for drivers, but it’s almost always class action lawsuits. The lawyers make out big and pretend they’re saints protecting drivers. Right, I’m sure they’re doing it out of the goodness of their hearts.
I received a letter in the mail concerning another lawsuit dealing with the way Swift paid drivers for the mileage. I would be interested in THAT… I only lasted 3 trips (month long each) out with them, but what the hell… got the experience I needed to land a gig at home.
If people keep working for them thin they will keep doing it they paid the Congress to make sure those computers went in everybody’s trucks don’t sell your soul this is the same company that hired 300 illegal aliens awhile back was caught by the government I guess they leveled the playing field but the real driver will never work 4 them
