A trucker recently released video footage that he claims shows he and his wife being attacked by security guards when they went to pick up a load. He is facing charges of assault and disorderly conduct in court this week.
Clinton and Shannon Kirker are a husband and wife team who have been driving for almost 15 years. In September, they were picking up a load at Metro Foods in Olive Branch, Mississippi. Clinton says they believed the load was just produce, so it was odd when security guards asked them to get out of the truck so they could inspect the vehicle.
Neither driver realized that the load they were picking up was actually from Metro Logics, a company which stores high-value pharmaceuticals including vaccines for the CDC.
“I saw it said Metro Food/Metro Logics. I had no idea it would be any sort of secure facility,” Clinton told Local Memphis.
After the Kirkers exited the cab, they were told to keep their hands out of their pockets. Clinton admits that he put his hands back in his pockets out of habit and that’s when things started getting tense. The Kirkers decided to leave, but the security guards stopped them.
“We started walking back to the truck and that’s when the guard stepped in front of me and said, ‘you can’t leave yet.’ I told him ‘I’m leaving. I can leave.’ He said, ‘no, you can’t,’” said Clinton.
In the video it appears that the guard put his hands on Clinton when he tried to prevent him from getting back in his cab. Clinton appeared to push him off, and that’s when the fight broke out. Both Clinton and Shannon were wrestled to the ground by multiple security officers.
“He didn’t have a right to touch me, neither guard had a right to do what they did to me,” claimed Clinton.
Clinton posted a picture on social media of his face after the incident which shows scrapes and bruising where his face was pushed into the ground.
It was only recently that the Kirkers found out what the were actually supposed to haul. They claim that they would not have accepted the load if they had known there were going to be hauling sensitive pharmaceuticals for the CDC.
Kirker was arrested and charged with assault and disorderly conduct.
“Security for the facility is provided by an outside security firm,” read a statement put out by Metro Logics. “All trucks are inspected prior to entering, as has been the case for many years. Thousands of trucks have been inspected in a professional and courteous manner with no altercations. Outside of the above statement, the company does not comment on legal proceedings.”
You can see the video of the incident below. The altercation starts at around 5:00. Later in the video a paramedic arrives and you can see Clinton’s bloody face as he sits handcuffed on the ground.

The procedures should be, the security guards should explain to the drivers what’s their policies are, then have the driver sign that he understands and agree with their policies and if not the driver has the option to LEAVE.

You guys are so right. cops, and company security, or outside security have this “I am better than you ” ! attitude. Have you ever noticed….the folks who do this type of work were “bullies” towards others when younger ? Once I was to deliver a load, the security guy told me they were not going to unload my “expedited hot load”. I didn’t argue, I got his name from another employee, wrote his name, and time,date on the freight bill. Then I left called dispatch from the truck stop, gave them the guy’s name. Three days later, after the plant had shut down for lack of parts that I had. When the company was trying to put the blame on me….I just told them to talk to the guy who refused me three days prior. Which they did. I was cleared by the company.

As drivers, you fend for yourself, he’s been in similar situations on lo value loads, and refused them or left. It’s part of the job. CYA. But why is a dispatcher, company, or even the shipper (they are notorious for not respecting DOT requirements for drivers) not giving proper load details, why hide it? FYI Security Officers are legally Law Enforcement Officers with full arrest powers in some states. I used to be one. My advice is treat em all with respect and comply with their instructions and you won’t end up like this driver did. Confrontational enticement to violence is not in the training manual, and those individuals practicing this maneuver should be weeded out; before giving a bad name to the entire department. When the driver’s liberty was challenged, they went to blows. Sad that the outcome was one knee pinning the face to the pavement results in a black eye. The wife possibly suffered most blows.

No they aren’t Terry. The only cases in which a Security Guard would be a law enforcement officer with the full arrest powers of a actual cop would be if he or she was a real cop working a security job off duty.
Since law enforcement officers retain their arrest powers off duty some people hire them to do security off duty. Sometimes they are even hired as bodyguards.
There is no state in which security guards are automatically made equal with actual law enforcement just because they are security guards.
In some states they have slightly more arrest powers then the average Citizen but only when on their clients property on the clock. However even in those states these evil lying goons in the video should be arrested for making a false arrest, battery, and felony kidnapping.
In many states they only have the power to make a Citizens arrest and nothing more. Which might mean you can only arrest someone if a felony has been committed in front of you.
Your job isn’t to arrest people it’s to observe and report. Call the police.
Maybe prison guards and court baliffs which in many cases are actual sworn law enforcement officers. But no not security guards. They aren’t cops. They aren’t “like cops” either.
There are many cops who are absolutely clueless and don’t know the law that well (some do) but there are far far more Security Guards that don’t know anything about the laws pertaining to their job.
I was one for years and some of the completely wrong and stupid crud I’ve heard from other security guards about the law absolutely dumbfounded me.
Most security companies just want a warm body to put at a post though and so I’ve seen some real idiots in my time who shouldn’t have been security guards. Walking lawsuits waiting to happen.
I prefer the idiots who sleep on the job though or who sit in their guardshack with shorts and fuzzy slippers on then violent liers looking to beat someone up and then lie and falsely accuse them so they can arrest people like the scum in the video.
I never sleep at work, I do my job, and I’m not a wannabe cop. In fact if a client told me to lay hands on anyone I’d refuse….. because that would be not only be wrong unless a felony had been committed but it would cost me my license and rightfully so.
I took the job and kept doing it for a few years mainly because I love to read books and listen to audiobooks.

Mark, this trucker may have signed his rights away. One thing he still has is the right to refuse. Due to lawsuits against trucking companies, they want to make sure it’s clear it was the trucker who accepted. I do believe his days at that company are numbered regardless of the outcome. The security guard company, days are numbered if not already canceled. I would urge this trucker and his wife to seek legal advice. Choose from law firms that have a sound track record of successfully going after Trucking companies. Yes, he will need to most likely sue his trucking company if they are not using this company already on his behalf. He will sue for a variety of reasons and one for no advance instructions. This is done for hazmat and should have been done for this. They accepted this contract. He then file suit against Metro Food/Metro Logics. Metro Logics new in advance their need for high tech security and a secured property. They spent at least a hundred thousand on that entrance with even high tech camera, fences, and etc… Their needed high security was apparent to someone and approved by others. However, all this money and need to check the drivers coming in but little attention to the people monitoring the entrance would seem to be disjointed? Regardless of their excuses they did not have in place an escalation plan to de-escalate. Metro Logics own PR words says thousands of checks. So this trucker is 1 or 1000. I think pulling the police reports, emergency responders reports and checking for previously filed lawsuits would be a good start. Then check each of the guards. This will be costly and the trucker will most likely need a law firm that can front the cash. The payoff will be millions.

The truck drive can refuse the load at anytime. The driver decided not to pick up the load and wanted to leave. Once the driver refuses the load the guards should have backed away and say, you have a good day sir. The guard touched him and then pushed him, this is an assault by the guard. The guards do not have the authority to stop, touch or detain him if he’s not picking up the load or entering the property. I hope the driver is released and the guard is charged or at least the guard should be fired.

Enforcing an order to remain, when someone wants to leave, with violence, is kidnapping. It’s a Federal felony. Exceptions to this are few, and include law enforcement and military detention. They do not include discretionary detention by private security.
Rent-a-cops call the police, and defend workers from imminent and credible danger of violence. They do not get to beat down and hold anyone captive.
Take a license plate and truck/trailer number picture, and call the police. The baton is there so you can fight back, if attacked – it is not there for you to use to force people to obey you.
Having the police handle it would have probably been the best thing for everyone… and most likely would have de-escalated the situation immediately.

Not sure what you were watching but the guard initiated physical contact first. Some of us aren’t like you and aren’t about to let others lay hands on us. We put up with enough as is. The team wasn’t aware that this load would involve a stringent security check. They don’t know these people, would you want someone you didn’t know going through your home while you’re ordered to stand at a distance with hands out of pockets while they’re free to look and take want they like? They tried to do the right thing by leaving when he decided the load was more trouble than he wanted to put up with. It should’ve ended there.
As drivers, far too often we’re not made aware of all that’s going to be involved or required with a load.
This type of facility should have its own trucks with their own company hired drivers.
Should not have happened. You saw how quickly it escalated… bet it’s a pretty common situation there.

If you open eyes, you will notice the security guard was first to put his hands on the driver in a use of force. I had a similar situation at a grocery whse. I had a back haul out of Buffalo going to RI and when I had gotten at the delivery site they wanted money to back me in quicker. Told them in so many words where to go. Then I said I’ll be back in the morning they asked where I thought I was going and I told them I was leaving . They said I can’t leave so I said ,”watch me “. Before I got to the gate the Local PD arrived and asked where I was going. I told them I was going home and when they want the load to call my dispatcher . He said that I couldn’t leave because it was their mdse on my truck . I showed him the B.O.L. and asked where they had signed it ,he said they hadn’t signed it and I said that if they haven’t signed it then its still my MDSE and he said yup , have a nice day . So, I left. My company brought the trailer back the next day and dropped it in their yard with instructions to call when they emptied it .They were charged 100 dollars per day for 2 weeks when they called to ask us to remove our trailer from their yard . Yup, I was the lucky S.O.B. to go get it .

Even a police officer does not have the right to detain you if you are not suspected of a crime, but the outcome is usually similar. Under DOT law this driver was fully within his rights to refuse a load.

A driver with a maga hat on and two black security guards. Yeah i see what happened. Been through alot of secured facilities, that never happens just by putting your hands in your pocket. I had one gaurd in my face yelling and real disrespectful last week. Called my work and the place i was delivering and told them once they are through inspecting my truck, im leaving . Told them what happened and before i could leave they had a supervisor down there , checked video and in front of wrote that gaurd up. Even ask for a statement. They really wanted that delivery. I think those gaurds did that because of the hat.

After watching the video, that was insane! After all that, he was arrested? Wow! I,for one, am going to look into assisting this driver in his fight. True, I think he reacted wrong but he was well within his right to leave and they were not within their rights to stop him. It’s gated for a reason, he did not agree to be searched to enter the gate so leaving and rejecting the load is well within his right to do so. Was there any signage stating that you will be searched if you step on the property? Or, was it more like “anyone entering this facility will be searched”? They didn’t enter, they decided to leave, once that guard decided to put his hands on the driver, he has every right to defend himself! Why wasn’t the “guard” charged with assault? Considering the location “greater Memphis”, it doesn’t surprise me that this happened.

When you are on private property you are subject to their rules. Follow their instructions to the letter. This driver brought it on himself. Pharmaceuticals are a very high security commodity. As is hauling a truckload of cigarettes. The guards were in the right to detain this driver because he did not follow the rules. Again. The driver made a mistake by putting his hands back in his pockets. He did not show respect for the security guards because they were African American and he was a young white guy who had racial bias against a black person telling him what to do. I’ve been to many places like this. Ummm no, he was not inside the facility so that does not carry. The guard clotheslined the driver and pushed him into the engine bay of the truck while the driver was holding his own pockets, there was no threat. Your comment has very little truth to it they were not technically on private property until they entered the gate they were still outside of the gate in the driveway. It is kind a hard to call any law-enforcement when you were being thrown to the ground after you try to leave second of all I’m pretty sure if he tried to stay in his truck they would’ve tried to rip him out of his truck. And now even as a company driver you do not always know what you were going to pick up sometimes you have a pretty good idea but you don’t always know I have picked up the loads for the military as a company driver and never know what was in the trailer so it sounds like you need to get your facts straight before you open your mouth.

I run flatbed for over 30 years and to this day I don’t always know what I am picking up. So no, a majority of times you may not know exactly what you are picking up. As far as food commodities, not all food commodities require a reefer.

The information about procedures at this location SHOULD have been known and understood before arrival.
Also the corporation most likely contracts with an outside service to provide security. However the corporation and security WILL pay for this assault, illegal detainment and loss of income of the drivers.

Not through the gate & bills had not been signed for acceptance so the driver is still responsible for the load by federal law. By law these guards hi jacked a federal cargo. Even on their property the load still belongs to the driver until they sign the bill of laden releasing the driver of his responsibilities.

Even with a secure facility LOL such as the one in the video The driver and his wife were still out side of the premises outside the gate. They should’ve been free to leave at any point in time that security had no right to try to even stop them. I thought that if you haul a high dollar load there were extra security requirements involved that the driver is involved in during pick up and while in transit until delivery. This driver thought he was hauling produce? Surprising that the shipper did not bother to alert him to the value and security for a CDC pharmaceutical load. Sounds like the company is making an excuse for the unethical abuse of these drivers during their security check in. Then again, I don’t know the legality of the driver attempting to leave the customer with their property in his trailer. Either way, these guards were abusive and should have called the police. I guess we should all be relieved that they did not shoot him.

He had none of their property in his vehicle, he was OUTSIDE the gate, checking in upon arrival. Once he decided to refuse the load an leave, they should have allowed him to do so, there was no good reason for it to go the way it did. Even if the driver was being a little belligerent, he had not gotten through the gate, and should have been allowed to leave.
My only question there is, could he have backed out without pulling through the gate to turn around?

Shippers may be able able to make their own rules but they do not make the laws. The security guard not only assulted the driver but can not legally detain anyone, this is America and laws are in place to protect people in situations like this. The police arrested the drivers before seeing the video of the security guard instigating the altercation. The drivers have every right to leave and should have been allowed to do so, there are no laws saying a private security guard or anyone else can detain a person, period. The drivers did not break any laws nor commit any crime. The police should have arrested the security guard who became hostile and aggressive to begin with, the law says the driver has a right to defend himself. I hope he sues the hell out of the security guards and the shipper both. This isn’t about race but I guarantee that if the drivers were black and the security guards and police were white some would be crying racism. It definitely is about aggression that is unacceptable. I have refused to service a customer who was hostile and that is my right to do so. Drivers need to be treated with respect just like anyone else, it’s time to make a stand against customers and others who are abusive toward drivers. I stand with these drivers.

As a former policeman and private security guard, I have several comments. First, seems apparent there was a major communications lapse from the broker or shipper (I am new in this biz, unknown if they were owner ops or company drivers of what the commodity was. Because the comment was uttered that if he knew how sensitive the product was, he would not have taken it.
That being said, I (and countless lawyers) would like to read the post orders to determine if physical force and the amount of may be employed. Not knowing that, it is obvious to me the guards have underwent some type of police training, for all I know they may be off duty cops.
No private officer has the right to physically restrain you or manhandle you unless the suspect draws a weapon on them, those are the generally accepted rules governing use of force.
Nothing was mentioned of any signage stating the property is under the protection of private security.
Now if I were the driver, I would have politely played (while not being happy of it) their game while making mental notes of their name tags/badge number/security company name. Once their initial investigation was finished, I would have departed and written a detailed report and turn it over to my attorney.
While I feel bad for these two, his failure to comply with guard’s orders brought this upon himself.
Unless you have been told not to leave the property, seems to me he should not have had freedom of movement denied.
So here’s what the drivers need to do. First, file a police report in that jurisdiction. Doubt they never did that. Second, get a lawyer and let them litigate. Unless the rig was towed, I don’t see much in damages, perhaps EMS transport to the local hospital and because the load was not accepted, loss of potential wages lost. That gets sticky because a middleman mucked that up, so the lawyer goes after him.
Lawyer gets maybe 40% of judgement while the plaintiffs get the remainder.
Sometimes it is just easier (I know this sucks) just to go along with the program and file a proper legal complaint afterwards.
You won’t have a shiner, guaranteed.

First of all this is not a racial incident. If you are former military or law enforcement you should notice that all the guards are wearing vest under their shirts and carrying guns, which is a clue that this is a super high value facility. As the previous commentator stated as a 15 year driver you should know better. And guards may have special police powers in facilities like these, especially if CDC is involved. DEA may also be involved. As a former L.E.O if your told to keep your hands out of your pockets, you need to do so. What’s interesting is there is no audio so no one knows the verbal exchange that took place. Rule of thumb know your load and if the load told them they needed a TWIC that should have been clue. Also truck does not need to be behind gate, the driveway is clearly the property.

He was at check in. He decided he did not want the load. Description of freight can be vauge, especially in high value items. I drive semi.
I have been in at check at military bases. They do not beat you down at the gate if you decide to leave before you are checked in. With the exception that no illegal things were found during check in. I have been at the wrong gate before, i did not get assaulted. I have decided not to get a load at places because thier check in takes too much time. I have never been beat up as a result.
Bottom line, boycott metro foods. And i feel sorrow for those drivers who were beat down for no reason.

If they didn’t know that the load they were to pick up was high security and the procedures of the facility beforehand, then they should’ve had the right to refuse the load and leave when they did find out. The security firm in handling this was wrong and no charges against the team should’ve been filed. I say get a good attorny and sue the hell out of that facility and that firm. The guy IS wearing a MAGA hat! Drivers hands were in pockets when guard shoved him against the engine compartment. Unless the driver made violent comments that the guard felt threatened by (not likely with the hands in the pockets), then this is assault on both drivers. This driver is outside the facility and has not yet checked in. While security does have the right to inspect the vehicle and the drivers at a secure facility, they do NOT have the right to detain them as long as they are still outside of the facility. This case will be thrown out by the judge no doubt. If these two are smart they’ve already lawyered up for a counter-suit. They are going to win easily and big. Just goes to show you, that you can give a person a badge and they think it means they can bully and abuse they citizenry. Color has nothing to do with it. These guards are black. I can tell you this company has a huge lawsuit coming, and the broker could be potentially brought into the suit as well. Since the driver refused the load and offered to leave, the security cop, who is not a law enforcement official, not only placed his hands first on the driver, but he also prevented the driver from leaving which is false imprisonment. The security team had no right to assault the driver or hold him against his will. Since the security coverage is covered by a third party, the coverage was probably not given to LE on sight and I can probably guarantee that the security team lied as to the details of this incident. The video does show the incident very well. Also, it doesn’t matter whether or not the driver was mouthing off or not, security did not have the right.

I watched it. The security guard wrongly stopped the driver when he wanted to leave, then pinned his wife to the ground when she went to her husband’s defense…there were way too many security guards called in for that. I agree there should be a clearly stated agreement detailing the steps security would take upon your entering their facility for a load with the driver(s) signing their understanding but! that guard was in the wrong for pushing that driver & I hope & pray that team gets Justice for the treatment dealt out to them.

Sir I am a retired US Marshal and if I had been called out on this I would have arrested the security team and know charges would have been against the truck driver and his wife. The force use against these two were wrong. NO man is too use the force they used against his wife to take her down and then sit across her body. I counted five security officers on this woman. And then eight officers on the driver excessive force was used. All of these security officers should be brought up on charges.
The take down should have only taken two officers not eight.
And if this driver is a owner operator he has the right to leave without accepting the load even if he was dispatched on it. There is nothing that says he has to take the load.
So sir I say to you get your facts right before you let your pie hole open again.
Know the law. This driver and his wife were within there rights if they wanted to leave the property.
Know man should have laid hands on him. As I see it he was defending himself. And as for his wife she was trying to help her husband when she saw all of these security officers on him.
And as I said I would have watched the security video and then turned around and arrested all the officers involved in this mess, they do not deserve to wear the uniform for they do not know what they are doing.
And for the company hiring a security company as this one they should be held responsible also. The company is responsible for who works for them. And security works for them.
Now for the driver and his wife, if you read this I say to you an hear me. Get yourself a lawyer. Have him pull the video from the company if the have cleared the video charges can be brought against them for destroying evidence this is a criminal offense. If you were charged by the local police department then bring charges against them also. DO NOT let them get away with this.

This is the brokerage fault….. if they need a driver to pickup, they should at least warn the driver ahead of time of what they are picking up and if the warehouse has any specific policy that the driver needs to follow!! How many of you drivers get a pickup load without knowing what you’re picking up, what is the weight, what are the specific instructions!! The brokerage should provide that! Like it said in the article… if the driver had known what he was picking up, he would have never accepted the load!! These brokerages were trying to blind side him into moving the frieght for them!! To look at Video Only and No Audio I imagine what the Driver said when they Security seemed to change. The procedure or protocol they were preforming were like that of going to a Military or Government and sometimes Border Crossing location and that’s how it goes. When Security is doing checking like that and having sidearm it’s probably a little more serious location. That Driver looks like his Mouth said something that changed the situation to Bad… If his conversation was disrespectful then he got a deserved butt kick. Do something wrong at Military or Government location and it will be the same outcome.

Not a MAGA hat, which isn’t relevant anyway. It says “ MAKE TRUCKING GREAT AGAIN. TRU-BALANCE”. You can’t hear what was being said, but you can see that he wasn’t being aggressive, just standing easy and talking, not getting in anyone’s face. He only reacted after being grabbed and shoved against the truck, and was immediately thrown to the ground and attacked by four guards. How is that at all okay? He was at the street entrance, OUTSIDE the security gate. His options were to comply with their security procedures in order to enter, or leave. He chose to leave, not enter, and was then attacked. Doesn’t matter what he said. They were armed, so even if he was threatening to get a weapon from the truck, they had no legal reason for physical contact unless and until he produced a weapon.
As far as not knowing what the freight was before arriving, that’s not unusual for high value or sensitive loads. I often get the high security instructions from dispatch but, except for hazmat, never know exactly what I’m hauling. Even on the paperwork, everything is described with product codes instead of plain English.

To everyone that thinks the security guard was wrong. You’re not seeing the video. The security guard’s arm was barring the drivers path in a defensive manner. The driver walked into it then started fighting when it wrapped around him.
Drivers attempt to flee when being searched is suspect at best. I don’t like security guards or police. I wouldn’t defend them if it was iffy. But this is clearly a driver not following direction because he thought he had the right to leave.

Why is it anytime something happens the race card comes into play? All three parties involved here were in the wrong its that simple. I’ve been trucking For 36 years and have picked up many times without knowing what I’m picking up. Some of you must have never been to military base before because they don’t tell you what your hauling unless it’s hazmat so unless it’s obvious you don’t know. All military bases have high value companies have procedures that are in place to protect the companies assets not only from loss but to protect general population if there is health risk involved or a matter of national security. The military will know who you are before you enter the base that I promise you but companies like this have no idea who you are or if you’re even supposed to be there so they have procedures to follow in order to identify you and just not allowing you to leave without identifying you is one of them. The driver should have just said he didn’t want to haul the load and asked if he could call his company and probably kept his hands out of his pockets also but he chose to not comply and this is the results of his actions could it been handled differently yes should it had been handled differently definitely. There is no audio so who knows what was said before or during this situation but you can’t make a race issue out of every situation that’s just plain ignorant.

Looks like he was the antagonize. You can see his aggressive behavior. Maybe they didn’t want their meth confiscated. If they were not doing anything wrong both of them would not have been detained. Both of them would also not have been on the defense. He started it then he cries because they lost. I’m sure those guards deal with all types of people.. This has nothing to do with race. I would love to hear the audio. Perhaps there was a guard on the truck already….or in the back. Noone is going to stop you from leaving unless there is a valid reason. Probably drugs and alcohol on the truck and when a company have this level of inspections… neither are allowed on the premises. He definitely needs another hat to cover that bald spot… but you couldn’t have thought with that hat and that attitude he was going to get in and out unscathed.

There was no immediate threat for guards to legally use force unless they felt unsafe and in self defense only…which was not the case here obviously! If the other person walking away you have no right to attack him or God forbid shoot at him according to federal law. Plus they are not sworn officers or gov employees to be able to act like they did. Their job is to observe and report only! Any property damage being done for example it should be reported to local police and then you can pull civil arrest and detain the perpetrator. Other then that and with no immediate threat to you and/or property you guard you can only observe and report.
As we can see in the video this was obvious aggravated assault with intention to physically stop other person.
I hope the driver and his wife do lawsuit against pharmaceutical company and security contractors and their security contract company

It has been proven in court is it that truck is considered a living domain buy that driver and wife . regardless of any rules and regulations did that company metro logistics may have US law supersedes . And the law states a pond refusal of entry into the vehicle and he law or government agency will need a written warning signed by a judge . And in a private setting by a corporation there also has to be a written signed order entry by the driver and his wife . I’m sure in the heat of the moment the driver and his wife were not thinking clearly , what they should have done was call the local police and say they are being held against their will having the garbage and the company charged with kidnapping . As for the video goes and yourself by the security company they will and should be charged in a court of law and any lawyer will make sure that this happens and the husband and wife will be rewarded . I am sure the following statement will be disagreed by many drivers that read this . There is no driver respect anymore a large part of that disrespect his came from drivers with in the last 10 to 15 years them self . I was new driver at one time about 38 years ago . That was a time when men and women wanted to do this job they weren’t being forced to do the economics . They were trained by other drivers that want to do this job and were respected for doing it because they carried yourself respect themselves . It never was he’s not today and it never will be tomorrow a job it is a way of life . It’s not about passing a test to get a license At all. Anyone can go to a school and learn how to pass a test it is not everyone can be a truck driver that was born to do this . Not a driver that was made to do this and if you are a real driver you’ll understand that statement if you are not then you will be offended by that statement . This is a Federal court case if i ever saw one. The security personel had no authority to hold that man against his will once he made the decision to reject the load and leave the facility. They are NOT law enforcement officers therefore have NO peace officer powers and no authority to detain him if he was leaving. There was no reasonable suspicion to suggest he was up to anything other than to pick up a load. THEY called him there. When he told them he was leaving, They should’ve let him leave. “Academy Rejects” is right. Inspection to enter yes but he had not entered & they had not signed his bills so by law he is still responsible for the load to do what he assume to be best at the time. Let’s look at the obvious.
1.) A guard shack… first sign security check point. Paperwork, trailer seal procedure (if there is a trailer seal) and the guard gets to look in trailer if required or if they feel it’s necessary. NOTHING NEW for drivers. Has never needed to be explained or spelled out for me.
2.) Type of gate indicates they take security seriously (not some cheap chain link)
2.) Searching vehicle undercarriage, they take security seriously.
3.) Guards appear to be armed guards (higher level of security) they take security seriously.
4.) Multiple guards, they take security seriously
5.) The company’s property both in the vehicle and vehicle on their property, their rules.
Would love to here the exchange while the driver was still truck… willing to bet he was confrontational and trying to refuse the search.

The video doesn’t state what transpired prior to the contact. Based on the statements by the driver, and the video compilation, it appears there’s more than meets the eye to this story. The property is contracted by the U.S. CDC, and has clear instructions upon entering the property. One of which, all vehicles and persons are subject to search. Obviously, the driver breached the procedures, which led to a containment, and inspection of the carrier. The carrier has a signed agreement with the shipper. Of which, outlines indemnity of the shipper in the event of confrontation by the carrier’s employees, during a security breach. The video clearly show this process in full execution. The driver is obligated by the carrier’s agreement to fully cooperate with asset protection to determine the nature of the breach. As depicted by the video, the driver refused. The asset protection used minimum force to detain the driver. The only punches are from the driver. And, the co-driver blindsides another guard, in an effort to obstruct that detainment. Both were subdued with minimum force. There is no defense. The driver did not cooperate with asset protection, and the situation quickly escalated. We also must error on the side of the shipper, as we do not have audio. I’m sure the driver engaged in colorful language, as you clearly see the guard began to posture, prior to the driver being detained. At this point, minimum engagement was untilized, as the driver began to physically assault the guard. And, the co-driver appears running to obstruct that detainment. The shipper fully provided all neccessary procedures, to include providing medical assistance to the injured, all while the cameras are in full operation. I’m sure the shipper has audio to this event, and is not providing the evidence, as the Prosecutor is fully investigating the incident. Don’t be quick to judge, the Courts will fully review the matter via investigation by local authorities. Apparently, the driver thought he was going to tell the shipper how it was, and lost the battle to the shipper. Moreover, he will be fired by the carrier. That’s the least of their problems, as both of them may lose their license to operate a CMV. The evidence by the video, clearly establishes a case for that. Not to mention, the carrier’s negative report
that will be provided to DAC. What a stupid action on behalf of these two drivers. I hoped it was worth it. Because, on this specific day, these two drivers brought reproach on the entire industry of hard working professional commercial drivers.

This happened to me once when I was hauling dildos. The guards jumped me but didn’t hurt me. They just made me show them what DOT does to me when we get in the truck and close the curtains. I showed them everything the DOT does with a big black dildo to get out of any tickets.

First off, if you are on “Federal land,” you don’t just get to say oops just let me turn around and be on my way. “Inside the gate” is the same as “outside of it..” Once you are there, you are under federal jurisdiction. The guard does not know, “until the truck is cleared,” that there is no threat level. This may be a “one way in,” “one way out” facility with spikes, or a line of trucks may be blocking him, or there is simply no way to bag out of there by design. I don’t know… All I know is, if guy have guns and say do not go back to get in your truck, “I” am going to listen..
This has nothing to do with race or politics, only common sense, respect, and authority! If the guards were white and the driver was black, the same result would have happened! It doesn’t matter who touched who first.. The guard has every right to stop a person from going back to their truck “if” the federal rules states it. The guard was using his body posture to stop the driver. The driver tried to go around the federal contract guard. Then the guard put his hands up against the driver in a none violent manner to further his point that the search is going to happen regardless. Then the driver went off and used force against the officer and it didn’t end well for the driver!
A.) The driver should have known and looked into where he was picking up and delivering to! Poor planning…
B.) The driver should have remained calm and followed instructions and complied!
And C.) The driver should never have touched a federal contract security officer because they are treated just like a regular federal officer in the eyes of the law when protecting federal property!
This driver and his wife (team) actually have no leg to stand on… Winning a lawsuit in court is already difficult at times. But winning one against a government entity “when you didn’t comply” is almost virtually impossible… Lick your wounds, mend your pride, and become a better citizen because of it.

I think not. That would be false imprisonment..possibly kidnapping and assault in any state. Second you cannot just make up security procedures on the fly… There would have to have been a notice posted…something on the order of “subject to search” …offer and acceptance….without an offer there can be no acceptance. Finally no person has the “right” to place their hands on another person against their will that is assault.

There are law firms that represent truckers. A dash cam with multiple cameras would have ben a big help on a lawsuit. Most security guards are alright but some think they are God. Same for local police.

After viewing the video, the guards had no right to stop the drivers from leaving. They had not signed any paperwork nor entered into the facility. The guard started the hole thing by pushing the driver up against the truck for no reason. As I understand it, from several years back , the drivers were on public property up to the gate at the time. Example in Kentucky- a place of business is considered to be public property as long as their open for business, ( we’re talking about the general business areas, not behind a fenced area or office areas) once it’s closed to business,the property converts back to private property. This driveway to this facility should be public access to the gate as long as they are open for business. But, we’re not in Kentucky. I hope that an attorney will take a very strong look at this video and do what he or she can to right the wrong for these drivers, I think they had the right to leave any time before entering the gate or signing any paperwork! Hopefully!

I go through these type of searches all the time. The company Panther picks up these loads all the time. They should have instructed the drivers of what to expect. I blame the driver for have a attitude towards the guard. They need to stay pulling General freight.

Oh I also loved how the first security guy really didn’t want to keep him there. It looks like the guy in tan was the one all over it. Heck even after they took the driver down the first guy was more interested in grabbing his hat than helping with the driver. The tan guy seemed to have an “issue” with the driver. He after all was the one I would call throwing the first punch. Then the white guy with the beard seems to come in like a tough guy and runs his mouth while waving fingers. They could’ve taken the driver down with a lot less force. Slammed his face in the ground pretty good. In my neck of the woods security are not entitled to the same authority as police. Rent-a-cops are not police! I feel bad and could easily see this happening to lots of drivers I know…

So security actually laid hands on male driver 1st, driver was defending himself when fighting with security and wife clearly was defending husband. Shame on Panther for not being clear on what driver was suppose to be picking up. Driver could have also said “let me confirm with company what is to be picked up.” Or security could also have mentioned that load was sensitive, giving driver the chance to call company to clarify. (As usual rent a cop trying to push his weight around.)
Also why would Officer allow 2 strangers to take copies of DL from Panther drivers on their PERSONAL CELL PHONES! Not telling strangers that they will get a copy of the personal information from the police report. Shame on her, those 2 guys were quick to snap pictures. Who did the 2 guys share the information with? This crap is so wrong… Shame on Panther, security company, and clowns who assulted both drivers, thats BS… Both drivers need to find a good attorney, request copies of video posted for proof. I showed that video to a CHP. He said they had no right to stop the drivers from leaving and absolutely no right to attack him and beat him and his wife up. He said it wasn’t private property. Even if it was on the driveway the guards should have been arrested for assault. My question is what became of truck after drivers went to hospital?

No company has the Right to DETAIN me as a driver and better not ever try to. I have the RIGHT to deny ANY load I want, and they can just make other arrangements for it. For whatever reason the driver was choosing to leave, and that was his RIGHT. It should have ended right then and there. Now, you have all sorts of retaliation coming the offender’s way, to include lawsuit’s, boycott’s, PR problems, and possible harm to the security detail involved away from the property. My personality won’t allow me to pick-up or deliver there, as my tolerance for BS is sub-zero.

The driver should have never permitted the inspection, told security he thought he was picking up produce, and requested a turnaround. Instead, he wrongly assumed he could just waltz out. While I totally disagree with what happened here, my first thought is how the load was obtained. Was it from a Broker, a Dispatcher, or whomever, and what sensitive information was provided with the dispatch. For example, based on the load being sensitive, what to expect at the pickup location.
There’s an old saying that “Prior Planning Prevents Piss Poor Performance!” As Professional Drivers we plan based on the information we receive. SOMEBODY should have made these drivers aware and this situation could easily have been avoided!
Too many times we as Professional Drivers get caught in situations where we don’t have the information we need in order to be successful. Consistently, we are rushed and manipulated into dispatches half cocked only to regret it later.
DRIVERS! This is yet another prime example of why we need to TAKE CONTROL OF THE DISPATCH prior to just taking off with it. On the words of one of my military trainers; “One Somebody Didn’t Hear That!”

All trucks will be inspected entering the facilities. The driver decided not to enter and was did not enter the facility so therefore the inspection should of ended there.

When the driver said no, I’m leaving, that’s that. You had wannabe police way overstep their bounds. I would sue that security company into the Stone Age. I hope the Kirkers’ have hired a good lawyer because, with this video Metro Logistics, their private security company and the individual rent-a-cops are in deep crap. Not having entered their security gate the security had no legal right to stop the Kirkers from refusing the load and leaving. As videos do not lie, the security obviously started the altercation and Clinton had every right to defend himself. Whether they were found guilty by some kangaroo Mississippi court or not this video, especially seeing it is a company video, should be worth much gold to the Kirkers. The video should also be fair warning to all truckers to avoid going anywhere near Metro Food/Metro Logics. I think I’ll send a copy of this article to my Congressman to see if he can find out what connection the CDC has to Metro Logics.

A jury trial has been set for May 30, 2019 @ 9 am in Hernando Mississippi. The only charge I’m now defending is interfering with a business. They had no lawful reason to stop me as now crime had been committed. Had the guard not held me against my will and been allowed to leave, my truck wouldn’t have blocked the entrance to the facility. The caused the interference and my attorney will easily prove this simply by showing the jury I was going to the truck when I was blocked and Assaulted by not one but several guards.

The security guards should get sued they cannot detain or arrest they can as a normal citizen do make a citizens arrest if a suspected crime has been committed however this wasn’t the case if they wanted to leave they should not have been stopped based on what I saw this could have been prevented procedures explained military training is one thing comment sense and arrogance along with ignorance is another. The guard tried to block the driver they should have been allowed to leave the guards provocated then escalated the already volatile situation they were not trained properly should be suspended and sued even jailed in my opinion based on this video alone.

I see two sides to the story. I am a security guard captain, and a military vet. While I’ve never had to “rough up” anyone, simple explanations as to what is going on and why makes a difference. Most truckers know their load beforehand. They know what they need to pick up, and the location for the source. Sometimes they get lost, and I help them out so they don’t get fined with no truck zones. It’s a mutual respect. Terms like “rent-a-cop” or “not a real cop” from the source of this conversation is no different than saying if you have a CDL, you must be a perfect driver.
