Not necessarily. We obtained a judgment against someone years ago. The problem is after that someone's employer was served with the payroll garnish order the someone quit that job. If we wanted that someone to have their funds garnished we would have to find that someone when he or she hires on somewhere else. Its not worth it. But we have been through that side of Judgements in our courts here.G13Tomcat and Texas_hwy_287 Thank this.

Oh wow this happened to you in Texas? Did your attorney ever try to file a writ of execution or were you pro se?

If you were in Texas and you were an employee, whether W2 or 1099, I would have suggested filing a wage claim with TWC. It's free for you to file the claim and they do all the leg work with investigating it, if you didn't want to take the guy to court. But being in Georgia or whichever state you are in I am not sure how that would all work, if they have a workforce commission similar to Texas or not. I worked for someone once who had a written contract with me, on 1099. Paid .36 cpm. Noticed my pay was never accurate and when confronted they claimed they "told me" the first 50 miles of deadhead was free. Filed the wage claim and TWC found I was owed even more money than I thought I was owed. Of course the company waited until the last day to appeal, and they ended up giving me what I originally asked for, which was in all honesty all I could figure they owed. I didn't even agree with what TWC came up with in their findings. I wouldn't have felt right taking it, either. I know this is a post from January so sorry to anyone in advance for any frustration in "resurrecting" an old thread.

Did you sign anything saying that it was settled? If not, you may be able to get the rest of what you are owed. Workforce commission in Texas has a 180 day time limit to file a claim, I am sure any workforce commission where you are probably has the same kind of time limit. But if you are happy with half, I suppose that is better than nothing at all. Karma will get that guy.G13Tomcat Thanks this.

I would contact Macon intermodal, and make them aware. I would advise them that you plan to sue. The may cut him off, until he pays you. You can also try taking him to court yourselfG13Tomcat Thanks this.
