What you describe here is cut and dry Theft by Deception. If you can prove beyond a reasonable doubt that this person was planning on or prepared to act contrary to the arrangements you two agreed upon then proceed as if he walked into your home and took your stuff.

I plan on checking the truck later this week to assure everything is the way it was left. If the km are way above what they should have been or if I mechanicals dont look right. I will not be picking up the truck and sueing him for the payment. Otherwise, i will pick it up.

Waste of time; they won't do anything. At best, it is a civil issue, not criminal, but based on the OP's posts not even that.

Knowingly leaving the truck with an untrustworthy person puts you at fault as well for not acting in a reasonable manner to prevent further loss.not4hire Thanks this.

Guy already said he doesn't want the truck. He indicated his change of mind by stopping payment. Go get the truck, find another buyer.
Suing him (other than for specific damages; e.g., physical damage, excessive mileage, missing equipment, etc.) is a waste of time and you'll just be throwing good money after bad. -
He's got your truck,
You got no money,
He's had it for 2 weeks,
He canceled your check,
He won't talk to you,
He won't bring the truck back,
You can't be this naive.
Basically,he slapped you in the face,took the keys
Out of your pocket and dared you to do something
About it. Then drove off in your truck.
I can't be anymore straight forward than that.
That's his truck now.
You better take some law enforcement or some tough guys With you if you decide to go get it now.
He already considers you weak, he's just not gonna
Hand you the keys and say he's sorry.
It could get ugly, so don't go there alone.
