Log hours for days stranded?

    So, this truck is spitting out black smoke and will only climb hills in 1st gear. Even the it over heats every 1/4 mile. Highway Patrol warned me to stop, fix the truck. The boss says continue. CHP, so no. Safety, so no. I'm parking it. I expect to remain parked for two days. Can I PTI and log hours for two shift, since my orders are to continue? And, yah, I'm paid for down time.

    You *can* log the hours as on-duty, but why would you? If you have to do it to be paid (although I've never heard of that), then so be it. It is not legally required (assuming you're staying at a motel and not using the sleeper berth, but if you are you would log SB as appropriate).

    Park, go to off duty, make a notation for breakdown. Police might say that you need to have sleeper noted when you are in the sleeper. Don't worry about that. If you start going from sleeper to off duty you might accidentally go to on duty. Just leave it in off and wait it out.

    Your in a truck that keeps overheating,
    Will only climb a hill in first gear and a boss telling
    You to keep on driving it.
    You got way bigger problems than that log book.
    While your sitting you should be looking for a new job.

    I'd log off duty also. If your in motel your off duty. You could log all the time if you wanted to but no reason. You get breakdown pay you said. So sit back and relax till they fix the truck. It does sound like to boss is pretty cheap and the truck has more thing wrong then they want to fix. I hope they actually pay you breakdown pay. Hope the boss is paying for motel room. Most shops won't let you stay or sleep in the truck when being repaired.

    Unless there is something out of the ordinary going on when you are NOT on line 3 (on-duty driving) you are NOT making any money! I advise staying OFF line 4 unless you have been told directly otherwise by your supervisor or boss.

    I not going to say what you should do, but as long as it's broken down on the side of the road (and not in a shop) legally it's on duty.

    On-duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work. On-duty time shall include:

    (6) All time repairing, obtaining assistance, or remaining in attendance upon a disabled commercial motor vehicle;

    ####, guess I should've logged on duty while putting new air lines on the truck in my driveway a little bit ago, lol.

    If your not being constructive for the company, then I wouldnt log it. As your burning up your hours.
