Log book rules for owner operator

    hello everyone,
    I have a owner operator that has gotten his own authority. He will be hauling for us and for himself under his own contracts. My questions are, what name goes on his logs? Our name for our loads and his for his loads? He will have a lease with us, do I have to stipulate that he has the right to haul outside of our company?

    I read that 4 times, still didnt make alota sense...

    Name - As in company name - Whos ever authority he's under is the name that goes on the logs. (other than his signature)

    Ya lost me on the part where he has his own authorty, but is "leased" to your company..

    I'm guessing this guy was once leased to you as a typical O/O, but he went out and got his own authority, but still wants loads thru you, yes?

    There is only one authority he runs under - either his OR yours (but it sounds like his now)

    I don't get the part where you think he is still leased to you. With his own authority absolutely he has the right to haul outside of our company. But he can get loads thru you, but they should be at a higher cut than where he was leased to you as an O/O. BTW, tecnicaly speaking he's now an independant, not an O/O if I read your post right.

    Sounds like OP meant to say he would have a contract to haul for them not a lease with them.

    I think OP meant O/O with his own authority will have a contract to haul their stuff for them but also haul other stuff as well. I could be wrong though.

    He would log under his company name what ever name his authority is under and he will keep his logs for 6 months for dot, you should have nothing to do with those or drug testing, qualification files, etc... he is the trucking company and will need to take care of those things himself. I don't know why he would have a lease agreement with you, he could have a contract with you for hauling your product or loads and for rates but he shouldn't have lease agreement with you if he has his own authority.

    Now does the company need to be a broker to contract out the loads to the newly minted Authority?

    Well if it is their product I don't think so, but if they are brokering out loads they get from their customers they are required to have Broker Authority and a bond.
