Most places I’ve talked to said it can go back 6 months to 1 year so after I get a year or a little more experience I should be able to go anywhere by then and be 100% confident

His problem is not a simple moving violation. It's closer to getting one of that huge overweight or oversized tickets that can reach the multiple thousands of bucks. As I and others have said, he needs to get an attorney (and a dang good one). I am shocked his employer did not also get a fine. They often go after both the driver as well as the authority holder in these improper license situations. I wish the OP all the best. Stay clean and at some point will have a chance at a good career. I'm trying to stay positive, but this situation is what it is.ibcalm19 Thanks this.

What sucks is what I got it in the company isn’t a authority holder. It’s a concrete company with no CDL drivers They said to haul a bobcat and at the time four months ago with no CDL education I didn’t think there was any way a truck and trailer with a bobcat on it needed a CDL. My gvwr was written on the ticket as like 30k 16 for the truck and 14 for the trailer. So it’s kind of crazy to me that they got a warning and I got the ticket but it is what it is. The state trooper said if I obtained my CDL he would be fine with a dismissal.

I'm assuming you are talking about a concrete finishing company and not a ready mix operation. Yes, it stinks. I'm hoping you can get the best outcome possible.

Oh by the way, when your shopping for a new driving job, ask them if they use hair or urine or both, Like Knight does both or at least they used to.

You had better read up on hair testing. If your hair is 12" long, and you used drugs when that last inch of you hair was"inside your head", say 2 years ago, It WILL show up. "Most" places test 1 1/2 inches of hair. There are guidelines that you can see online on the procedure. 1 1/2" goes back approximately 90 days. That is based on the average growth rate of hair on your head at 1/2" per month. It is a VERY accurate test.

The tests may be accurate in some people but it has been noted that some hair types are prone to giving false positives.

Yes, that racial thing in regard to hair is one of the primary reasons the FAST act hair testing mandate has not been put into FMCSA rulemaking yet.
My basic issue with hair testing is in general there is no real oversight in maintaining across-the-board guidelines. Carrier A might take these samples one way while Carrier B does it another way. This is why the advice to get a haircut a few months before testing makes the best sense. Don't go test looking like Mr. Clean, just use some common sense!
Let's make sure the problem with a hair test positive is clear. The FMCSA does NOT recognize hair testing currently. This means you don't have to go through SAP. What it does mean, however, is a lot of carriers report orientations when job offers are withdrawn to DAC. If you get sent home from orientation because of a hair test positive this positive has the VERY serious potential of following you because of 391.23. This is why it is IMPERATIVE you make dang sure you are totally clean urine & hair wise when you test!ibcalm19 and Dockbumper Thank this.
