Put it in your contract (rate con) beforehand. Otherwise you are at the mercy of whatever the broker feels like tossing your way.

No it's not. Brokers can easily screw you on detention, layover and TONU. You won't be enforcing it, cause you have no time to go to court for $150 and you won't get $750 put on the rate confirmation, brokers simply don't agree to that and just give loads to someone else. Then you sue. You add the lawyer fees to the amount owed. Any decent lawyer can handle this. And before you claim that doesn't work, you might want to try it. I've done it and won not just what was owed, but lawyer fees too.
And collection fees in a second suit when I had to hire someone to actually get the money owed.
